HomeMy WebLinkAbout08-1269 01-22-2008RESOLUTION NO. 08-1269 A RESOLUTION CALLING A GENERAL ELECTION FOR THE OFFICES OF MAYOR AND CITY COUNCIL MEMBERS, PLACE TWO AND PLACE FOUR; ESTABLISHING THE DATES AND TIMES OF EARLY VOTING FOR SUCH ELECTION; ESTABLISHING A DATE FOR A RUNOFF ELECTION, IF REQUIRED; AND AUTHORIZING A CONTRACT WITH TARRANT COUNTY TO FURNISH ELECTION SERVICES AND EQUIPMENT. WHEREAS, pursuant to the Election Code of the State of Texas and the Euless City Charter, it is provided that there shall be held in each municipality in the State of Texas, a general election for the purpose of electing officials of said municipality; and WHEREAS, the City of Euless, Texas ( "Euless ") and the Hurst - Euless- Bedford Independent School District ( "HEBISD ") desire to conduct joint elections pursuant to the provisions of the Texas Election Code, including the conduct of joint early voting and to provide for the sharing of expenses; and WHEREAS, Section 271.002 of the Texas Election Code provides for joint elections upon the passage of a resolution by each of the goveming bodies participating therein reciting the terms of the agreement, including the method for allocating expenses for the election; and WHEREAS, the Euless City Council has determined that a contract with Tarrant County Elections Administration for election services and equipment is in the best interest of the City of Euless. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1 The City Council of the City of Euless, Texas, at a regular meeting held this date, does hereby order an election of officers for the City of Euless, Texas, to be held on the second Saturday in May, that being May 10, 2008, for the purpose of electing the Mayor, one Council Member for Place Two and one Council Member for Place Four, who shall each serve for a period of three years or until their successors have been duly qualified. The candidate receiving a majority of the votes cast for Mayor, the candidate receiving a majority of the votes cast for City Council Member Place Two, and the candidate receiving a majority of the votes cast for City Council Member Place Four, shall be declared elected to such offices. SECTION 2 Pursuant to Resolution 98 -988, approved by the Euless City Council on February 24, 1998, the Hurst - Euless- Bedford Independent School District will conduct a joint election with the City of Euless, Texas, for the purpose of electing Trustees to Place Six and Place Seven of the HEBISD Board of Trustees, unless one of the entities qualify under Section 2.051 of the Texas Election Code to cancel their election. SECTION 3 The City Secretary is hereby authorized to negotiate and execute a contract with the Tarrant County Elections Administrator for the purpose of having Tarrant County furnish all or any portion of the election services and equipment needed by the City Secretary to conduct the election. The contract document and election services provided therein shall conform to Chapter 31, Subchapter D, of the Texas Election Code and other applicable statutes and laws. SECTION 4 The election services contract shall provide (a) the type of electronic voting equipment to be used for early voting by personal appearance and on election day, (b) notification and training for election judges and clerks, (c) an estimate and final payment terms for the election services provided, (d) agreements for early voting equipment and voting machine rental, and (e) other procedures to conduct the election. SECTION 5 Combined ballots may be utilized containing all of the offices and propositions to be voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote for any office or proposition on which the voter is ineligible to vote. Returns may be made on forms, which are individual or combined, and the Tarrant County Election Administrator shall be designated as the custodian of the combined records. Said joint elections shall be conducted in accordance with Chapter 271 of the Texas Election Code. SECTION 6 Steve Rabom, Tarrant County Elections Administrator, 2700 Premier Street, Fort Worth, Texas, 76111, is hereby appointed as Early Voting Clerk and Susan Crim, City Secretary, 201 N. Ector Drive, Euless, Texas, shall serve as Deputy Early Voting Clerk. Applications for ballot by mail must be received by mail no later than the close of business on Friday, May 2, 2008 (Mailing Address: P. O. Box 961011, Fort Worth, Texas, 76161- 0011; Attention: Steve Raborn, Early Voting Clerk.) RESOLU77ON NO. 08-1269, Page 2 of 4 SECTION 7 Early voting by personal appearance shall be conducted at the City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, and at the County's Main Early Voting location, 2700 Premier Street, Fort Worth, Texas, 76111. Branch offices for early voting shall also be established as outlined in the joint election agreement with Tarrant County. Early voting by personal appearance will begin on Monday, April 28, 2008, and will end on Tuesday, May 6, 2008, and the hours designated for early voting by personal appearance shall be as set forth below: April 28 — May 2 May 3 May 4 May 5 -6 (Monday - Friday) (Saturday) (Sunday) (Monday — Tuesday) 8:00 a.m. to 5:00 p.m. 7:00 a.m. to 7:00 p.m. 11:00 a.m. to 4:00 p.m. 7:00 a.m. to 7:00 p.m. For purposes of processing ballots cast in early voting, the election officers for the Early Voting Ballot Board shall be appointed and designated in accordance with the provisions of the joint election agreement with Tarrant County. SECTION 8 All resident, qualified voters, determined by the laws of the State of Texas, the Charter and ordinances of the City of Euless shall be qualified to vote at such election. For the purpose of said election, the entire City is hereby constituted into two voting precincts. Voting on election day, May 10, 2008, shall be conducted at Bear Creek Elementary School, 401 Bear Creek Drive, Euless, Texas, 76039, and City of Euless Public Library, 201 N. Ector Drive, Euless, Texas, 76039, and said election shall be held between the hours of 7:00 a.m. and 7:00 p.m. on the aforementioned date. SECTION 9 Applications for candidacy to the offices of Mayor, City Council Member Place Two and City Council Member Place Four, shall be made to the City Secretary of the City of Euless beginning at 8:00 a.m., February 11, 2008 (first business day after official filing date of February 9, 2008), and not later than 5:00 p.m., March 10, 2008, in manner and form as prescribed by law, and the Charter and ordinances of the City of Euless, Texas. SECTION 10 The names of eligible and qualified candidates for such office shall be placed on the ballots for such election by the City Secretary at the time and in the manner prescribed by law, and the Charter and Ordinances of the City of Euless. Combined ballots may be utilized containing all of the offices and propositions to be voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote for any office or proposition on which the voter is ineligible to vote. The County's voting equipment will be utilized for this election. RESOLUTION NO. 08 -1269, Page 3 of 4 SECTION 11 The results of the election shall be certified, canvassed, and returned in the form and manner prescribed by the laws of the State of Texas and the Charter and Ordinances of the City of Euless. SECTION 12 The notice of the election hereby ordered and called shall be promulgated, published and posted in keeping with the laws of the State of Texas, and the Charter and Ordinances of the City of Euless. SECTION 13 Any runoff election required for the election of members of the City Council of the City of Euless, Texas, following the regular election of May 10, 2008, shall be held on Saturday, June 14, 2008. ADOPTED at a regular meeting of the Euless City Council on the 22nd day of January, 2008, by a vote of 6 ayes, o nays, and 0 abstentions.
