A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
AN AGREEMENT BETWEEN THE CITY OF EULESS AND THE ARBOR
GLEN HOMEOWNERS ASSOCIATION FOR RECONSTRUCTION OF
EMERGENCY ACCESS AND UTILITY EASEMENTS
WHEREAS, Euless and Arbor Glen Homeowners Association (HOA) mutually
desire to enter into an agreement to reconstruct the emergency access and utility
easements with the Arbor Glen Addition (the "Project "); and
WHEREAS, Chapter 380, Texas Local Government Code, as amended (the
"Act "), provides authorization for municipalities to contract with third party entities for the
performance of programs such as are contemplated hereunder; and
WHEREAS, the Euless City Council has determined that the Program provided
hereunder will promote local economic development and stimulate business and
commercial activity in the municipality; and
WHEREAS, Euless and HOA have need to reconstruct these emergency access
and utility easements, which shall be located in the Arbor Glen Addition; and
WHEREAS, Euless and HOA shall provide the financing for the Program as
provided herein; and
WHEREAS, Euless and HOA are willing to cooperate with one another to
accomplish the construction and maintenance as provided in the Agreement; and
WHEREAS, each part paying for the performance of services under this
Agreement must make those payments from current revenues; and
WHEREAS, it is mutually advantageous to both parties to enter into such
Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION I
THAT the City Council of the City of Euless, Texas, authorizes the City Manager
to execute that certain Agreement providing the terms of the Program above provided
for between the City of Euless and the Arbor Glen Homeowners Association for the
reconstruction of the emergency access and utility easements.
SECTION II
EFFECTIVE DATE. This resolution shall become effective immediately from and
after its passage as provided by the Euless City Charter and the laws of the State of
Texas.
ADOPTED AND APPROVED at the regular meeting of the Euless City Council
on the 24th day of June, 2008, by a vote of 7 ayes, 0 nays, and 0
abstentions.
