HomeMy WebLinkAbout1980-07-08Regular Meeting Euless City Council July 8, 1980 CALL TO ORDER The regular meeting of the Euless City Council was called to order at 8:02 p.m., in the Council Chambers of Euless City Hall, by Mayor Harold Samuels. Other members present were Mayor Pro Tem Willie Mae McCormick, Councilman Ron Sternfels, Charles Hunt, Glenn Walker, and Robert Pippin. Also present were City Manager W. M. Sustaire, City Secretary Della Houy, City Attorney Bob McFarland, and City Engineer James Knight. VISITORS Visitors in attendance were Messrs. Don Perkins, Glenn Cooper, Al Anglin, Walter A. Elliott, Jr., Doyle Winters, Neal W. Adams, Mike Skaggs, Wayne Ferguson, R. Dan Watkins, Bruce Trench, Steve Crim, Kent flyn n , Philip Brown, and Mrs. Judy Kay Ferguson. INVOCATION The invocation was given by Councilman Robert Pippin. APPROVAL OF MINUTES The minutes of the regular meeting dated June 24, 1980, were approved as written. PRESENTATION OF MIKE SKAGGS, EXECUTIVE VICE PRESIDENT OF HEB CHAMBER OF COMMERCE Mr. Neal Adams, President of the HEB Chamber of Commerce, introduced Mr. Mike Skaggs, Executive Vice President of the HE8 Chamber of Commerce. Mr. Adams thanked the Council for their support of the HEB Chamber of Commerce. I. ORDINANCE NO. 631 AMENDING ORDINANCE NO. 347 REGARDING SIGN REQUIREMENTS Mr. Walker moved to approve second and f i n a l reading of Ordinance No. 631 amending Ordinance No. 347 re- garding sign requirements in the City of Euless. BLOCK 1, TRAIL LAKE ESTATES Mr. Pippin moved to approve second and final reading of Ordinance No. 632 abandoning a utility easement on Lot 13, Block 1, Trail Lake Estates. Mr. Hunt seconded the motion and the vote is as follows: Ayes: Messrs. Pippin, Hunt, Sternfels, and Mrs. McCormick Nays: None Abstain: Mr. Walker Mayor Samuels declared the motion carr ied. PUBLIC HEARING - ZONING CASE NO. 314 - REQUEST CF STEPHEN CRIM, L & N MANAGEMENT, INC., FCR CHANGE OF ZONING FROM "R -1" SINGLE FAMILY DWELLING DISTRICT AND "PD" PLANNED DEVELOPMENT DISTRICT TO "R -1" SINGLE FAMILY DWELLING DISTRICT WITH "SP" SPECIFIC USE FOR "CUD" (R -4 DENSITY) FCR VARIABLE HOUSING ON TRACTS 1B, 6A, AND 6D, S. HUITT SURVEY, A -705 Mayor Samuels opened the p u b l i c hearing on Zoning Case No. 314, for change of zoning from "R -1" Single Family Dwelling District and "PD" Planned Development District to "R -1" Single Family Dwelling District with "SP" Specific Use for CUD (R -4 Density) for variable housing, on Tracts 1B, 6A, and 6D, S . H u i t t Survey, A -705, and stated the Council would hear from the pro- ponents fi r s t and then any opponents. Mayor Samuels recognized Mr. Stephen Crim. 162 (Page Three, Regular Meeting, Euless City Council, July 8, 1980) Mr. Crim, Vice President of L & N Land Corporation, stated he is requesting the zoning change from "R -1" Single Family Dwelling District and "PD" Planned Development District with R -5 density, twenty -four units per acre, to "R -1" Single Family Dwelling District with a Community Unit Development designation with R -4 density, allowing sixteen units per acre. He indicated the location of the property on a plat in relation to the main offices of Braniff Airlines and American Airlines. He stated the property fronts on North Main Street and extends east along Blessing Branch and is adjacent to Midway Square, which is presently being developed. Mr. Crim stated the existing zoning allows 1155 dwelling units on the fifty -five acre tract. He stated the requested zoning is for an attached housing development of approximately one hundred sixty lots on one -half of the tract. He stated the remainder o f t h e t r a c t , approximately 21.8 acres, w i l l be developed as multi - family housing. He stated the total number of units that wi l l be con- structed, i f the rezoning is approved, will be 724 as opposed the 1155 units that are allowed as the property is presently zoned. Mr. Crim explained the attached housing concept as being a two family unit with each unit selling separately. He stated each u n i t w i l l have parking at the rear of the unit and each yard will be fenced. He stated the units will sell for $45.000 to $60,000 at today's market. Mr. Crim stated the south boundary is Blessing Branch and extends east 2500 feet. He stated the city ordinance requires that the creek be channelized, but that would destroy the trees that surround the creek, and the developer is requesting a variance to the ordinance. He stated the developer would like to dedicate the seven acres along the creek as a p u b l i c park and w i l l dedicate it with access from the main street in the development. He stated he has met with the City Staff and Park Director and they have worked out some details on the dedication. He stated three items were imposed on the developer if the park is dedicated to the City. 1. The developer will clear the proposed park area of brush and large obstructions so that it can be mowed by the City. However, the developer would not be required to cut creek embankments to any assigned slope. 