HomeMy WebLinkAbout1975-03-04 Regular Meeting Planning and Zoning Commission March 4, 1975 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 8:00 p.m. in the Council Chambers of Euless City Hall by Chairman Bob Pippin. Other members present were Messrs. Don Perkins, Troy Fuller, Carl Maas, Carl Tyson, Bob Johnson, and Mrs. Jackie Comola. Also present were Director of Public Works, Jack Bullard and Recording Secretary, Becky Null . VISITORS Visitors in attendance were as follows: John B. Mitchell , Jr. , Tom Whittaker, Gene Horrigan, Bill Kirkley, Martin Poslick, Francis Sees, J. R. Hampton, Bruce Greensmith, Terry Castleberry, Edward R. APPROVAL OF MINUTES Mr. Johnson made a motion to approve the minutes of the regular meeting dated February 18, 1975, as written. Mr. Fuller seconded the motion and the vote is as follows: Ayes: Pippin, Perkins, Fuller, Maas, Tyson, Johnson, and Mrs. Comola Nays: None Chairman Pippin declared the motion carried. (Page Two, Regular Meeting, Planning & Zoning Commission, March 4, 1975) PUBLIC HEARING: ZONING CASE NO. 244 REQUEST OF DR. RICHARD J. THOMES FOR CHANGE OF ZONING FROM "R-1" SINGLE- FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT DISTRICT ON LOT 9, 10, 11 AND PART OF LOT 12, RAY SHELTON SUB-DIVISION AND TRACT 4A, B. F. CROWLEY SURVEY. (PROPERTY LOCATED NORTH, EAST AND SOUTH OF ELEVATED WATER TANK) . Chairman Pippin opened the Public Hearing and stated the rules of conduct for a Public Hearing. Walter Elliott was recognized and stated that he represented Dr. Richard Thomes. He stated that they had submitted some questions and changes to their financial advisers and the information they requested was not back in time for the meeting tonight. Mr. Elliott requested that the meeting be postponed until the March 18th, meeting so they could get the informa- tion back from their financial advisers. Chairman Pippin asked to what degree the information would change the plans. Mr. Elliott felt that it would be important on an overall degree, that this would help answer questions that have come up at the meetings held with the homeowners. Chairman Pippin asked if there were any questions directed to Mr. Elliott. Chairman Pippin asked Mr. Elliott how many meetings were held with the homeowners. Mr. Elliott stated two. Mr. Denham of 102 Walnut Way was recognized and he stated that he represented the people of Royal Oaks. He stated that he felt that the meeting tonight should go on. Chairman Pippin stated that the meeting has already been postponed once and he felt that it would be to the best interest of the people to have the facts. Mr. Tyson felt that if Mr. Elliott was not ready, then there was nothing to address. Mr. Maas stated that he is for the postponement. Mr. Fuller felt that if the plat will be changed, they will need more time to look at it. (Paqe Three, Regular Meeting, Planning & Zoning Commission, March 4, 1975) Chairman Pippin stated that he would like all the facts in order to make a judicial decision. Mr. Fuller asked Mr. Elliott if they will have something to look at before the meeting if it is postponed. Mr. Elliott stated yes. Chairman Pippin asked if they would be guaranteed to have the material by March 18th or if they needed to look at another date. Mr. Elliott stated that on their part it would be ready. Mr. Pippin asked if they planned to have an additional meeting with the homeowners before this meeting. Mr. Elliott stated not unless they request it. Mr. Denham stated that March 18, would not be satisfactory because there will be PTA meetings that night. Mrs. Comola asked Mr. Elliott if they could assume that if the funds were not committed, the rezoning would not be needed. Mr. Elliott stated that most definitely if funds are not available, , it would not be possible to push this project at this time. Chairman Pippin asked the people in the audience if April 1 , would be suitable. Mr. Hampton of 103 Shelmar stated that he felt that they were always on the defense, that whatever Elliott pushed they had to defend themselves. He stated that this was procrastination and that Elliott would have his way whether they wanted it or not. Chairman Pippin restated his question as to whether April 1 , would be preferable to March 18. Mr. Denham stated that it would be. Mr. Johnson made a motion to postpone the Public Hearing for Zoning Case No. 244 until April 1 , 1975. Mr. Maas seconded the motion and the vote is as follows: Ayes: Pippin, Fuller, Maas, Tyson, Johnson and Mrs. Comola Nays: None Abstain: Perkins Chairman Pippin declared the motion carried. (Page Four, Regular Meeting, Planning & Zoning Commission, March 4, 1975) Mr. Mel McReynolds of 208 Oak Forest Trail stated about the two meetings with the homeowners they decided there needed to be some changes. The first meeting almost no one knew about it. The second meeting, Dr. Thomes stated that there was one change. Also Dr. Thomes stated that the Homeowner's Association was not an organized body. Mr. McReynolds wanted him to know that they have chartered the organization. Chairman Pippin stated that the first postponement was because of a legal standpoint, that six homeowners were not notified. He stated that this postponement is to clarify some questions. Mr. Iva Starnes of 207 Oak Forest asked whether or not there should be some consideration to the previous hearings. Chairman Pippin stated that there has been no hearings. Chairman Pippin stated that there will be one hearing and then they will recommend to the City Council of the decision. The City Council will consider it then and have two readings. Mr. Hal Fergusson of 101 Walnut Way asked Mr. Pippin if there will be any penalties or anything to assure that the April 1 , meeting will be held. Chairman Pippin stated that they do not have the authority to penalize any body. Mr. Fergusson stated that Dr. Thomes should have taken all this into consideration when he requested this change. Mr. Ronald Hughes of 207 Walnut Way stated that he had an opportunity to look at the plans and do some research from their side. He stated he would like to have another opportunity to look at the plans again. Mr. Doug Mayer of 304 Trailwood asked if it was possible if they could get any plans, if the City could provide them to the Association. Mr. Bullard stated that as soon as plans are presented to City Hall , it becomes public information. Chairman Pippin declared the Public Hearing closed at 8:40 p.m. Chairman Pippin recalled the meeting to order at 9:00 p.m. to consider a request to the City Council . Mr. Maas made a motion that the City Council of Euless meet with the Bedford City Council and obtain a meeting Slowwith Hurst City Council to correct a drainage problem on Pebble Creek. (Page Five, Regular Meeting, Planning & Zoning Commission, March 4, 1975) Mr. Troy Fuller seconded the motion and the vote is as follows: Ayes: Pippin, Perkins, Fuller, Maas, Tyson, Johnson and Mrs. Comola Nays: None Chairman Pippin declared the motion carried.
