Regular Meeting Euless City Council January 23, 1979 CALL TO ORDER The regular meeting of the Euless City Council was called to order at 8:00 p.m., in the Council Chambers of Euless City Hall by Mayor Harold Samuels Other members present were Mrs. Willie Me McCormick, Messrs. Raymond Ozebek, Glenn Walker, Robert Pippin, and Charles Hunt. Also present were City Manager W. IT Sustaire, City Secretary Della Houy, City Attorney James Cribbs, City Engineer Bill Flowers, and Assistant City Manager John Lynch, IV. VISITORS 1 Visitors in attendance were Messrs. Raymond Armstrong, Don Perkins, B. R. Heath, and Don Savage; Mesdms. Sualice Armstrong, Zoe Petersen, and Myrtle Hall. INVOCATION The invocation was given by Councilman Robert Pippin. APPROVAL OF MINUTES The minutes of the regular meeting dated January 9, 1979, were approved as written with the correction as follows: ITEM XIII, PAGE ELEVEN - IVY: Ozebek moved that the City staff be authorized to schedule a public hearing before the City Council on zoning cases following the public hearing by the Planning and Zoning Commission, based on their action, in order to shorten the procedure for rezoning. CONSIDER SECOND AND FINAL READING OF ORDINANCE NO. 560 - ZONING CASE NO. 276 - REQUEST OF W. 0. FERGUSON FOR CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "SP" SPECIFIC USE PERMIT FOR A COMMERCIAL AMUSEMENT CENTER ON A PORTION OF LOTS 4, 5, AND 6, BLOCK 2, EULESS GARDENS ADDITION Mr. Ozebek moved to approve second and final reading of Ordinance No. 560 for change of zoning from "C -2" Community Business District to "SP" Specific Use Permit with the stipulation that the particular building being used for the Specific Use be covered by field notes and these field notes submitted within thirty (30) days. (Page Two, Regular Meeting, Euless City Council , January©, 1979) Mrs. McCormick seconded the vote and the vote i s as follows: Ayes: Mr. Ozebek, Mrs. McCormick, Messrs. Pippin, Walker, and Hunt Nays: None Mayor Samuels declared the motion carried. Mr. Armstrong stated they w i l l have t h e i r opening on Friday, January 26th, a t 5:30 p.m. and i n v i t e d a l l members of the Council to attend. M r . Armstrong stated he has purchased a l l the signs required for inside and outside the building and has met all the stipulations required by the Council. He stated he will get the field notes i f Mr. Ferguson, the owner, doesn't get them. 11. CONSIDER NEGOTIATED BIDS FCR 1WJ 1979 FOUR DOOR SEDANS, 1VD 1979 PICKUPS, AND ONE 1979 WINDOW VAN Mr. Sustaire stated that Mr. Shackelford Administrative Assistant, visited with ten (10) dealers requesting they submit a bid for the two 1979 four -door sedans, two 1979 pickups, and one 1979 window van. Mr. Hunt inquired what the City did to get these bids when e didn't get any bids before? Mr. Sustaire stated he had Mr. Shackelford visit with each of the fleet managers and personally asked them to bid and called them from time to time until he got their bid, he also had to go and pick up some of the bids from the dealership. Mr. Hunt stated that he is glad that the City has someone on the staff to do this and he wonders if this is not the proper procedure that the City should follow every time e have vehicles to purchase. Mr. Cribbs stated the Council authorized negotiated bids in this instance because there were no bids submitted in response to the publication. Mr. Hunt stated he is not sure that this was a negotiated bid situation, that it looks to him l i.ke the City asked the dealers to bid, and if it is considered a negotiated bid, the City changed the procedure to some extent to get new bids and wouldn't it be proper or prudent for the City to change the procedure for all future bidding to be done in a similar situation, as it appears that this is a better way to do it? Mr. Cribbs stated the City changed the procedure to the extent that an employee was sent out and talked with the managers and inquired why the City did not receive a response to their invitations to bid and Mr. Shackelford submitted some of the comments he received. He stated that it may be that the next time the City advertises for bids, as required by law, you may receive.'more bids. Mayor Samuels stated there wouldn't be anything wrong with a member of the City staff visiting with the dealers or talking with them on the telephone and asking them to submit a bid the next time w e advertise for b i d s , but e would s t i l l have to have a l l the bids in at one time and opened at one time at a public 'meeting,' and if e didn't �o (Pape Four, Regular Meeting, Euless City Council, January 