HomeMy WebLinkAbout1974-03-05 Regular Meeting Planning and Zoning Commission March 5, 1974 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 8:05 P. M. in the Council Chambers of Euless City Hall by Chairman Carl Tyson. Other members present were Messrs. Herman Wallace, Ray Ozebek and Don Perkins. (Absent were Messrs. Richard Leggett, Bob Pippin, and Robert Johnson.) Also present were City Inspector Jack Bullard and Recording Secretary Della Houy. VISITORS Visitors in attendance were Messrs. Byron Zirkle, James R. Robertson, Marvin B. Walton, Kenneth C. Newman, Ray Mixon, Burley Owings, Stanley Smith, Manning Grinnan, Jr. , Thomas W. Allred, Lloyd A. Graham, Bill McLindon, and W. W. McCormick; Mesdms. L. A. Graham, Ray Mixon, and Glenna Owings. APPROVAL OF MINUTES Mr. Ozebek moved to approve minutes of the regular meeting dated February 19, 1974 as written. Mr. Wallace seconded the motion and the vote is as follows: Ayes: Messrs. Ozebek, Wallace and Tyson Nays: None Chairman Tyson declared the motion carried. PUBLIC HEARING - ZONING CASE NO. 237 REQUEST OF MR. RAY MIXON FOR CHANGE OF ZONING FROM "R-1" SINGLE FAMILY DWELLING DISTRICT TO "SP" SPECIFIC USE FOR OUTSIDE STORAGE OF CONTRACTORS EQUIPMENT ON LOT 2, BLOCK 10, BELL RANCH TERRACE ADDITION NO. 1 , (PROPERTY LOCATED 70.0' SOUTH OF SIGNET DRIVE ON PROPOSED CROWE DRIVE. ) Chairman Tyson opened the Public Hearing on Zoning Case No. 237, request for change of zoning from "R-1" Single Dwelling District to "SP" Specific Use for outside storage of contractors equipment on Lot 2, Block 10, Bell Ranch Terrace Addition No. 1 and recog- nized Mr. Ray Mixon. Mr. Mixon stated that he requested this rezoning because he wants to use this lot to store his construction equip- ment when it is not in use. Mr. Mixon stated that he contracts work by (Page Two, Regular Meeting Planning and Zoning Commission, March 5, 1974) the hour and his equipment is not used at this location. Mr. Mixon further stated that if the surrounding property is developed, he will move his equipment to another location. In reply to a question from a member of the Commission, Mr. Mixon stated that the only time the machinery is running is in loading and unloading the equipment, that when he finishes a job he brings the equipment back, unloads it and washes the equipment down and it remains idle until he loads it onto his tracks from .another job. Mr. Mixon stated that he never works on his equipment after dark. Mr. Ozebek inquired concerning the storage of gasoline and Mr. Mixon stated that he has a portable storage tank that he carries to the job with him and he uses diesel fuel . Mr. Mixon stated that the maximum capacity of the tank is 250 gallons. Mr. Tyson inquired concerning a City ordinance governing storage of diesel fuel , and Mr. Bullard stated that the City does have an ordinance regulating the amount of storage of volatile liquids and the Fire Marshal would have to comment on what is legal . Mr. Mixon stated that if it is required and would be safer, he will put his tank underground. Chairman Tyson inquired if there were proponents present. Mr. Burley Owings stated that he owns • the property south of Mr. Mixon and that he has no objections to this rezoning. Mr. Owings further stated that Mr. Mixon keeps the lot very clean, more so than some undeveloped land, and that there is no noise from the machinery. Mr. Owings stated he would rather see the storage of the machinery there than something else more distracting. (Mr. Perkins arrived at the meeting at 8: 25 P. M. ) Mr. Kenneth Newman, 502 Yorkshire Drive, stated that he lives across the street and he has no complaints about Mr. Mixon; Mr. Mixon always kept the vacant lots mowed and cleaned on his own time to prevent grass fires. Chairman Tyson read a letter from Mr. F. S. Stearns, 507 Yorkshire Drive, as follows: "Because it is doubtful that we will be able to express our views in person, March 5th, please accept this letter as our contribution to your decision making process relative to the petition of Mr. Ray Mixon for change of Zoning District from "R-l" to "SP" on Lot 2, Block 10, Bell Ranch Addition No. 1 . We have no objection what-so-ever to this change in zoning, provided that it is not a permanent change. In our opinion, Mr. Mixon should be able to use his property for storage of his equipment for as long (Page Three, Regular Meeting Planning and Zoning Commission, March 5, 1974) as the surrounding area remains undeveloped; but when single family development of the area does come about, as it inevitably will , he must be prepared to store his equipment elsewhere. We would strongly object to spot zoning changes in that undeveloped area of a nature which would