HomeMy WebLinkAbout1973-12-04 L Regular Meeting Planning and Zoning Commission December 4, 1973 CALL TO ORDER The regular meeting of the Planning and Zoning Commission was called to order at 8:05 p.m. in the Council Chambers of Euless City Hall by Chairman Carl Tyson. Other members present were Messrs. Richard Leggett, Don Perkins, Ray Ozebek, Bob Pippin and Herman Wallace. (Absent was Robert Johnson.) Also present were City Inspector Jack Bullard and Recording Secretary Becky Lowrance. VISITORS Visitors in attendance were Mrs. Willie Mae McCormick, Mr. Joe Chitwood, Mr. Walter Elliott, Mr. Robert Mahoney, Mr. and Mrs. Pete Glynn and Mrs. Hazel McKee. APPROVAL OF MINUTES Mr. Pippin moved to approve minutes of the regular meeting dated November 20, 1973, as written. Mr. Leggett seconded the motion and the vote is as follows: Ayes: Messrs. Tyson, Leggett, Perkins, Ozebek, Pippin and Wallace Nays: None Chairman Tyson declared the motion carried. PUBLIC HEARING - ZONING CASE NO. 236 REQUEST OF MR. ROBERT MAHONEY FOR CHANGE OF ZONING FROM "C-2" SINGLE FAMILY DWELLING DISTRICT TO "PD" PLANNED DEVELOPMENT ON 1 .929 ACRE TRACT IN THE A. J. HUITT SURVEY, A-684. (PROPERTY LOCATED SOUTH OF SH-183 AND EAST OF THE DAIRY MART.) Mr. Walter Elliott was recognized and stated that he was representing Mr. Robert Mahoney. He also stated that Mr. Mahoney was present. Mr. Elliott presented the plat and gave the location of this property as being on Highway 183, East of the Dairy Mart. (Page Two, Regular Meeting, Planning and Zoning Commission, December 4, 1973) He also stated that there will be a six foot screening wooden fence on the South side of the property. The exterior wall of the building on the east property line will serve as a screening fence for that section. The additional footage of the mini- warehouse space on the East side will be screened by a six foot wooden fence. Mr. Perkins asked about the type of burglary system they would have. Mr. Mahoney stated that there would be none and that it would be up to the individual to insure his property. Mr. Leggett asked Mr. Mahoney if the building will have a sprinkler system. Mr. Mahoney stated that it would not have. Mr. Wallace asked if the building on the East would be on the property line. Mr. Elliott stated that it would be. Mr. Bullard asked what type of construc- tion the building would be. Mr. Mahoney stated that it would be of concrete masonry blocks. Mr. Bullard asked about the proposed width between the buildings. Mr. Mahoney stated that there will be 30 feet between the building and 35 feet on the West and South sides from the fence to the building. Mr. Tyson asked if the units open up on both sides. Mr. Mahoney stated that all but the one on the property line opened on both sides. Mr. Leggett asked Mr. Mahoney what type of door the units would have. Mr. Mahoney stated that the larger units would have overhead doors and that the smaller units would have metal hinge doors. Mr. Perkins asked if there was any restriction as to who could rent these. Mr. Mahoney stated that the larger ones are usually rented by other commercial business and the smaller ones are rented by individuals. He stated that they would have an employee on the (Page Three, Regular Meeting, Planning and Zoning Commission, December 4, 1973) premises eight hours a day, but the rest of the time, the people would have their own key and there would be no control over who came and went. Mr. Tyson asked when construction would begin. Mr. Mahoney stated that construction would begin in February, 1974. Mr. Perkins asked if there would be a fence between the commercial section and the mini-warehouses. Mr. Elliott stated no, that there was approximately five feet difference in elevation between the commercial site and the mini-warehouse site and the development in front would serve to screen the mini-warehouses. Mr. Perkins asked what type of lighting was proposed for the structures. Mr. Mahoney stated that they would have lighting in the front of the buildings and that the lighting would be directed toward SH-183 and would not interfere with the residences to the South. Mr. Leggett asked what type of lighting there would be inside of the units. Mr. Mahoney stated that there will be one electrical light. Mr. Tyson asked if there were any questions from the audience. Mrs. Hazel McKee asked if there were any improvements to be made to the drainage ditch behind her property and that this drainage ditch was presently overloaded and that water got up into her back yard when it rained. She stated that the banks of the creek were eroded away. Mr. Tyson asked Mr. Elliott if a drainage study had been done on this project. Mr. Elliott stated no. Mr. Mahoney stated that the tract will be so graded to where the water will drain to the South and to the West. The Southwest corner of the tract will be the lowest point. Mr. Pete Glynn asked if this development would aggravate the drainage problem. 416w Mr. Elliott explained that there would be a faster run off from this property when developed, but the amount at this time would not aggravate the present condition by Mr. Glynn's house, since the water from this development would go into the drainage channel (Page Four, Regular Meeting, Planning and Zoning Commission, December 4, 1973) to the West. He stated it would then go into the channel that drains behind Mr. Glynn's house South of his location. Mr. Glynn wanted to know who would be responsible for the development of the creek. Mr. Bullard stated that it would be the responsibility of the owner of the property where the creek exists to improve the creek at such time as that property was developed. Mr. Glynn wanted to know if the more development that took place, if it would increase the amount of water in the creek. Mr. Elliott stated yes, that all develop- ment upstream from the creek would increase the flow, but the location of this particular piece of property would not have the effect on the creek at this site that the upstream development from this site will have. Mr. Glynn asked if there would be any improvements made. Mr. Bullard stated that there would not be at this time. Mr. Bullard asked if they were going to leave the trees. Mr. Mahoney stated that the trees along the front would be left, but that in the back there was nothing but grass. Chairman Tyson closed the Public Hearing at 9:00 p.m. After some discussion, Mr. Perkins made a motion to approve the request of Mr. Mahoney for change of zoning from "C-2" Business to "PD" Planned Development. Chairman Tyson declared this motion died for lack of a second. Mr. Perkins made a motion to table Zoning Case No. 236 until the Commission had additional detail as discussed in the Public Hearing. Mr. Leggett seconded the motion and the vote is as follows: Ayes: Messrs. Leggett, Perkins and Ozebek Nays: Messrs. Tyson, Pippin and Wallace ( Chairman Tyson declared this motion failed due to a lack of majority. (Page Five, Regular Meeting, Planning and Zoning Commission, December 4, 1973) Mr. Pippin made a motion to disapprove Are Zoning Case No. 236 based on the fact that the Commission has provided in the Master Plan Zoning for mini-warehouses in the "L-l" Limited Industrial District. Mr. Wallace seconded the motion and the vote is as follows: Ayes: Messrs. Tyson, Pippin, Wallace and Ozebek Nays: Mr. Leggett Abstains: Mr. Perkins Chairman Tyson declared the motion carried. Mr. Tyson stated that this request will be passed onto the City Council and that it will need more detail . Mr. Bullard stated that the zoning case has been recommended to the City Council to be denied. He stated that Mr. Mahoney may go ahead and present this case to the City Council or he may withdraw in writing to the City Secretary within 48 hours and receive $75.00 of the filing fee back. Mr. Mahoney stated that he will go ahead to the City Council . II . CONSIDER AVIGATION RELEASE ORDINANCE BY MR. BOB MCFARLAND Mr. Bob McFarland was not present and Chairman Tyson stated that this would be tabled until the next meeting. III . ADJOURNMENT The meeting adjourned at 9:20 p.m. APPROVED: Chairman
