A RESOLUTION APPROVING A LEASE AND INCENTIVE
AGREEMENT BY AND BETWEEN THE CITY OF EULESS, THE
EULESS DEVELOPMENT CORPORATION, AND U.S. CONCRETE,
INC., AND ITS SUBSIDIARY REDI MIX, L.L.C., AND AUTHORIZING
THE MAYOR TO EXECUTE SUCH AGREEMENT AND MAKE
MODIFICATIONS THERETO
WHEREAS, the City of Euless, and the Euless Development Corporation and U.
S. Concrete and its subsidiary Redi Mix, L.L.C., mutually desire to enter into a Lease
and Incentive Agreement to provide for the construction of a regional headquarters and
training facility to be leased by Redi Mix, L.L.C., as its sole office for sales of its ready -
mixed concrete products in Dallas /Fort Worth; and
WHEREAS, Chapter 380, Texas Local Government Code, as amended, (the
"Act"), provides authorization for municipalities to contract with third party entities for the
performance of programs such as are contemplated hereunder; and
WHEREAS, the Euless City Council has determined that the Program provided
hereunder will promote local economic development and stimulate business and
commercial activity in the municipality; and
WHEREAS, the City of Euless, the Euless Development Corporation and U. S.
Concrete and its subsidiary Redi Mix, L.L.C., are willing to cooperate with one another
to accomplish the construction and lease and incentive terms as provided in the
Agreement; and
WHEREAS, it is mutually advantageous to all parties to enter into such
Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION I
AUTHORIZATION. That the City Council of the City of Euless, Texas authorizes
the Mayor to execute that certain Lease and Incentive Agreement by and between the
City of Euless, the Euless Development Corporation and U.S. Concrete and its
subsidiary Redi Mix, L.L.C., and make any amendments determined to be necessary
and appropriate thereto.
SECTION II
EFFECTIVE DATE. This resolution shall become effective immediately from and
after its passage as provided by the Euless City Charter and the laws of the State of
Texas.
ADOPTED AND APPROVED at the regular meeting of the Euless City Council
on the 24th day of June, 2008, by a vote of 7 ayes, 0 nays, and 0
abstentions.