2. The Park Department will require a minimum width of fifty feet dedicated from the center line of the creek to give the public and city access to the channel. 3. A screening fence to be constructed to conform to the requirements of the City. (Page Four, Regular Meeting, Euless City Council, July 8, 1980) Crim stated he discussed the fence with the Park Director and they agreed to a forty -two inch high boundary fence like the City has around all the parks in the City, which is a two rail wooden fence. He stated they will install the fence at their expense. He stated they will deed restrict their plat so that there will not be any screening fences along the back yards of the houses along the creek. Mr. C r i m recapped t h e i r reasons f o r requesting the rezoning - a thirty -seven percent reduction in the number of units that are allowed on the site by the present zoning, when the tract is developed it will add approximately twenty -three million dollars in assessed valuation to the city tax rolls, they are dedicating in a seven acre park to the City, and they think they are providing a good p l a n which w i l l provide housing t h a t w i l l be responsive to the growing economic base in this area. Mayor Samuels inquired if they discussed the possibility of a narrow trail to tie in with Midway Park. Mr. Crim stated Midway Park is not across from their property, but further south. Mr. Hunt stated he is concerned about vandalism and upkeep on the one -half mile long two rail wooden fence. Mr. Crim stated the fence was suggested by the Park Director since it is the type of fence that is around the other city parks. Mayor Samuels inquired if there were any other proponents. There being none, he inquired if there were any opponents. There being none, he declared the public hearing closed. Mrs. McCormick moved to concur with the recommendation of the Planning and Zoning Commission and approve first reading of an ordinance rezoning Tracts 1B, 6A, and 6D, S. Huitt Survey from "R -1" Single Family Dwelling District and "PD" Planned Development to "R -1" Single Family Dwelling District with "SP" Specific Use for "CUD" R -4 Density for variable housing. Mr. Pippin seconded the motion and the vote is as follows: Ayes: Mrs. McCormick, Messrs. Pippin, Walker, Hunt, and Sternfels Nays: None Mayor Samuels declared the motion carried. PUBLIC HEARING - ZONING CASE NO. 315 - REQUEST CF GLENN COOPER FOR, CHANGE CF ZONING FR CM "R-1" SINGLE FAMILY DWELLING DISTRICT 10 'R -2" 1WD FAMILY DWELLING DISTRICT ON TRACT 2E1, A. J. HUITT SURVEY, A -684 Mayor Samuels opened the p u b l i c hearing on Zoning Case No. 315 for change of zoning from 'R -1" Single Family Dwelling District to "R -2" Two - Family Dwelling District on Tract 2E1, A. J. Huitt Survey, and stated the Council would hear from the proponents first and then any opponents. Mayor Samuels recognized Mr. Al Anglin. Mr. Anglin stated he is the owner of the property and will construct an owner /occupant duplex on a portion of the property and w i 11 poss bly construct another duplex on the remainder of the property for additional income. He located the property as being on South Main Street He stated the duplexes w i 1 1 be construct- ed of seventy -five percent br ck, will be two bedroom, two bath units, and should sell for approximately 75,000 for each unit. He stated each unit of the duplex should rent for $375.00 to $400.00. He stated the houses on each side of his property are rental units and approximately thirty years old. He stated he feels that the duplexes will have a stabilizing effect on South Main Street. Mr. Sternfels inquired if he would concur with the Planning and Zoning Commission's recommendation of a circular driveway to prevent backing onto South Main Street. Mr. Anglin stated he would concur with the circular driveway as the of is 136 foot wide and 150 foot deep and there w i l l be plenty of room. Mayor Samuels inquired if there were any other proponents. There being none, he inquired if there were any opponents. There being none, he declared the public hearing closed. Mr. Sternfels inquired if the Council can require a circular driveway in with the rezoning request. Mr. McFarland stated this property w i l l be subject to platting and when the developer comes in for the final plat, the Council can require a circular driveway as part of the final plat. Mr. Hunt moved to concur with the recommendation of the Planning and Zoning Commission and approve first reading of an ordinance rezoning Tract 2E1, A. J. Huitt Survey, Prom "R -1" Single Family Dwelling District to "R -2" Two - Family Dwelling District. PRELIMINARY PLAT - LOTS 1, 2, AND 3, TRAIL CREEK PROFESSIONAL CENTER Mr. Walter Elliott, Jr. stated he is representing the owners of Trail Creek Professional Center. He located the property as being on the southwest corner of Tibbets Drive and Westpark Way. He stated they have met a l l conditions requested by the City Staff. He stated the owners will have their final plat ready for submission in August. He stated the professional building w i l l be constructed