Secondly, Mr. Nichols, representing Johnson - Campbell Lumber Company, accompanied by Mr. Al Clyde, an attorney, was heard in a plea for some inflection of Ordinance No. 40 which would permit his company to resume its intentions of construction as previously planned. No action was taken by the council other than a clarified statement of assurance that the City Council stands ready and willing at all times to hear any reasonable suggestions offered by Johnson - Campbell or any others, so long as such suggestions w i I I not destroy or weaken the intent and purposes of Ordinance No. 40. On the statements of Mr. Mills and other information taken from a recent map, two permits to build had been issued in error to Mr. Mills and the houses virtually completed before the discrepancy was discovered. Therefore, no action was taken by the Countil to rectify the error which apparently was not the fault of the Council nor the issuing clerks. Mr. Mills did promise the City Secretary, who issues building permits, that he would refrain from furtherxonstruction until he can comply with Ordinance No. 40. No unfinished or new business came `before the council, no motions were offered, and no further action other than to be adjourned by Mayor Payton at 9:30 p.m. /s/ Thos. A. Mills was heard, who presented to the Council a plat of his acreage just west of the city and south of Highway 183, which, he stated, should have been recorded and the street in question dedicated. But, due to the sudden death of the party making the plat, no record was made in so far as could be determined at present. Mr. Mills stated further that he had built under the assumption that the street had been dedicated.
