A RESOLUTION DECLARING THE DETERMINATION NOT TO
UPDATE WATER AND WASTEWATER IMPACT FEES, LAND USE
ASSUMPTIONS AND CAPITAL IMPROVEMENT PLAN
WHEREAS, the City of Euless updated and adopted water and wastewater
impact fees by Ordinance No. 1364 in 1999; and
WHEREAS, Chapter 395 of the Local Government Code as amended by Senate
Bill 243 of the 77th Legislature extended the time for impact fee updates; and
WHEREAS, Chapter 395 of the Local Government Code provides a procedure to
be used when not updating impact fees, land use assumptions and the capital
improvement plan; and
WHEREAS, the City of Euless land use assumptions have not changed and the
capital improvements plan has not changed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
1. THAT the City of Euless has made the determination that an update to its
land use assumptions, capital improvements plan, or impact fees is
unnecessary.
2. THAT the procedures mandated by Chapter 395 of the Local Government
Code to not update impact fees will be followed.
APPROVED AND ADOPTED at a regular meeting of the Euless City Council on
the 12th day of June, 2007, by a vote of 6 ayes, 0 nays, and 0
abstentions.
