A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
MANAGER OR HIS DESIGNEE TO CONDUCT A SALE BY PUBLIC
AUCTION OF PARCEL C, LITTLE BEAR ADDITION, AT 10:00 A. M. ON
JANUARY 2, 2008, IN THE CITY'S MUNICIPAL COMPLEX, PUBLISH
NOTICE OF THE AUCTION, AND AUTHORIZING THE MAYOR TO
EXECUTE A CONVEYANCE OF SUCH PROPERTY IF AN
ACCEPTABLE BID IS RECEIVED.
WHEREAS, Section 272.001 of the Local Government Code establishes a
procedure for the Sale by Public Auction of real property owned by a city; and,
WHEREAS, the City of Euless obtained Parcel C at no cost, said site is virtually
encumbered in its entirety by multiple easements, rendering the site undevelopable;
and,
WHEREAS, the City Council has determined that such property is surplus and
will not be needed for municipal purposes; and,
WHEREAS, Section 272.001 of the Local Government Code establishes that
such property may be sold at public auction for fair market value; and
WHEREAS, fair market value is determined by an appraisal or public auction
price; and
WHEREAS, Section 272.001 further establishes that such property can be sold
to one or more abutting property owners, for less than fair market value, if such
property, because of its shape and small size, cannot be used independently under its
current zoning or under applicable subdivision or development control ordinances.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION 1
THAT the City Council authorizes the Sale by Public Auction of Parcel C, Little
Bear Addition, which auction is to be conducted on January 2, 2008, 10:00 a. m. in the
Council Chamber of the Municipal Complex, 201 N. Ector Drive, Euless, Tarrant
County, Texas.
SECTION 2
THAT the City Council directs the City Manager or his designee to conduct such
Public Auction.
SECTION 3
THAT if a bid is received from an individual who does not own abutting property
for an amount equal to or greater than such appraised value, or if a bid is received from
an abutting property owner, such bids could be accepted, and upon receipt by the City
of certifiable funds evidenced by money order, cashiers or certified check in the amount
of the successful bid, the Mayor is authorized and directed to execute in favor of such
successful bidder, a Special Warranty Deed conveying such property. The City of
Euless reserves the right to reject any and all bids.
ADOPTED at a regular meeting of the City Council on the 11th day of December,
2007, by a vote of 7 ayes, o nays, and o abstentions.
