RESOLUTION SUPPORTING REPRESENTATIVE TODD SMITH'S
H.C.R. NO. 87 INTRODUCED IN THE EIGHTIETH TEXAS
LEGISLATURE MEMORIALIZING THE UNITED STATES CONGRESS
TO REMOVE AND REPEAL CONFIDENTIALITY REQUIREMENTS OF
FEDERAL LAW FOR MINORS FROM FAMILY PLANNING SERVICES
PROGRAMS OPERATING UNDER TITLE X OF THE PUBLIC HEALTH
SERVICES ACT AND MEDICAID.
WHEREAS, the United States Congress by a majority vote on three occasions
has passed a bill prohibiting the act of infanticide called partial birth abortion and the
President has signed such a bill into law; and
WHEREAS, the Texas Legislature over the past eight years has by majority vote
passed the following legislation:
The detailed statistical reporting of all abortions within the state to be
provided to the Health and Human Services Administration;
2. The parental notification bill requiring parents notification in the event of an
abortion to be performed on a minor;
3. The subsequent parental consent bill whereby parents must give written
consent for a minor to acquire an abortion;
4. The informed consent bill, whereby any woman pursuing an abortion must
be given written information detailing the adverse medical consequences
of the abortion process and suggesting other options; and
WHEREAS, the State Board of Education approved school text books that focus
exclusively on abstinence in the sections that discuss preventing pregnancy and
disease; and
WHEREAS, the governing board of John Peter Smith Hospital, with the
agreement of the Tarrant County Commissioner's Court, did rescind their policy of
abortion upon demand 18 years ago; and
WHEREAS, it is the responsibility of govemment at all levels to protect the
health, safety and welfare of its residents, including minor children and the unborn; and
WHEREAS, current federal confidentiality laws cannot require minors to obtain
parental consent before receiving family planning services, including contraceptives;
and
WHEREAS, taken together, these requirements effectively force the state to
provide contraceptives to children under the age of 16 in order to finance critical family
planning services and reduce the likelihood of parental involvement at a time in a child's
sexual development when emotional capacity is not likely to correspond to physical
maturity.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS, THAT the City of Euless supports Representative Todd Smith's
H.C.R. No. 87 introduced in the Eightieth Texas Legislature memorializing the United
States Congress to remove and repeal confidentiality requirements of federal law for
minors from family planning services programs operating under Title X of the Public
Health Services Act and Medicaid.
ADOPTED AND APPROVED at a regular meeting of the Euless City Council on
the 8th day of May, 2007, by a vote of ayes, nays, and abstentions.
