HomeMy WebLinkAbout06-1221 03-14-2006RESOLUTION NO. 06-1221 WHEREAS, the regular election for the City Council of the City of Euless as set forth by the Charter and by the Texas Election Code is required to be held on May 13, 2006, at which time the voters will elect persons to fill the offices of City Council Places 5 and 6; and WHEREAS, the City of Euless, Texas ( "Euless "), Hurst - Euless- Bedford Independent School District ( "HEBISD "), and Tarrant County desire to conduct joint elections pursuant to the provisions of the Texas Election Code, including the conduct of joint early voting and to provide for the sharing of expenses. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 Pursuant to Resolution No. 06 -1217 approved on January 24, 2006, an election was called by the Euless City Council to elect persons to the offices of City Council Places 5 and 6 to serve until May of 2009, or until their successors are duly elected and qualified. Such election shall be held at the Euless Public Library and Bear Creek Elementary School on the 13th day of May, 2006, from 7:00 a.m. until 7:00 p.m. SECTION 2 Unless one or more of the entities qualify under provisions of the Texas Election Code to cancel their election, the City of Euless, HEB ISD and Tarrant County shall hold a joint election on Saturday, May 13, 2006, for the purpose of electing members of the Euless City Council, Trustees to the HEB ISD Board of Trustees, and a Special Bond election for Tarrant County. SECTION 3 Gayle Hamilton, Tarrant County Interim Elections Administrator, 2700 Premier Street, Fort Worth, Texas, 76111, shall serve as Early Voting Clerk. Applications for ballot by mail must be received by mail no later than the close of business on Friday, May 5, 2006, (Mailing Address: P. 0. Box 961011, Fort Worth, Texas, 76161; Attention: Gayle Hamilton, Early Voting Clerk.) SECTION 4 Early voting by personal appearance shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, and at the County's Main Early Voting location: Muller Building, 600 W. Weatherford Street, Fort Worth, Texas, 76102. Branch offices for early voting shall also be established as outlined in the joint election agreement with Tarrant County. Early voting by personal appearance will begin on Monday, May 1, 2006, and will end on Tuesday, May 9, 2006, and the hours designated for early voting by personal appearance shall be as set forth below: May 1 — 5 (Friday — Monday) May 6 (Saturday) May 7 (Sunday) May 8 - 9 (Monday — Tuesday) 8:00 a.m. to 5:00 p.m. 7:00 a.m. to 7:00 p.m. 11:00 a.m. to 4:00 p.m. 7:00 a.m. to 7:00 p.m. For purposes of processing ballots cast in early voting, the Early Voting Ballot Board Judge shall be Jeanne Lyons, and the election officers for the Early Voting Ballot Board shall be appointed and designated in accordance with the provisions of the joint election agreement with Tarrant County. SECTION 5 All resident qualified electors of the City shall be permitted to vote at said election. This election shall be held and conducted in accordance with the election laws of the State of Texas, and as may be required by law, all election materials and proceedings shall be printed in both English and Spanish. SECTION 6 Combined ballots may be utilized containing all of the offices and propositions to be voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote for any office or proposition on which the voter is ineligible to vote. The County's voting equipment will be utilized for this election. SECTION 7 The election officers for each polling place shall be appointed in accordance with the provisions of the election agreement for conducting the election on the aforesaid election date with Tarrant County, Texas, and the City Secretary is hereby authorized and directed to execute such election agreement for the election for and on behalf of the City. SECTION 8 The expenses of the joint election shall be borne by the City of Euless and HEB ISD as outlined in the joint election agreement with Tarrant County. ADOPTED at a regular meeting of the Euless City Council on the 14th day of March, 2006, by a vote of 6 ayes, 0 nays, and 0 abstentions.
