HomeMy WebLinkAbout07-1249 05-29-2007RESOLUTION NO. 07 -1249 RESOLUTION CALLING A GENERAL RUNOFF ELECTION FOR PLACE ONE OF THE EULESS CITY COUNCIL, DESIGNATING THE DATE OF SAID ELECTION; DESIGNATING POLLING PLACES; DESIGNATING EARLY VOTING HOURS AND PLACES; APPOINTING ELECTION JUDGES; AND DIRECTING POSTING AND PUBLICATION OF NOTICE FOR SAID ELECTION WHEREAS, pursuant to Sec. 2.021 of the Election Code of the State of Texas, and the Euless City Charter, it is provided that if no candidate for a particular office receives the vote necessary to be elected in an election requiring a majority vote, a runoff election for that office is required. WHEREAS, a canvassing of the returns and declaring the results of a regular City Officer Election held on May 12, 2007, was approved by the City Council on May 18, 2007; and WHEREAS, the canvass determined that, in the race for Council Member, Place One, no candidate received a majority of the votes cast; and WHEREAS, the two candidates receiving the highest number of votes for the office of Council Member, Place One, were Tim Stinneford and Carl Tyson. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 There is hereby ordered a general runoff election to be held in the City of Euless, Texas, on the 16th day of June, 2007, for the purpose of filling the position of Council Member, Place One, who shall serve for a period of three years or until their successor has been duly qualified. The candidate receiving a majority of the votes cast for City Council Member, Place One, shall be declared elected to such office. SECTION 2 Steve Rabom, Tarrant County Elections Administrator, 2700 Premier Street, Fort Worth, Texas, 76111, is hereby appointed as Early Voting Clerk and Susan Crim, City Secretary, 201 N. Ector Drive, Euless, Texas, shall serve as Deputy Early Voting Clerk Applications for ballot by mail must be received by mail no later than the close of business on Friday, June 8, 2007 (Mailing Address: P. O. Box 961011, Fort Worth, Texas, 76161 -0011; Attention: Steve Rabom, Early Voting Clerk.) SECTION 3 Early voting by personal appearance shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, and at the County's Main Early Voting location, 2700 Premier Street, Fort Worth, Texas, 76111. Early voting by personal appearance will begin on Monday, June 4, 2007, and will end on Tuesday, June 12, 2007, and the hours designated for early voting by personal appearance shall be as set forth below: June 4 — June 8 June 9 June 10 June 11 -12 (Monday - Friday) (Saturday) (Sunday) (Monday — Tuesday) 8:00 a.m. to 5:00 p.m. 8:00 a.m. to 5:00 p.m. CLOSED. 7:00 a.m. to 7:00 p.m. For purposes of processing ballots cast in early voting, the election officers for the Early Voting Ballot Board shall be appointed and designated in accordance with the provisions of the joint election agreement with Tarrant County. SECTION 4 All resident, qualified voters, determined by the laws of the State of Texas, the Charter and ordinances of the City of Euless shall be qualified to vote at such election. For the purpose of said election, the entire City is hereby constituted into two voting precincts. Voting on election day, June 16, 2007, shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, 76039, for both the Bear Creek Elementary School precinct and the Euless Public Library precinct, and said election shall be held between the hours of 7:00 a.m. and 7:00 p.m. on the aforementioned date. SECTION 5 Voting machines used for the conduct of the elections, shall be procured, maintained, operated, scaled and the votes therefrom tabulated pursuant to procedures established and authorized by the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 6 The results of the elections shall be certified, canvassed, and returned in the form and manner prescribed by the laws of the State of Texas and the Charter and Ordinances of the City of Euless. SECTION 7 The notice of the election hereby ordered and called shall be promulgated, published, and posted in keeping with the laws of the State of Texas, and the Charter and Ordinances of the City of Euless.
