A RESOLUTION DECLARING A PUBLIC NECESSITY AND
AUTHORIZING THE MAYOR TO ACQUIRE LOT 5, BLOCK 4,
TIMBERLINE ADDITION FOR DRAINAGE IMPROVEMENTS
WHEREAS, a long term flooding problem has existed at Lot 5, Block 4, of the
Timberline Addition; and
WHEREAS, Teague Nall and Perkins, Inc., an engineering firm, was authorized
to study and determine alternative solutions; and
WHEREAS, the study recommended that the most economically feasible
alternative would be to purchase and demolish the house, grade and re -turf the
property;
WHEREAS, because of the house removal, the risk of flooding to the remaining
houses on the cul-de sac would be reduced,
WHEREAS, the City Council of the City of Euless finds that a public necessity
exists for the acquisition of the aforesaid parcel of real estate, and that said parcel when
taken, shall be put to a public use for the benefit of the community at large,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION 1
THAT there is a public necessity for the acquisition by the City of Euless of Lot 5,
Block 4, Timberline Addition with this parcel necessary for the construction of the
drainage to serve the Timberline Addition, and such improvements are hereby declared
to be a public use for a public purpose.
PASSED AND APPROVED by the City Council of the City of Euless, Texas, and
effective, on this 8th day of April, 2003, by a vote of 7 ayes, 0 nays, and 0 abstentions.
