Regular Meeting
Planning and Zoning Commission
March 2, 1976
CALL TO ORDER
The regular meeting of the Planning
and Zoning Commission was called to order at 8:00 p.m. in the Council
Chambers of Euless City Hall by Mr. Carl Tyson. Other members present
were Messrs. Dick Wells, Troy Fuller, and Mrs. Helen Lightbody.
(Absent were Messrs. Carl Maas, Robert Johnson, and Bob Pippin.)
Also present were Director of Planning
and Development, Lynn Shackelford and Recording Secretary, Becky Gunter.
VISITORS
Visitors in attendance were as follows:
Messrs. Ronnie Pierce, G.W. Petrek, Leroy Bryant, Jerome C. Hebert,
A.C. Phillips, Ron Nery, Bill Lindsey, Ken McCorkle, Jerry Mills, Bill
Carmichael , Glenn Walker, and Mrs. Willie Mae McCormick.
INVOCATION
The invocation was given by Mr. Troy
Fuller.
APPROVAL OF MINUTES
Mr. Fuller made a motion to approve the
minutes of the regular meeting dated February 3, 1976, as written.
Mrs. Lightbody seconded the motion and
the vote is as follows:
Ayes: Mr. Fuller, Mrs. Lightbody, Messrs. Tyson and Wells.
Nays: None
Mr. Tyson declared the motion carried.

PUBLIC HEARING - ZONING CASE #251
REQUEST OF G.W. PETREK FOR CHANGE
OF ZONING FROM "C-2" COMMUNITY
BUSINESS DISTRICT TO "SP" SPECIFIC
USE PERMIT DISTRICT FOR GARDEN SHOP
AND PLANT SALES ON TRACT 1C AND 1C1 ,
JAMES MATSON SURVEY. (PROPERTY LOCATED
ON THE NORTH SIDE OF HWY. 183 AT THE
INTERSECTION OF WEST PIPELINE AND HWY.
183, PREVIOUS SITE OF THE SAIL BOAT
SALES)
Mr. Tyson outlined the rules for a
public hearing. Proponents will be heard first, then opponents, and
then the floor will be opened for discussion. Questions should be di-
rected through the Planning and Zoning Commission.
Mr. Tyson called for a representative
of the case.
Mr. George Petrek stated his name and
that this is his first zoning change meeting to attend.
Mr. Petrek stated it is his understanding
that the Specific Use Permit is required when plants are exibited outside
of the shop.
Mr. Tyson stated that this was correct;
if the plants were all indoors, the present zoning of "C-2" would be
sufficient.
Mr. Petrek asked if the Specific Use
Permit would include all of the property or just the portion surveyed.
Mr. Tyson stated it would include the
property 150 feet deep by 80 feet wide.
Mr. Petrek stated that this is the
total property that he wants re-zoned.
Mr. Tyson asked if trees would be sold.
Mr. Petrek stated trees would be sold
and also shrubbery.
Mr. Fuller asked if the building would
be included in the re-zoning.
Mr. Petrek stated it would be. There
will be a six foot chain link fence with a single strand of barb wire used.

Mr. Fuller asked if this garden shop
would be similar to Phillip's Nursery.
Mr. Shackelford stated it would be.
Mr. Wells asked if a Specific Use Permit
would be required for any garden shop of this type.
Mr. Shackelford stated it would be.
Mr. Tyson asked if there were any more
questions. There were none.
Mr. Tyson asked if there were any
opponents. There were none.
Mr. Wells made a motion to recommend
approval to the City Council for change of zoning from "C-2" Community
Business District to "SP" Specific Use Permit District as requested by Mr.
G.W. Petrek.
Mr. Fuller seconded the motion and the
vote is as follows:
Ayes: Messrs. Wells, Fuller, Tyson, and Mrs. Lightbody.
Nays: None
Mr. Tyson declared the motion carried.
Mr. Shackelford stated this zoning case
will be on the March 23rd agenda of the City Council .

PUBLIC HEARING - ZONING CASE #252
REQUEST OF BILL LINDSEY & ASSOCIATES,
INC. FOR CHANGE OF ZONING FROM "C-1"
NEIGHBORHOOD BUSINESS DISTRICT TO "C-2"
COMMUNITY BUSINESS DISTRICT ON TRACT 4D1
AND 4D2, A.J. HUITT SURVEY, ABSTRACT 684.
(PROPERTY LOCATED ON THE SOUTH SERVICE
ROAD OF HWY. 350, WEST OF SOUTH SHEPPARD)
Mr. Tyson stated the same rules of a
public hearing apply to this zoning case.
Mr. Ron Nery stated he is representing
Bill Lindsey & Associates, Inc. asking for a change of zoning to build a
medical and dental clinic.