23,1979) receive any bids, then the City Manager could negotiate for bids again, but are bound by law when xNe purchase anything of this magnitude that e have a bid opening at a given time and place. Mr. Sustaire stated e have learned a lot from this and we do intend to form new policies in approaching dealers to get bids in the future, that a plan on making personal contacts either by telephone, mail, or walking into the dealership and advising them that we plan to advertise for bids. He stated most of the dealers had the same comment, that they weren't getting any cooperation from the manufacturers. Mr. Sustaire stated the pricing e received on the vehicles has been very good and e had one of the best receptions e have ever had. Mr. Hunt stated he is glad to hear that the city learned a lot from the procedure that was used but he is concerned about the statement in the memorandum that states "the result of this interview was not surprising to myself and I'm sure riot 'to you," and it seems to him that i t was s u r p r i s i n g t o everybody t o be able t o come up w i t h a l l these bids by simply contacting these people in person. He stated he hopes there w i l l by a revised method for bidding in the future, based on what was learned, so we don't run into this situation the next time e advertise for bids. Mr. Sustaire stated that he can not say what the business community holds because the mood of the business community changes so rapidly. Mr. Hunt stated that according to the memorandum, the dealers are saying that the specifications are too complicated, too general, very time consuming, and items are specified which are not a v a i l - a b l e and he can understand why nobody w i l l bid if this is the case. He stated what he is trying to get is for the City to have a set of specifications that w i l l not be too complicated for a person to bid on, and also personal contact, if necessary. Mr. Sustaire stated the memorandum is the context of interviews with twelve different dealers and Mr. Shackelford has narrowed it down to the basic responses, that some of the dealers said the specifications were too simple or too general, and some said they were too compl icated. Mr. Hunt inquired if we • are going to continue to not get bids in the future then? Mr. Sustaire stated he cannot guarentee whether the C i t y win get bids o r not, t h a t e w i l l continue to advertise and send out invitations to bid. Mr. Hunt inquired if -the City is going to modify, inprove and update the s p e c i f i c a t i o n s so t h a t dealers w i l l continue to bid? Sustaire stated that if you will tell rre what t o put in the s p e c i f i c a t i o n s t h a t w i l l be simple enough or complicated enough, I w i l l be glad to, but to date we have written simple specifications, complicated specifications and we get the same reaction. Mayor Samuels inquired if Mr. Hunt would have time next year to make some personal contacts concerning the bidding when we advertise for new vehicles? Mr. Hunt stated that he would have no objections to spending time visiting with the dealers, but it would appear to him that the staff knows, and has known all along from this memorandum, what the problems are, that this is what he gets from the iemorandum, and inquired i f the Council had read the memorandum? Mayor Samuels stated that he has read it several times, and thinks the Council is spending too much time talking about automobiles and not getting along with other business of the City and we are not saving our taxpayers any money, if we were he would be willing to spend a l l night here. He stated on the contrary, when we rejected the bid from the last dealer we actually caused a staff member one week of his time soliciting the bids and when the automobile bids came in they were approximately $100.00 per vehicle higher than the bid which we rejected. Mrs. McCormick moved to concur with the recommendation of the City Manager and approve the low bid of Payton - Wright Ford Sales, in the amount of $5,96$.00 each, total bid $11,936.00, for the two 1979 four -door sedans; the low bid of Payton - Wright Ford Sales, in the amount of $5,5560.00 each, total bid $11,120.00, for two 1979 pickup trucks; and the low bid of Ted Arendale Ford, in the amount of $6,634.27, for one 1979 window van. Mr. Walker seconded the motion and the vote is as follows: Ayes: Mrs. McCormick, Messrs. Walker, Pippin, Hunt, and Ozebek Nay: None Mayor Samuels declared the motion carried. CONSIDER RENEWAL CF AMBULANCE CONTRACT Mr. Sustaire stated he recommends the City extend the ambulance contract for one year, that Hurst has requested some changes and Mid - Cities Ambulance Company has agreed to the changes. Mr. Lynch stated the changes are procedural changes, which are as follows: (Page Six, Regular Meeting, Euless City Counoil, January 23, 1979) 1. Requirement of an annual financial audit by an independent, CPA firm would be subnitted showing a balance sheet of the company's local and parent company operations 60 -90 days before contract renewal. 