APRIL 29, 2013
MINUTES
The regular meeting of the Zoning Board of Adjustment was called to order by
Chairman Rubyanne Crites at 6:02 p.m. for consideration of scheduled items in the Pre-
Council Room in City Hall of the Municipal Complex. Chairman Rubyanne Crites stated
there was a quorum of members of the Zoning Board of Adjustment present.

ITEM 1 CONSIDER APPROVAL OF ZONING BOARD OF ADJUSTMENT
MINUTES for Regular Meeting of February 28, 2013.
Board Member Eilenfeldt made a motion to approve the minutes for February 28, 2013
as written. Board Member Moore seconded the motion. The vote was as follows:
Ayes: Chairman Crites, Vice Chairman Ellis, Board Members Wooldridge, Eilenfeldt,
and Moore.
Nays: None
Abstention: None
The motion carried (5-0-0)

ITEM 2 RECONSIDER CALLING A MEETING OF THE ZONING BOARD OF
ADJUSTMENT TO CONDUCT THE AMORTIZATION HEARING
RELATED TO THE SHADOW CREEK APARTMENTS, 311 S.
INDUSTRIAL BOULEVARD
City Attorney Wayne Olson was asked to brief those present on the case as it stands
currently. Mr. Olson informed the Board that there is currently a notice of foreclosure of
May 7th, 2013 by the lender to the property owner. Representatives of the owner(s) and
the lender(s) gave their perspective on these matters.
Board Member Dunckel made a motion to postpone the Amortization Hearing related to
Shadow Creek Apartments until the foreclosure status has been determined and more
information is provided to the Zoning Board Adjustment. Board Member Eilenfeldt
seconded the motion. The vote was as follows:
Ayes: Chairman Crites, Vice Chairman Ellis, Board Members Wooldridge, Eilenfeldt,
and Moore.
Nays: None
Abstention: None
The meeting was adjourned at 6:32 p.m.