on one lot and an aerobic center on the remainder of the property. He stated they have met a l l conditions as required by the City on the storm drainage. Mr. Walker moved to concur with the recommendation of the Planning and Zoning Commission and approve the preliminary plat of Lots 1, 2, and 3, Trail Creek Professional Center. Mr. Pippin seconded the motion and the vote is as follows: Ayes: Messrs. Walker, Pippin, Hunt, Sternfels, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. VI. PRELIMINARY PLAT - BLOCK A -1, WOODCREEK ADDITION Mr. Stephen Crim, L & N Land Corporation, stated this is the preliminary plat of the zoning case discussed in item 111. He stated the preliminary plat is a total of sixty acres and shows the one hundred year flood plain that was dis- cussed earlier that will be dedicated as a city park. He stated the development w i l l be developed in two phases, with phase one being a portion of the attached housing development and the dedication of the park area. He stated they a n t i c i p a t e having a l l the engineering complete and w i l l be ready to submit their final plat within six to eight weeks. (Page Seven, Regular Meetin, Euless' City Council, July 8, 1980) Mayor Samuels inquired if the Council approves this preliminary plat with the dedication of the park, will the Council be approving anything along the creek on the property south of Blessing Branch. Mr. Flynn stated the developer of Woodcreek Addition requested that they be allowed to leave the creek in its natural state and since the property to the south of the creek is zoned Planned Development, a new development plan would have to be provided prior to development. He stated when the owner of that property submits his plat for approval he wi I I be made aware of the proposed drainage easement that concurs with the one hundred year flood plain. Mr. Knight stated the owner of the property to the south of the creek w i 11 have the option of leaving the creek in its natural state and leaving the one hundred year flood plain undeveloped or being responsible for any improvements t o a l l the creek. Mr. Pippin moved to concur with the recommendation of the Planning and Zoning Commission and approve the preliminary plat of Block A -1, Woodcreek Addition. Mr. Walker seconded the motion. Mr. Sternfels inquired if there would be any provisions for upkeep of the fence. Mayor Samuels stated the fence would be on city park property and would be the responsibility of the City. There being no further discussion, the vote on Mr. Pippin's motion is as follows: Ayes: Messrs. Pippin, Walker, Sternfels, Hunt, and Mrs. McCormick Nays: None carried. Mayor Samuels declared the motion VI I. REPLATTING OF KNOB HILL MOBILE HOME PARK Mr. Neal Adams, representing Knob H i ll Sales, Inc., stated he is requesting replatting of Knob H i ll Mobil Horne Park because the owner is selling the lots and the replat is required in order for the owners to obtain a deed to their property when the lots are paid for. (Page Eight, Regular Meeting, Euless City Council, July 8, 1980) Mr. Adams stated as a result of meetings with the City Staff, the owner has signed an indemnification letter indemnifying the City in regard to potential encroachment of possible fences that encroach on property lines as platted, and has executed a perpetual maintenance agreement that addresses a number of problems which were identified in Mr. Flynn's letter. He stated it gives the City more control than they would have in a mobile home park. Mr. Walker moved to concur with the recommendation of the Planning and Zoning Commission and approve the replat of Knob H i l l Mobile Home Park. Mr. Sternfels seconded the motion and the vote is as follows: Ayes: Messrs. Walker, Sternfels, Pippin, Hunt, and Mrs. McCormick Nays: None c a r r ied. Mayor Samuels declared the motion VIII. FIRST READ NG OF ORDINANCE VACAT NQ AND ABANDONING DELPHIA LANE IN THE J. E. WHITNER ESTATES Mr. Pippin moved to approve'first reading of an ordinance vacating and abandoning Delphia Lane i n the J. E. Whitner Estates, subject to receipt of an easement fo r a sanitary sewer line and Iift station in the street prior to second reading of the ordinance. Mrs. McCormick seconded the motion and the vote is as follows: Ayes: Mr. Pippin, Mrs. McCormick, Messrs. Walker, Hunt and Sternfels Nays: None carried. Mayor Samuels declared the motion IX. RESOLUTION NO. 491 GRANTING APPROVAL TO THE TARRANT COUNTY HOUSING FINANCE CORPORATION TO USE PROCEEDS OF ITS SERIES 1980 SINGLE FAMILY MORTGAGE REVENUE BONDS FOR ACQUIRING HOME MORTGAGES IN THE CITY OF EULESS Mr. Sternfels moved to approved Resolution No. 491 granting approval to the Tarrant County Housing Finance 168 (Page Nine, Regular Meeting, Euless City Council, July 8, 1980) Corporation -....to use proceeds of its Series 1980 Single Family Mortgage Revenue Bonds for acquiring home mortgages in the City of Euless. Mrs. McCormick seconded the motion and the vote is as follows: Ayes: Mr. Sternfels, Mrs. McCormick, Messrs. Pippin, Walker, and Hunt Nays: None carried.
