Planning and Zoning Commission
March 21 , 1972
CALL TO ORDER
The regular meeting of the Planning
and Zoning Commission was called to order at 8:00 P.M. in the Council
Chambers of Euless City Hall , with Chairman Leonard Weber presiding.
Other members present were Messrs. Harry Arth, Richard Leggett, Herman
Wallace and Turner Gauntt. (Absent were Messrs . Robert Johnson and Jack
Cline. )
Also present were City Manager C. J.
Griggs, City Inspector Jack Bullard and Recording Secretary Florence Murr.

Raymond Himes, Mdmes . Chesley Johnston and James C. McLane, Messrs. Andrew

APPROVAL OF MINUTES
Mr. Leggett moved to approve minutes of
the regular meeting dated March 7, 1972, as written.
Mr. Gauntt seconded the motion, and the
vote is as follows :
Ayes : Messrs. Leggett, Gauntt, Arth and Wallace

PUBLIC HEARING: ZONING CASE NO. 221
REQUEST OF J-P DEVELOPMENT COMPANY
FOR REZONING OF 3.09 ACRE TRACT IN
KITTY HOUSE SURVEY, A-678, FROM "C-2"
TO "L-1" (LOCATED IN NORTHEAST CORNER
OF INTERNATIONAL/REGIONAL INDUSTRIAL
COMPLEX PLAT ON SH183)
Chairman Weber opened the Public Hearing
on Zoning Case No. 221 to consider the request for a zoning district change
on approximately 3.09 acres located in the Kitty House Survey, Abstract 678,
from "C-2" Community Business District to "L-1" Limited Industrial District.

Chairman Weber recognized Mr. Lou Smith,
General Manager for J-P Development Company.
Mr. Smith presented over-all plans for
the International/Regional Industrial Complex, which call for a variety
of land uses. He advised that a 300 ft. strip adjacent to SH 183 is
presently zoned "C-2", with the remainder being zoned "1-2" Heavy Industrial
District. Mr. Smith explained that light manufacturing, such as totally
enclosed electronic manufacturing, and light warehousing combined with office
space are proposed for the area for which the zoning change is requested.
He stated that two small buildings are proposed to utilize the area in the
northeast corner, with 34,000 square feet in the complex. He stated that
the current "C-2" zoning will not allow light manufacturing, therefore,
this zoning change was requested.
Replying to a question from Mr. Arth, Mr.
Smith advised that J-P Development Company proposes to construct the
buildings -- that this will be a speculative venture of their own -- that
they do this quite frequently in different parts of the country, and they
are of the opinion this area is right for this type of venture at this time.
He explained that they build a "shell" which could be used for warehousing,
but they put an attractive front on it and landscape it extensively, which
brings in offices -- offices in the front with warehousing in the rear of
the same complex.
In reply to Mr. Arth's question, Mr.
Smith stated that slightly more than three (3) acres are involved in this
case and that J-P Development controls a total of eighty-five (85) acres
in this area. Mr. Smith reviewed the Final Plat of International/Regional
Industrial Complex, for the benefit of members who were absent from the
meeting when the plat was approved.
Mr. Arth asked if excessive noise from
this area would affect the hospital .
Mr. Bullard advised that he is of the
opinion the "1-2" district will generate more noise than the area proposed
for "L-l" zoning because "L-1" is more restrictive and also that this area
faces the highway.
Mr. Smith stated that the Developers
are currently writing deed restrictions, which will include noise and
gaseous conflicts.
Mr. Arth asked why the zoning change is
requested for such a small area, when the entire frontage is zoned "C-2" .
Mr. Smith advised that this zoning co-
incides with their development plan -- that a tri-level office complex is
proposed, which fits in "C-2" zoning, and they are of the opinion the re-
maining frontage property is excellent for commercial sites. Mr. Smith

stated that this type of complex must have a high traffic vantage point --
that they lease to small users, and it is surprising how many they will
get from people seeing the complex go up -- that it is better to blend
from lighter industry back to the heavier, which they anticipate being to
the South.
Chairman Weber called for proponents in
this zoning request. There being none, he called for opponents.
Mr. 0. D. McMullin inquired concerning
the location of Pipeline Road, in relation to the proposed development.
Mr. Smith advised that Pipeline is al-
most directly across SH183 from proposed Royal Park Way.
Chairman Weber declared the Public Hear-
ing on Zoning Case No. 221 closed.
Mr. Arth moved to recommend approval of
the zoning district change requested in Zoning Case No. 221 , rezoning
approximately 3.09 acres located in the Northeast corner of International/
Regional Industrial Complex, from "C-2" Community Business District to
"L-1" Limited Industrial District.
Mr. Leggett seconded the motion, and
the vote is as follows :

III .
PUBLIC HEARING: ZONING CASE NO. 222,
REQUEST OF RAYMOND RIMES FOR REZONING
5.7 ACRE TRACT IN J.P.HALFORD SURVEY,
A-711 , FROM "R-1" SINGLE FAMILY TO
"R-5" MULTI-FAMILY(LOCATED 120 FEET
EAST OF RIMES DRIVE, NORTH OF THE
SOUTHWESTERN BELL SERVICE CENTER)
Chairman Weber opened the Public Hearing
on Zoning Case No. 222, to consider the request of Mr. Raymond E. Himes for
a zoning district change on approximately 5.7 acres located in the J. P.
Halford Survey, Abstract 711 , from "R-1" Single Family Dwelling District to
"R-5" Multi-Family Dwelling District.
Chairman Weber recognized Mr. Charles
Patillo, representative for Mr. and Mrs. Himes, who presented small plats,
indicating the current zoning of surrounding properties.

