HomeMy WebLinkAbout1976-03-16 lir Regular Meeting Planning and Zoning Commission March 16, 1976 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 8:00 p.m. in the Council Chambers of Euless City Hall by Chairman Pippin. Other members present were Messrs. Carl Tyson, Robert Johnson, Troy Fuller, Dick Wells, and Mrs. Helen Lightbody. (Absent was Carl Maas.) Also present were Director of Planning and Development, Lynn Shackelford and Recording Secretary, Becky Gunter. VISITORS Visitors in attendance were as follows: Messrs. Walter Elliott and Bill Lindsey. INVOCATION The invocation was given by Chairman Pippin. APPROVAL OF MINUTES Mr. Fuller made a motion to approve the minutes of the regular meeting dated March 2, 1976, as written. Mr. Tyson seconded the motion and the vote is as follows: Ayes: Messrs. Fuller, Tyson, Johnson, Pippin, Wells, and Mrs. Lightbody. Nays: None Chairman Pippin declared the motion carried. (Page Two, Regular Meeting, Planning & Zoning Commission, March 16, 1976) DEVELOPMENT PLAT - TRACT 401 AND 4D2, A.J. HUITT SURVEY. PROPERTY LOCATED ON THE SOUTH SERVICE ROAD OF HWY. 350, WEST OF SOUTH SHEPPARD. Mr. Elliott stated he is representing Mr. Bill Lindsey and it is their desire to plat two lots, Tract 4D1 and 4D2 of the A.J. Huitt Survey. He stated they plan to take out a building permit shortly after the development plat is approved and start the development. Mr. Elliott stated they received a copy of the City Engineer's letter and he wants to discuss item number one. Item number one of the City Engineer's letter is as follows: "We note that the coefficients of runoff used in the drainage analysis indicates the subject tracts will have improvements such as buildings and paved areas; thus, increasing the runoff to the South. We recommend that the developer be required to supply the City with an agreement between the developer and the property owner South of these tracts in which the property owner to the South agrees that he is aware there will be increased runoff onto his property and that he has no objection to this. The other alternative would be for the developer to regrade the site to allow the drainage to be to the North." Mr. Elliott stated they will not be diverting the existing drainage and does not feel that an agreement with the owner of the property South of these tracts should be required. Also, you must take into consideration that the property will be developed and not left as it is. Mr. Elliott stated that in regard to item number two, he is aware that the State Highway Department must approve these and the reason he has not submitted the plans yet is because he was wait- ing for approval of the drive approaches. Item number two of the City Engineer's letter is as follows: "The City's approval of these plans should be made subject to approval by the State Highway Department of the curb, gutter, sidewalk and drive approaches within its right-of-way." Mr. Fuller asked if Mr. Flowers had made such an agreement a requirement in the past. tir (Page Three, Regular Meeting, Planning & Zoning Commission, March 16, 1976) Mr. Shackelford stated Mr. Flowers had required the agreement on Bear Creek Estates with Priest Baze. 416, Mr. Fuller stated he does not feel the City could require an agreement such as this as the natural flow of the drainage is not changed. Mr. Tyson asked how much difference there would be due to paving. Mr. Shackelford stated there would not be a great deal and that it was immaterial to the approval of the development plat. Mr. Tyson stated the natural flow would not be changed even on the property to the South. Mr. Tyson stated the property South of the subject tracts was not developed due to the drainage problem. Mr. Elliott stated he can show plans that he made which would alleviate the problem. It was not developed because of finances. Mr. Shackelford stated the owner, Johnson Campbell , still plans on developing the property but is waiting for the economics to improve. Mrs. Lightbody asked if any of the construction would effect the natural flow. Mr. Elliott stated it would not as can be seen by the topography. Earthen landscaping will be used, which may be new to the City of Euless but is used in the City of Dallas. Mr. Elliott stated the property will be totally developed and the parking lot will have surface draining. Mr. Wells asked if the developer has to submit anything concerning the drainage. Mr. Shackelford stated they do not; the drainage is considered in the development plat. Mr. Wells asked if the drainage is checked after the property is developed. Mr. Shackelford stated it usually is not unless there are complaints about it. L (Page Four, Regular Meeting, Planning & Zoning Commission, March 16, 1976) Mr. Elliott stated they predict the amount of run-off using a 9/10 factor. Also, if a lawsuit is filed, it will be against the owner of the property so they are going to comply with all of the regulations. Mr. Fuller made a motion to recommend approval of the development plat of Tract 4D1 and 4D2, A. J. Huitt Survey deleting item one of the City Engineer's letter. Mr. Wells seconded the motion and the vote is as follows: Ayes: Messrs. Fuller, Wells, Tyson, Johnson, Pippin, and Mrs. Lightbody. Nays: None Chairman Pippin declared the motion carried. II .
