HomeMy WebLinkAbout00-1060 03-28-2000RESOLUTION NO. 0 0 -10 6 0 A RESOLUTION ACCEPTING THE DONATION OF 2.513 ACRES OUT OF THE TERRELL- JASPER SURVEY, ABSTRACT NO. 861, CITY OF EULESS, TARRANT COUNTY, TEXAS WHEREAS, Arvind S. Patel joined Pro Forma by his spouse, Helen M. Patel by warranty deed dated December 30, 1999, conveyed and donated certain real property to the City of Euless which warranty deed is recorded in Volume 14160, Page 0255 of the Deed Records of Tarrant County, Texas, a copy of which is attached hereto as Exhibit "A "; and WHEREAS, such deed was subject to and conditioned upon completion of performance by Grantor of certain conditions subsequent, including without limitation thereto, the completion of certain improvements to the property and adjacent property; and WHEREAS, such conditions precedent have been satisfied by Grantor and it is the intention of the city council of the city of Euless, Texas, by adoption of this resolution, to formally accept the conveyance and donation of such property to the city of Euless. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. That the City of Euless, acting by and through its City Council, hereby accepts the conveyance and donation of the property described in that certain warranty deed, a copy of which, as recorded, from Arvind S. Patel, joined Pro Forma by his spouse, Helen M. Patel to the City of Euless is attached hereto as Exhibit "A ". That the improvements to the property so conveyed and adjacent property as required in that certain Developer Reimbursement Agreement made and entered into by and between Al Patel being one and the same as the Grantor Arvind S. Patel and the city of Euless under date of December 30, 1999, have been completed. Be it further resolved that the City Secretary of the City of Euless is hereby directed to cause a certified copy of this resolution and its attachments to be filed among the real property records of Tarrant County, Texas, after its passage and approval as provided by law. No money or additional consideration. Property: (including any improvements) As described on Exhibit "A" attached hereto and incorporated herein. Reservations from and Exceptions to Conveyance and Warranty: This conveyance is given subject to any and all restrictions, reservations, covenants, conditions, rights of way, casements, municipal or other governmental zoning laws, regulations and ordinances, if any, affecting the herein described property. All easements shown on the survey drawing of the property by Michael Dale Linke, RPLS, dated 10/26/99, a copy of which is attached hereto as Exhibit "B ". Grantor, with full intention of conveying the Property as a gift, with only the reversionary interest in favor of Grantor below provided, and subject to the reservations from and exceptions to conveyance and warranty, grants and conveys to Grantee the Property, together with all and singular the rights and appurtenances thereto in any wise belonging, to have and hold it to Grantee and Grantee's successors or assigns forever. Grantor binds Grantor and Grantor's hcirs, executors, administrators, and successors to warrant and forever defend all and singular the Property to Grantee and Grantee's successors and assigns against every person whomsoever lawfully claiming or to claim the sauce or any part thereof, except as to the reservations from and exceptions to conveyance and warranty. Grantor acknowledges that acceptance of this conveyance by Grantee is subject to and conditioned upon completion ofperforntancc by Grantor of certain conditions subsequent, including without limitation thereto, completion of certain improvements to the property and adjacent properties which conditions are set forth in that certain Developer Reimbursement Agreement made and entered into by and between Grantor, Al Patel and Grantee, of even date herewith, which completion of the performance of the improvements required shall be completed by Grantor no later than the 15"' day of March, 2000. Upon satisfactory completion of such conditions subsequent, the acceptance of this conveyance by Grantee shall be evidenced by a Memorandum acknowledging such acceptance by action of Grantee's city council which Memorandum referencing this deed shall be recorded among WARRANTY DEED Page 1 the Deed Records ofTarrant County, Texas, in which event the reversionary interest herein provided shall be null, void and of no further consequences and the title and interest in the property herein conveyed shall fully vest in Grantee. In the event such improvements shall not have been satisfactorily completed by the date above provided and Grantee shall have rejected acceptance of this conveyance, such rejection to be evidenced by a Memorandum acknowledging same by action of Grantee's city council, which Memorandum rejecting acceptance of this conveyance shall be recorded among the Deed Records of Tarrant County, Texas, in which event all right, title and interest purported to be conveyed by this iced shall revert to and vest in Orrantor.