Mr. Patillo pointed out that property
to the north of the tract in question is zoned "C-2", property to the east
is "C-1" and "C-2" -- that the western half of property on the southern
boundary is zoned "C-1", with the remainder zoned "R-1". Mr. Patillo com-
mented that only three (3) lots are acutally in use as "R-1" (along the
western boundary on Himes) . Mr. Patillo advised that rezoning of this
property will offer a buffer for single family area from the commercial
area along Main Street and on Fuller and Himes.
Mr. Patillo presented statistics indi-
cating that appearance of a development is the first consideration of
potential apartment dwellers -- that 43% of all married families living
in apartments have no children living with them -- that some people would
rather rent than buy -- that assuming some of these people would have
children he checked with the School District and found that Midway Ele-
mentary School 's enrollment is below the design level and, with the
opening of Lakewood Elementary, it will drop even more. He reported that
H.E.B. School District statistics show there is one (1 ) child per apartment
dweller and three (3) per single family residence -- that it would take
a house costing $49,000.00 to support one student, and he considers it
economically unfeasible to build houses which would support one child much
less three, on this particular tract.
Mr. Patillo advised that he proposes to
construct 108 units, which falls between the density requirements for
"R-4" and "R-5" zoning districts . He commented that this gives flexibility
to meet City restrictions and allows them to design buildings, which will
be above average, making the development an attractive asset to the com-
munity.
Chairman Weber asked if there were others
who desired to speak in behalf of this zoning request.
There being none, he called for opponents
and recognized Mr. Bill Lindsey, whose address is 302 Lee.
Mr. Lindsey asked if the proposed apart-
ments will be constructed on 236 loans or conventional loans.
Mr. Patillo replied that he is not in a
position to answer this at this time -- that he does not anticipate utiliz-
ing this type of money for this type of apartments -- that they are going
to make the apartments more attractive to the point that they will be above
average.
Mr. Lindsey stated that he has no op-
position to the requested zoning, but wanted clarification on that point.

In reply to Chairman Weber's question
concerning property to the West and South of the subject property, Mr.
Patillo advised that the land to the west is being farmed at this time,
and the area to the South is vacant land, which is kept mowed, but is not
being used at this time.
Mr. Gauntt inquired concerning easements
for ingress and egress to the property.
Mr. Patillo advised that Byers is the
only dedicated street -- that there are dirt roads to the West and East,
however, he has found no evidence of their ever having been dedicated
as streets. He commented that the property on the West is owned by Mr.
Raymond Himes' father.
Mr. Arth commented that, in his opinion,
the commercial tract to the north is poor zoning and asked if property
can be zoned in the opposite direction.
Mr. Bullard advised that this tract
was rezoned several years ago -- that at one time Euless Electric Company
planned to develop the tract commercially -- that a more restrictive zon-
ing classification can be placed on a property, if the owner requests it,
but to do so without a request, possibly would involve the City in a law
suit.
In reply to a question from Mr. Gauntt,
Mr. Patillo advised that he is in the process of forming a joint-venture,
which proposes to develop the tract -- that he is a partner, and they pro-
pose to develop the land as soon as he finds some more partners.
In answer to a question, Mr. Bullard
advised that 50 feet of right-of-way was dedicated for Byers Avenue.
Mr. Gauntt asked if the City's Engineers
will do a traffic study of this location, if this zoning request is approved.
Mr. Bullard advised that the only study
the City's Engineers will make will be regarding the platting of the property --
that they can require additional access before the plat is approved.
Mr. Patillo stated that he and his
associates have taken this point into consideration -- that one of their
members is a draftsman and they have adequate setback and are willing to
dedicate 30 feet and are willing to pay for paving if the City will condemn
the property on the East and West authorizing a complete new street from
North Main to Himes.
Mr. Bullard stated he is of the opinion
attempts to negotiate for the property should be made, rather than involve
the City in a law suit -- that this is the time to straighten it out, not

after the property is purchased.
Chairman Weber stated that, in his opinion,
the package which was presented by Mr. Patillo is going to complicate things
for the City, and he does not think it is a workable plan.
Mr. Patillo stated that their idea was
to get the property zoned before designing the project -- that they hope
to get property to the West, but have not approached the owner concerning
the matter.
Mr. Arth stated that, in his opinion,
the zoning done previously was abominable and on the merits of the request --
and streets are no part of it -- he does not think the City should go any
further with bad zoning.
Mr. Arth moved to recommend denial of
the request for change of zoning in Zoning Case No. 222.
Mr. Leggett seconded the motion, and
the vote is as follows :
Ayes : Messrs. Arth, Leggett and Wallace
Nays : Mr. Gauntt
Mr. Gauntt commented that, in his opinion,
the land usage is to the advantage of the City and, if a dedicated easement
across this tract could be obtained, he thinks the Commission should have
considered it.
Mr. Leggett commented that one thing
against the plan is the roads, and it should be a planned development.
At the request of Mr. Gauntt, Mr. Bullard
informed Mr. Patillo that he can withdraw his request, by letter to the
City Secretary within 24 hours, and one-half of the fee will be refunded, or
the request can go on to the City Council to see whether or not the Council
concurs with the Planning and Zoning Commission's recommendation. Mr.
Bullard stated that six months must elapse before the request is re-submitted
if the City Council should deny the request this time.