permit anything but "R-1" use of the land. (Permanent, Long-term) Mr. Mixon is a fine neighbor and a sound businessman who takes excellent care of his capital equipment and personal property. His lot is not a nuisance in any respect, nor do we expect that it would become one for as long as he is permitted to use the lot for that purpose." Chairman Tyson inquired if there were any opponents to this zoning case present. Mr. Marvin Walton stated that he owns the property at 501 Yorkshire and that he lives in Houston, that he does not want to speak against this rezoning nor has any objections against the storage of the equipment, but if the City allows this Specific Use on this property, what will prevent other property owners from obtaining a Specific Use for other purposes. Mr. Tyson informed Mr. Walton that each zoning request is discussed and voted on for its own merits, and one rezoning doesn' t set a precedent. Mr. Walton inquired if the zoning request was approved, would the zoning ever revert back to "R-l" zoning. Mr. Bullard stated that the zoning request is for a Specific Use for the storage of construction equipment and when the equipment is gone, the zoning will revert back to single family zoning. Mr. J. R. Robertson stated that he lives across the street from Mr. Mixon and he is in agreement with the letter from Mr. Stearns, that he is opposed to permanent zoning that may devalue his property. Mr. Wallace inquired if anything has been requested for development in this area. Mr. Bullard stated that he has had several inquiries along the highway, some inner lots that were requesting "C-2" Commercial zoning for garages and auto shops, that were denied. Mr. Bullard stated that he advised Mr. Mixon that the Commission may require screening or fencing, and if they do require the screening, they need to stipulate what will be required. Mr. Byron Zirkle stated that Mr. Mixon has planted shrubbery around this lot and he believes the shrubbery is more attractive and he thinks it would be foolish to require fencing. (Page Four, Regular Meeting Planning and Zoning Commission, March 5, 1974) Mr. Ozebek inquired if Mr. Mixon is bothered with children playing in this area. Mr. Mixon stated that he has never had any trouble with children because he does not let children around his equipment. Mr. Owings stated that sometimes a fence attracts the children and they will try to climb the fence, and he believes the shrubbery would be better. Chairman Tyson inquired if there were others present who wished to speak; there being none he declared the Public Hearing closed. Mr. Ozebek moved to recommend approval to Zoning Case No. 237 for change of zoning on Lot 2, Block 10, Bell Ranch Terrace Addition No. 1 from "R-1" Single Family Dwelling District to "SP" Specific Use for outside storage of contractors equipment with the following conditions: that the permit be granted for a one (1 ) year duration and granted that Mr. Mixon still own the property and equipment and that screening not be required, using the present shrubbery and any future shrubbery Mr. Mixon wishes to place around the lot. Mr. Wallace seconded the motion and the vote is as follows: Ayes: Messrs. Ozebek, Wallace and Tyson Nays: None Abstained: Mr. Perkins Chairman Tyson declared the motion carried. II . LITTLE BEAR CREEK DEVELOPMENT Mr. Tyson recognized Mr. Tom Allred, who stated that Mr. Tyson invited him to come before the Commission with a proposed development of property east of North Main Street along Little Bear Creek. Mr. Allred stated they were attempting to use the guidelines of the Euless Master Plan in the development of this tract of land; that the land should be used for the betterment of the populace. Mr. Allred stated that the entrance would be from North Main Street and they planned to have a country club atmosphere along North Main Street in order to establish a good relationship with the residents of Trailwood Addition and Royal Oaks Estates. . Mr. Allred further stated that the country club activities would be open to the public on a member- ship basis. A discussion followed on the street into the development and Mr. Bullard informed Mr. Allred that the Fire Marshal (Page Five, Regular Meeting Planning and Zoning Commission, March 5, 1974) may require more circulation for fire equipment. In reply to a question from Mr. Perkins concerning security, Mr. Allred stated they have not given this enough study at this time but the developers will probably plan some type of on-premises security. Mr. Tyson thanked the men for the presenta- tion and Mr. Bullard stated he would meet with the Fire Marshal with a copy of the proposed plat on their recommendations on the streets. III .