2. In addition to a requirement for the average resporse tine of five minutes or less, an annual average of 65% of all calls should be less than five minutes response. time. 3. both manned units are not available for a call, the dispatcher should notify the respective Police and Fire Departments of Hurst and Euless of the situation and give the location of the nearest backup unit. If a call for an ambulance is received and a front line ambulance is not available, or the backup unit is more than ten minutes away, the dispatcher should notify the respective Police and Fire Department of Hurst and Euless the nature of the call. Dispatching of a Fire Department unit would be dependent upon City and Department policies. 4. Quarterly reports should be submitted to the City Manager of each City showing the mechanical service provided each piece of equipment (to show chassis lubrications and oil changes) , odometer reading at each service, and the date of the next scheduled preventive maintainence service. The City Manager of either City may require additional maintainence if an inspection so warrants. Mr. Pippin moved to authorize the City Manager to enter into a contract extension with Mid - Cities Ambulance Service. Mr. Walker seconded the motion and the vote is as follows: Ayes: Messrs. Pippin, Walker, Ozebek, Hunt, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. Iv. CONSIDER ORDINANCE GOVERNING THE FRANCHISE FOR A CABLE TELEVISION SYSTEM Mr. Walker moved to table the ordinance governing the franchise for a cable television system until the February 13, 1979, meeting to allow additional time for review by the City Attorney. Mr. Hunt seconded the motion and the vote is as follows: Ayes: Messrs. Walker, Hunt, Ozebek, Pippin, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. CONSIDER RESOLUTION NO. 447 APPROVING AGREEMENT BETWEEN THE CITY CF EULESS AND DALLAS /FORT WORTH AIRPORT BOARD REGARDING GLADE ROAD AND MINTERS CHAPEL ROAD Members of the Council had previously received a copy of the agreement between the City of Eulsss and the Dallas/ Fort Worth Airport Board regarding Glade Road and Minters Chapel Road. Mr. Lynch stated the City staff has entered into some discussion with County Commissioner Lyn Gregory to begin work on Glade Road as soon as possible, if the agreement is signed. He stated they a n t i c i p a t e the County w i l l begin work this week. Mrs. McCormick moved to approve Resolution No. 447 authorizing the City Manager t enter into an agreement with the Dallas /Fort Worth Airport Board regard ng Glade Road and Minters Chapel Road. Mr. Walker seconded the motion and the vote is as follows: Ayes: Mrs. McCormick, Messrs, VA ker, Pippin, Ozebek, and Hunt Nays: None Mayor Samuels declared the motion carried. VI. CONSIDER APPOINTMENT TO LIBRARY BOARD Mrs. McCormick moved to appoint Mrs. Sonja Adams t o the L i b r a r y Board t o f i I l the unexpired term o f M r . B i l l McCray. Mr. Walker seconded the motion and the vote is as follows: Ayes: Mrs, McCormick, Messrs. Walker, Pippin, Ozebek, and Hunt Nays: None CITY ENGINEER'S REPORT Mayor Samuels declardd the motion carried. VII. NORTH MAIN STREET IMPROVEMENTS Mr. Flowers stated the sidewalks on the west side of North Main Street have not been installed and he has been in (Page Eight, Regular Meeting, Euless City Council, January 23., 1979) contact with the contractor today and he said that he and the sidewalk contractor have been out to the site and it is sti I I too wet and if it does not r a i n they w i l l be on the job Friday morning. VIII. CONSIDER AUTHORIZING CITY MANAGER TO NEGOTIATE FOR A WATER LINE EXTENSION IN THE NORTH PORTION OF, EULESS Mr. Pippin moved to authorize the City Manager to negotiate for a water line extension in the north portion of Euless. Mr. Walker seconded the motion and the vote is as follows: Ayes: Messrs. Pippin,. Walker, Ozebek, Hunt, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. IX. COMPLIMENT ON ANIMAL SHELTER Mrs. McCormick stated she received a letter --- from the Tarrant County Humane Society complimenting Euless on the staff and building of the Animal Shelter, that it is well above the average.
