HomeMy WebLinkAbout1975-05-20 Regular Meeting Planning and Zoning Commission May 20, 1975 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 8:05 p.m. in the Council Chambers of Euless City Hall by Chairman Bob Pippin. Other members present were Messrs. Troy Fuller and Carl Tyson; and Mrs. Jackie Comola. (Absent were Messrs. Don Perkins, Bob Johnson and Carl Maas.) Also present were Director of Planning and Development, Lynn Shackelford and Recording Secretary, Becky Null . VISITORS Visitors in attendance were as follows: Messrs. Walter Elliott, Douglas Wagner, Noah Cureton and 0. S. Denham; and Mesdms. Douglas Wagner and Willie Mae McCormick. INVOCATION The invocation was given by Mr. Carl Tyson. APPROVAL OF MINUTES Mr. Fuller made a motion to approve the minutes of the regular meeting dated May 6, 1975, as written. Mrs. Comola seconded the motion and the vote is as follows: Ayes: Messrs. Pippin, Tyson and Fuller; and Mrs. Comola Nays: None Chairman Pippin declared the motion carried. CONSIDER PLAT APPROVAL: RESUBDIVISION OF PART OF TRACT 10, ALEXANDER-CULLUM SUBDIVISION INTO LOTS 1 THROUGH 6, BLOCK 10. (PROPERTY LOCATED SOUTH OF EAST HUITT AND CULLUM DRIVE.) Mr. Walter Elliott was recognized and stated that at the last meeting the subdivision was divided into six lots and was asked to replat the plans into larger lots. He stated he is tiow resubmitting the plat for approval . He stated that three of the lots will (Page Two, Regular Meeting, Planning & Zoning Commission, May 20, 1975) 82' x 120' , the corner lot will be 105' x 120' and there is no change in size of Lot 5. Chairman Pippin asked if all the easements were shown. Mr. Elliott stated he believed so. Chairman Pippin stated he feels that this totally complies with the request. Mr. Tyson asked if the construction drawings were revised. Mr. Elliott stated yes, and that also the sewer plans were revised. He stated that they will have to tie onto existing sewer lines, open-cut across the street. Mr. Fuller made a motion to approve the resubdivision of part of tract 10, Alexander-Cullum Subdivision into Lots 1 through 5, Block 10, as presented. Mr. Tyson seconded the motion and the vote is as follows: Ayes: Messrs. Pippin, Tyson and Fuller; Mrs. Comola Nays: None Chairman Pippin declared the motion carried. II . PUBLIC HEARING: ZONING CASE NO, 246 REQUEST OF DOUGLAS WAGNER FOR A "C-2" SPECIFIC USE PERMIT FOR A COIN-OPERATED AMUSEMENT CENTER. (PROPERTY LOCATED ON A PORTION OF TRACT A, WILSHIRE VILLAGE SHOPPING CENTER.) Mr. Douglas Wagner was recognized and stated that he was presenting the case for a Specific Use Permit. He stated that the amusement center will consist of fooseball machines, pinball machines, air hockey and other vending machines. Mr. Wagner stated that the hours would be Monday through Thursday 2:00 p.m. to 10:00 p.m. , Friday 2:00 p.m. to 1 :00 a.m. , Saturday 10:00 a.m. to 1 :00 a.m. , and Sunday 2:00 p.m. to 10:00 p.m. He stated that he would be running a nice clean establishment for teenagers and young adults. Chairman Pippin asked how long he has been a citizen of Euless. Mr. Wagner stated four years. (Page Three, Regular Meeting, Planning & Zoning Commission, May 20, 1975) Chairman Pippin stated that this center would occupy two of the existing rental spaces, units 15 & 17. Chairman Pippin asked what type of regulations he would have. Mr. Wagner stated that there would be an adult attendant and that they would not tolerate unnecessary behavior. Mr. Tyson asked if he had any experience with this type or business. Mr. Wagner stated not as such, but that he has done work with vending machines and knows some people who run this type of business. Mrs. Comola asked where he was employed. Mr. Wagner stated he was a manager of a coin changer company in Dallas. Mrs. Comola stated that the hours of operation are not consistent with the Code of Ordinances. Mrs. Comola asked if the building that is being used as a church is within 200 feet. Chairman Pippin stated that the property is within 200 feet, but not sure if building to building is within 200 feet. Mr. Wagner asked which building. Chairman Pippin stated the old First State Bank Building. Chairman Pippin mentioned some of the Police calls on the last amusement center, which included drug problems, theft, fights and burglar alarms being set off. Mr. Tyson stated that the drawing shows a rear entrance and asked if it will be open. Mr. Wagner stated no. Mr. Tyson asked if there would be an entrance fee. Mr. Wagner stated no. Chairman Pippin asked what the minimum age would be. Mr. Wagner stated about 12 years old. (Page Four, Regular Meeting, Planning & Zoning Commission, May 20, 1975) Chairman Pippin read Section 10-22 of the Euless Code of Ordinances on Hours of Operation which is as follows: "The lawful hours of operation of a pool hall shall be from 7:00 a.m. to 12:00 midnight of any day other than Sunday. The lawful hours of operation of a pool hall on Sunday of any week shall be only between the hours of 1 :00 p.m. and 6:00 p.m. (Ord. No. 365, Art. III , 2, 11-25-69)" Mrs. Comola mentioned Section 10-23 of the Euless Code of Ordinances on Use by Minors, which reads as follows: " It shall be unlawful for the licensee, owner, operator or employee of any pool hall to admit to such pool hall persons under the age of seventeen (17) years between the hours of 8:30 a.m. and 4:00 p.m. of any day other than an official school holiday unless such person shall be accompanied by a parent or guardian or shall have obtained the written consent of a parent or guardian authorizing such persons admission to such pool hall during the above hours. (Ord. No. 365, Art. III , 3, 11-25-69)" Chairman Pippin stated that he assumed gambling would be disallowed. Mr. Wagner stated yes, and that he would abide by the City Codes. Mrs. Comola asked if he has made an applica- tion for license from the City Manager. Mr. Wagner stated that they were trying to get the Specific Use Permit first. Mr. Tyson asked if he was willing to comply with the Ordinances. Mr. Wagner stated yes and that he might just adjust the hours and not open until 4:00 p.m. Chairman Pippin asked to get a clarification from the City Attorney on Section 10-23. Chairman Pippin asked if the machines would be personal property or leased. Mr. Wagner stated that they would be personal property. Someone in the audience asked if there would be any cigarette machines. Mr. Wagner stated yes. Mr. Noah Cureton of 724 Koen Lane asked why they would be open on Sunday at all , that this is the Lord's Day. Mr. Wagner stated that on Sunday afternoon, people do a lot of things. Chairman Pippin asked Mr. Shackelford if this establishment comes under the Blue Laws. Mr. Shackelford stated that he could not find where it did. Chairman Pippin declared the Public Hearing closed at 8:45 p.m. Mr. Fuller made a motion to obtain clarification on Zoning Case No. 246 of Sec. 10-21 and Sec. 10-23 from the City Attorney and the Permit Office as to the interpretation of these two sections before making a decision. Mrs. Comola seconded the motion and the vote is as follows: Ayes: Messrs. Pippin, Tyson and Fuller; and Mrs. Comola Nays: None Chairman Pippin declared the motion carried. III .
