A RESOLUTION AUTHORIZING THE CITY MANAGER TO ESTABLISH
AND RESCIND A BURN BAN WITHIN THE CITY OF EULESS AND
THEREBY PERMITTING THE ENFORCEMENT OF ORDINANCE NO. 1741
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council recognizes that fires can have a detrimental impact on
the safety and quality of life of our citizens; and
WHEREAS, weather conditions can create periodic times of extreme fire danger in
the community; and
WHEREAS, the Fire Marshal monitors the necessity to restrict outdoor burning
based on prevailing and long term weather conditions and predictions; and
WHEREAS, the City Council wishes to exercise the authority to enact and rescind a
burn ban in a timely and efficient manner without the need to consider each occurrence of
the issuance of a bum ban as an agenda item.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION I
That the City Manager is hereby authorized to declare a city wide burn ban or to
rescind the same on the recommendation of the Fire Marshal and Fire Chief based upon
probable cause that a burn ban is warranted. During the period that a bum ban is in effect,
the provisions of Ordinance No. 1741, as codified in Section 34 -135 of the Euless Code of
Ordinances will be in effect in their entirety.
SECTION II
That the City Council shall be notified of the City Managers actions in a timely
manner and that any member of the City Council may request the action to be placed on a
future agenda for discussion and/or action.
SECTION III
EFFECTIVE DATE. This resolution shall become effective immediately upon its
passage and approval.
APPROVED AND ADOPTED at a regular meeting of the Euless City Council on the
24th day of February, 2009, by a vote of 7 ayes, o nays, and o abstentions.
