A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS, OF NO OBJECTION TO THE REHABILITATION AND
PRESERVATION OF AN AFFORDABLE RENTAL HOUSING
DEVELOPMENT OF 250 UNITS LOCATED AT 601 EAST ASH LANE,
EULESS, TEXAS KNOWN AS ASH LANE APARTMENTS; ADOPTING
A SAVINGS CLAUSE; AND REQUIRING DELIVERY OF THIS
RESOLUTION TO THE COMPANY AND THE TEXAS DEPARTMENT
OF HOUSING AND COMMUNITY AFFAIRS.
WHEREAS, Norstar Ash Park, LLC ("the Applicant"), has proposed a major
rehabilitation project of an existing 250 unit apartment complex that provides affordable
rental housing that is located at 601 East Ash Lane named Ash Lane Apartments ("the
Development") in the City of Euless, Texas ("the City"); and
WHEREAS, Applicant has submitted an application to the Texas Department of
Housing and Community Affairs ("TDHCA") for 2014 housing tax credits for Ash Lane
Apartments; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS that the City certifies in accordance with the requirements of
Texas Government Code §2306.67071 and Texas Administrative Code §10.204(4), it is
hereby found:
Section 1.
THAT notice has been provided to the Governing Body in accordance with Texas
Government Code, §2306.67071(a); and
Section 2.
THAT the Governing Body has had sufficient opportunity to obtain a response
from the Applicant regarding any questions or concerns about the proposed
Development; and
Section 3.
THAT the Governing Body has held a hearing at which public comment may be
made on the proposed Development in accordance with Texas Government Code,
§2306.67071(b); and
Section 4.
THAT after due consideration of the information provided by the Applicant and
public comment, the Governing Body does not object to the proposed Application.
FURTHER RESOLVED, that for and on behalf of the City of Euless, the City
Secretary, is hereby authorized, empowered, and directed to certify this Resolution to
the Texas Department of Housing and Community Affairs.
APPROVED AND ADOPTED at a regular meeting of the Euless City Council on
the 24th day of June 2014 by a vote of 6 ayes, 0 nays, and 0 abstentions.
