MINUTES
A regular meeting of the Planning and Zoning Commission was called to order by
Chairman Steve Ellis at 5:30 p.m. on April 19, 2022, in the Pre -Council Conference Room
of City Hall, 201 North Ector Drive. Those present included Chairman Ellis, Vice Chairman
LuAnn Portugal and Commission Members: Richard Barker, David Brown, Eric Owens
and Ronald Dunckel. Commissioner Curtis Brown was absent.
During the Pre -Session Meeting:
➢ Senior Planner Stephen Cook reviewed the regular agenda and gave a brief
Development Update.
PLANNING AND ZONING CONSIDERATION OF SCHEDULED ITEMS — COUNCIL
CHAMBERS
The Euless Planning and Zoning Commission continued their meeting in the Council
Chambers at 6:30 p.m. for consideration of scheduled items.

Commissioner D. Brown led the pledge of allegiance.
ITEM 1. APPROVED PLANNING AND ZONING MINUTES
Commissioner D. Brown made a motion to approve the minutes for the regular meeting
of April 5, 2022.
Commissioner Barker seconded the motion. The vote was as follows:
Ayes: Vice Chairman Portugal and Commission Members: Barker, D. Brown,
Owens and Dunckel.

ITEM 2. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 22-
03-SUP AND RECOMMENDED AN ORDINANCE
Chairman Ellis opened the public hearing on Specific Use Permit Case No 22-03-SUP at
6:35 PM.
Senior Planner Stephen Cook gave a brief description of the case. The applicant is
requesting a Specific Use Permit (SUP) for a psychiatric and substance abuse care center
in an existing facility originally constructed as a hospital and has recently been used as a
substance care center by a different operator. Such facilities require a SUP in the heavy
industrial zoning district.
The property had been operating under a SUP since 2006. The property is 6.0 acres in
size. The facility is approximately 63,270 square feet in size. Access to the property is
through a shared drive access from West Euless Boulevard. The facility has an
agreement with the adjacent property owner for a sign on West Euless Boulevard as well
as the access drive.
With the new SUP, the new operators have provided a new landscape plan for the facility
with tree and shrub planting and an outdoor recreation area on the south side of building
for their client's use. There is adequate parking for the use of the building.
The operator has worked with the City of Euless Police and Fire Departments to design
a protocol for when City Services would be called in emergent situations for the assistance
of clients who may be in distress during their treatment at the facility.
New wayfinding signage has been installed within the building to assist emergency
personnel when accessing the facility.
Staff recommends the Specific Use Permit, with the following conditions:
a. The Specific Use Permit is tied to the business owner, Positive Recovery, LLC;
and
b. The Specific Use Permit is tied to the business name, Positive Recovery Centers
- DFW; and
c. An emergency response plan will be generated by the operator of the facility in
cooperation with the City of Euless Fire and Police Departments. This plan will set
the parameters of what is considered an emergent situation and the expectations
of response. The plan will be set into writing, and provided to all employees of the
facility and provided to the families of those in the facility's care; and
d. Maintenance of the entire building will be required for life, health, and safety
purposes regardless if the entire facility is actively utilized for the primary purpose
of the business; and
e. The Specific Use Permit may be revoked if one or more of the conditions imposed
by this permit has not been met or has been violated.

Julie DeNofa, the applicant and business owner, gave a presentation about Positive
Recovery Centers' background, other locations, and the mission of their business. They
treat adults over the age of 18. No adolescent care at this time, but if needed, they would
engage with the City for any consideration. Ms. DeNofa gave a specific description on the
care that is given to their clients, their families, along with hours of operation, and facility
arrangements. Ms. DeNofa also conveyed that in 2012 the previous business "The Right
Step" was sold and her business partner continued to be the owner and landlord of the
building. Their decision to stay in Euless was because while doing business as "The Right
Step" they partnered well with the community and served many people. Ms. DeNofa
explained that they will treat outpatient clients for now and then file with the state to be
able to accept inpatient clients. There is room for growth but at this time will have 43 beds,
which is less than half of what was previously offered. Ms. DeNofa also mentioned that
they are an accredited Joint Commission Center which is a gold standard healthcare
network and offer affordable payment options.
Jaime Demeris, a representative with Ms. DeNofa, gave his testimony and the impact this
program offered him.
Chairman Ellis asked to hear from any proponents/opponents who wished to speak.
Seeing none, Chairman Ellis closed the public hearing at 6:51 p.m.
Commissioner Owens asked for clarification on the connection of the prior business to
Positive Recovery Center.
Ms. DeNofa said that Positive Recovery Center is under a completely different ownership.
Commissioner D. Brown asked about the timeframe of receiving a license to treat the
overnight in-house patients.
Ms. DeNofa responded that the timeframe is between 45 to 120 days and includes the
acceptance of the license application, and an additional 6 months to complete the process
and receive the appropriate license.
There were no further questions or comments presented by the Commission.
Vice Chairman Portugal made a motion to approve Case No. 22-03-SUP for a Specific
Use Permit on Lot 2, 2219 West Euless Boulevard for a psychiatric and substance abuse
care center in the Heavy Industrial (1-2) zoning district with the conditions as presented.
Commissioner Dunckel seconded the motion. The vote was as follows:
Ayes: Chairman Ellis, Vice Chairman Portugal and Commission Members:
Barker, D. Brown, Owens and Dunckel.
Nays: None

ITEM 3. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 22-
04-SUP AND RECOMMENDED AN ORDINANCE
Chairman Ellis opened the public hearing on Specific Use Permit Case No 22-04-SUP at
6:51 PM.
Senior Planner Cook gave a brief description of the case. The applicant is purchasing the
franchise store of Uptown Cheapskate, a used merchandise store which received a
Specific Use Permit in May, 2020 for the subject address. This Specific Use Permit is to
change the business owner and business name to the new ownership group of the
franchise. The applicant has indicated that no operational changes will be made to the
existing business. Since the opening of the business last year, the City has not received
any complaints on the operation of the business in this location.
Staff is recommending the continuation of the same operational conditions for the Specific
Use Permit in this location with the modifications to the business owner and business
name.
Staff recommends the Specific Use Permit, with the following conditions:
a. The Specific Use Permit is tied to the business owner, BCR Colleyville UC, LLC;
and
b. The Specific Use Permit is tied to the business name, Uptown Cheapskate
Colleyville; and
c. All merchandise shall be displayed within the store and not exterior to the building;
and
d. Any customer bringing items to be sold to the retail store shall bring such items
interior to the store during business hours; and
e. No items shall be left exterior to the store. Any such items shall be removed in a
timely manner; and
f. The Specific Use Permit may be revoked if one or more of the conditions imposed
by this permit has not been met or has been violated.
Chairman Ellis asked to hear from any proponents/opponents who wished to speak.
Seeing none, Chairman Ellis closed the public hearing at 6:54 p.m.
There were no questions or comments presented by the Commission.
Commissioner Owens made a motion to approve Case No. 22-04-SUP for a Specific Use
Permit on Block K, Lot 4R1, 1220 Chisholm Trail, Suite 200 for a Used Merchandise store
in the Planned Development (PD) zoning district with the conditions as presented.
Commissioner Barker seconded the motion. The vote was as follows:
Ayes: Chairman Ellis, Vice Chairman Portugal and Commission Members:
Barker, D. Brown. Owens and Dunckel.