Mr. Nery stated the medical building
will be located on the smaller tract and will be a modern one story
building. It will be approximately 2850 square feet and will be on the
East border of the property. The property will be landscaped and will
have a sprinkler system installed.
Mr. Tyson stated the easement between
the two tracts was not a dedicated street. He asked if there were plans
to pave the easement.
Mr. Nery stated there were no plans
at this time to pave the easement.
Mr. Tyson asked if the entrance to
both buildings would be from Hwy. 350.
Mr. Nery stated both entrances would
be from Hwy. 350.
Mr. Nery stated the development will
be in three phases. Phase one will be the development of a 2850 square
foot building on Tract 4D2. Phases two and three will be the development
of a 13,000 square foot building on Tract 401 .
Mr. Nery showed a sketch of the building
planned for Phase one.
Mr. Tyson stated the reason for the
change from "C-1" to "C-2" is because the City Ordinance requires a "C-2"
zoning for medical and dental clinics.
Mr. Fuller asked when the estimated
starting date would be.
Mr. Nery stated they will begin as
soon as they can get a building permit and everything is finalized with
their engineer.
Mr. Tyson asked if there were already
tenants for the buildings.
Mr. Nery stated that they had several
tenants but are still getting others.
Mr. Tyson asked if there were any
questions from the audience.
Mr. A.C. Phillips, 102 Sheppard, asked
if the entire strip of land between Hwy. 157 and S. Sheppard was planned
for Commercial business.

Mr. Shackelford stated that most of
that property is already zoned Commercial .
Mr. Nery located Tracts 4D1 and 4D2
on the zoning map and pointed out the Commercially zoned property in the
area.
Mr. Wells stated the property South of
Tract 4D1 and 402 is zoned "PD" Planned Development for mini-warehouses.
Mr. Leroy Bryant, 104 S. Sheppard,
asked if they planned to build a wall between the East side of Tract 4D2
and the back of the lots on S. Sheppard.
Mr. Nery stated a screening fence would
be built according to City Ordinances. A six foot wood fence or a six
foot landscape bank is planned.
Mr. Bryant stated a six foot concrete
wall is proposed behind the third lot down from Hwy. 350 on Sheppard.
When the development in the "PD" zoned property is constructed, a six
foot high masonry fence will be put up. He asked what the possibility
would be of continuing with the same type fence.
Mr. Nery stated he would check into
the possibilities of doing this.
Mr. Ken McCorkle, 108 S. Sheppard,
stated there is a five foot wall to the West on the property line and
asked if it will continue in that direction. He asked if since the fence
cannot be built on the property line because of utility lines, will
there be a five foot jog in the fence. He further pointed out the
elevation difference if an embankment is used.
Mr. Nery stated that the screening will
be done in accordance with City Ordinances and that since the buildings
will be professional buildings, they will not allow the screening to be
an eyesore.
Mr. McCorkle stated he was not concerned
with the possibility of the screening being an eyesore, but was seeking
more privacy to isolate the back yards. He stated his preference of the
concrete wall .
Mr. Shackelford stated that under a
"C-1" or "C-2" zoning, the City Ordinance requires screening by use of
either green areas, trees, or fences, but will have to be permanent.

Mr. Jerome C. Hebert, 106 S. Sheppard,
asked what effect this would have on the property tax.
Mr. Tyson stated the only property
effected by the construction and the change of zoning would be the
property that is re-zoned.
Mr. Fuller asked what kind of fence
Mr. Nery prefers.
Mr. Nery stated he prefers a wood
fence.
Mr. Wells asked where the parking would
be located.
Mr. Nery stated the parking on Tract 4D2
would be to the Northwest.
Mr. Tyson stated the developer of
the Planned Development faced financial problems because of the necessity
of draining the back of the property and it would therefore, be doubtful
if the property is developed as requested.
Mr. Wells stated the request for the
Planned Development was approved almost two years ago.
Mr. Bryant stated that a wood fence
would have to be repaired in three or four years, whereas a concrete wall
would last longer.
Mr. Nery reminded the audience that the
buildings will be professional buildings and the fence would be maintained
to keep the area looking nice.
Mr. Tyson stated the fence must be
maintained as it is required by the City Ordinances.
Mr. Bryant asked if Mr. Nery had any
objections to building a concrete wall .
Mr. Nery stated he did not.
Mr. Bill Lindsey stated there is a rock
base and if the ground shifted, a concrete wall would be more difficult to
repair than a wood fence.
Mr. Hebert asked which direction the
water will be drained.

Mr. Nery stated the water drainage will
%re be determined by their Engineer, Elliott & Hughes, in compliance with City
requirements.
Mr. Shackelford stated that drainage
plans must be submitted and approved before a building permit can be issued.
The zoning case does not require that the drainage plans be submitted.
Mrs. Lightbody made a motion to recommend
approval to the City Council for change of zoning from "C-1" Neighborhood
Business District to "C-2" Community Business District as requested by Bill
Lindsey & Associates, Inc.
Mr. Fuller seconded the motion and the
vote is as follows:
Ayes: Mrs. Lightbody, Messrs. Fuller, Wells, and Tyson.
Nays: None
Mr. Tyson declared the motion carried.
