HomeMy WebLinkAbout06-1217 01-24-2006RESOLUTION NO. 06-1217 A RESOLUTION CALLING A GENERAL ELECTION FOR THE OFFICES OF CITY COUNCIL MEMBERS, PLACE FIVE AND PLACE SIX, AND ESTABLISHING THE DATES AND TIMES OF EARLY VOTING FOR SUCH ELECTION; AND ESTABLISHING A DATE FOR A RUNOFF ELECTION, IF REQUIRED. WHEREAS, pursuant to the Election Code of the State of Texas, and the Euless City Charter, it is provided that there shall be held in each municipality in the State of Texas, a general election for the purpose of electing officials of said municipality; WHEREAS, the City of Euless, Texas ( "Euless ") and the Hurst - Euless- Bedford Independent School District ( "HEBISD ") desire to conduct joint elections pursuant to the provisions of the Texas Election Code, including the conduct of joint early voting and to provide for the sharing of expenses; and WHEREAS, Section 271.002 of the Texas Election Code provides for joint elections upon the passage of a resolution by each of the goveming bodies participating therein reciting the terms of the agreement, including the method for allocating expenses for the election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 The City Council of the City of Euless, Texas, at a regular meeting held this date, does hereby order an election of officers for the City of Euless, Texas, to be held on the second Saturday in May, that being May 13, 2006, for the purpose of electing one Council Member for Place Five and one Council Member for Place Six, who shall each serve for a period of three years or until their successors have been duly qualified. The candidate receiving a majority of the votes cast for City Council Member Place Five, and the candidate receiving a majority of the votes cast for City Council Member Place Six, shall be declared elected to such offices. SECTION 2 Pursuant to Resolution 98 -988, approved by the Euless City Council on February 24, 1998, the Hurst - Euless- Bedford Independent School District will conduct a joint election with the City of Euless, Texas, for the purpose of electing Trustees to Place One and Place Two of the HEBISD Board of Trustees, unless one of the entities qualify under Section 2.051 of the Texas Election Code to cancel their election. SECTION 3 All qualified voters determined by the laws of the State of Texas, the Charter and Ordinances of the City of Euless shall be qualified to vote at such election. For the purpose of said election, the entire City is hereby constituted into two voting precincts. Voting on election day, May 13, 2006, shall be conducted at Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas, 76039, and City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, 76039, and said election shall be held between the hours of 7:00 a.m. and 7:00 p.m. on the aforementioned date. SECTION 4 Applications for candidacy to the offices of City Council Member Place Five and City Council Member Place Six, shall be made to the City Secretary of the City of Euless beginning at 8:00 a.m., February 13, 2006 (first business day after official filing date of February 11, 2006), and not later than 5:00 p.m., March 13, 2006, in manner and form as prescribed by law, and the Charter and Ordinances of the City of Euless, Texas. SECTION 5 The names of eligible and qualified candidates for such office shall be placed on the ballots for such election by the City Secretary at the time and in the manner prescribed by law, and the Charter and Ordinances of the City of Euless. SECTION 6 Early voting for the above designated election shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, weekdays from Monday, May 1, through Friday, May 5, from 8:00 a.m. to 5:00 p.m., Saturday, May 6, from 7:00 a.m. to 7:00 p.m., Sunday, May 7, from 11 a.m. to 4:00 p.m., and on Monday and Tuesday, May 8 and 9, from 7:00 a.m. to 7:00 p.m. SECTION 7 Voting machines used for the conduct of the election, shall be procured, maintained, operated, sealed and the votes therefrom tabulated pursuant to procedures established and authorized by the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 8 The results of the election shall be certified, canvassed, and returned in the form and manner prescribed by the laws of the State of Texas and the Charter and Ordinances of the City of Euless. RESOLUTION NO. 05-1217, PAGE 2 OF 3 SECTION 9 The notice of the election hereby ordered and called shall be promulgated, published and posted in keeping with the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 10 Any runoff election required for the election of members of the City Council of the City of Euless, Texas, following the regular election of May 13, 2006, shall be held on Saturday, June 17, 2006.
