COMMITTMENT TO NEGOTIATE AN AGREEMENT WITH THE CITY OF
FORT WORTH REGARDING THE PURCHASE OF RECLAIMED
WATER DELIVERED THROUGH FORT WORTH'S PROPOSED
RECLAIMED WATER DELIVERY SYSTEM
WHEREAS, the City of Arlington, the City of Euless and the Dallas /Fort Worth
International Airport Board (collectively the "Parties ") desire to implement a Reclaimed
Water System to provide for continued regional growth and water demand; and
WHEREAS, the Parties desire to provide a sustainable source of non - potable
water for irrigation demands; and
WHEREAS, the City of Fort Worth ( "Fort Worth ") seeks to preserve its water
supply and is committed to pursuing water conservation and the use of reclaimed water;
and
WHEREAS, Fort Worth owns and operates the Village Creek Wastewater
Treatment Plant; and
WHEREAS, Fort Worth has contractual water rights to the effluent from the
Village Creek Wastewater Treatment Plant and is a wholesale water and wastewater
provider; and
WHEREAS, Dallas /Fort Worth Airport is a wholesale customer of the Fort Worth
water system; and
WHEREAS, due to the demand on the Fort Worth water supply, it is the desire of
Fort Worth to expand the reclaimed water system; and
WHEREAS, the City of Euless embraces and desires to support the use of
reclaimed wastewater for irrigation and other appropriate uses in order to reduce the
use of potable water; and
WHEREAS, Forth Worth has requested proposals for the design of a reclaimed
water pump station and a reclaimed water transmission pipeline, originating at the
Village Creek Wastewater Treatment Plant and extending to the north and east to serve
customers; and
WHEREAS, such an eastern reclaimed water transmission pipeline could convey
reclaimed water to customers such as the Parties to help meet their demands; and
WHEREAS, in order for the design and construction of a reclaimed water
transmission pipeline to include an approach main to serve the Parties individually; Fort
Worth requires certain assurances, as far as legally practicable, from each Party,
individually and collectively, that each Party is authorized to enter into an agreement
with Fort Worth to participate in the reclaimed water system to include but not be limited
to the Party's proportionate share of the cost of construction for the pipeline, the cost of
operation and maintenance of the Fort Worth reclaimed water system, and the rates for
use of the Fort Worth reclaimed water system; and
WHEREAS, Fort Worth is agreeable to funding the design costs for a reclaimed
water pipeline to serve the Parties, individually and /or collectively, upon passage of this
Resolution; and
WHEREAS, prior to construction of the reclaimed water transmission pipeline,
the City of Euless shall enter into a binding agreement with Fort Worth: to fund its
proportionate share of the construction cost; to agree to the rate and rate methodology
for the reclaimed water system; and other necessary provisions; and
WHEREAS, it would be beneficial to the City of Euless to participate in the Fort
Worth's reclaimed water system; and
WHEREAS, Fort Worth and Euless shall negotiate fair and equitable terms.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION 1
THAT the City of Euless shall enter into good faith negotiations to participate in
the cost of construction of a reclaimed water transmission pipeline to include an
approach main to serve Euless and shall, prior to construction of the reclaimed water
transmission pipeline, enter into a binding agreement with Fort Worth as soon as
reasonably practicable describing certain terms and conditions including but not limited
to the following:
1. The City of Euless' share of the capital cost of the reclaimed water
transmission pipeline; and
2. the rate and rate methodology for the reclaimed water used by the Party
through the Fort Worth reclaimed water system; and
APPROVED at a regular meeting of the Euless City Council on the 11th day of
March, 2008, by a vote of 7 ayes, o nays, and 0 abstentions.
