A RESOLUTION AFFIRMING THE WATER AND WASTEWATER
IMPACT FEES FOR DEVELOPMENTS IN THE CITY OF EULESS
WHEREAS, the City of Euless updated and adopted water and wastewater
impact fees by Ordinance No. 1364 in 1999; and
WHEREAS, Chapter 395 of the Local Government Code provides a procedure to
be used to not update the current water and wastewater impact fees; and
WHEREAS, the City Council of the City of Euless, by Resolution No. 07 -1252,
made the determination that an update to the water and wastewater impact fees is
unnecessary; and
WHEREAS, the Capital Improvement Advisory Committee of the City of Euless,
by Resolution No. 07 -02 -CIAC, concurred with the City Council's determination; and
WHEREAS, a notice not to update the impact fees was published in the
newspaper for three (3) consecutive weeks; and
WHEREAS, no citizen requested an update to the water and wastewater impact
fees; and
WHEREAS, the City Council finds that in all aspects the City of Euless has
complied with the requirements of Chapter 395 of the Local Government Code to not
update the current impact fees;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS:
1. THAT the water and wastewater impact fees adopted by Ordinance No. 1364
are affirmed and shall continue in effect.
2. THAT the current water and wastewater impact fees shall be updated or
continued without change on or before September, 2012.
APPROVED AND ADOPTED at a regular meeting of the Euless City Council on
the 25th day of September, 2007, by a vote of 7 ayes, o nays, and o
abstentions.
