HomeMy WebLinkAbout59-19 03-10-1959RESOLUTION NO. 19/ WHEREAS, by reason of the death of A. B. Tillery, a vacancy exists in the office of Councilman held by A. E. Tillery, who was duly elected to serve until April 1, 1960, or until his successor was duly elected and qualified; and WHEREAS, pursuant to the provisions of Title 28, Chapter 2, of the Revised Civil Statutes of Texas, it is provided that in case of a vacancy from any cause the City Council shall order a special election to fill such vacancy, NOV THEREFORE, BB IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. THAT the City Council of the Cityof Euless, Texas, at a regular meeting held this date, does hereby order a special election of one councilman for the City of Euless, Texas, to be held on Saturday, May 2, 1959, for the purpose of electing a councilman for the unexpired term of A. E. Tillery, for a period from the date of such election until April 1, 1960, or until his successor is duly elected and qualified. The effective date of taking office shall be May 2, 1959. The can- didate receiving the highest number of votes for the office of Councilman for the unexpired term of A. E. Tillery shall be elected to such office. Ir . FOR the purpose of said special election, the entire City is hereby consti» tuted one voting precinct; the polling place for said special election shall be held in the City Hall within said City and said special election shall be held between the hours of 7:00 A. Iv. ANY eligible and qualified person may have his name tinted upon the official ballot as an independent Candidate for the office of City' Councilman by filing his sworn application with the Mayor not later than Midnight, April 2, 1959. The application shall state the name of the office sought, his occupation, Post Office address, and County of the residence of said applicant the applicant's age, .I'` place of t.; .. +1. kin of citizenship, .. «,a length ..c res°.�d e in the County and State, # 1 and shall be accompanied by a fee of $1,00, which shall be deposited with the City Secretary. The fee received by the City Secretary shall be deposited in the General Fund of the City. V. (A) The form of the sworn application shall be substantially as follows: To the Mayor of the City of Euless, Texas, Greetings: I, , hereby make application for the office of City Councilman at the Special Election to be held on the 2nd day of May, 1059. My occupation is: , Post Office Address , County of my residence is My age is: , Place of Birth: rind of Citizenship Length of residence in the County and State are: I hereby certify that I am qualified to make this application and that I am legally qualified to hold such office if I am elected, Candidatets Signature THE STATE OF TEXAS COUNTY OF TARRANT I, , being duly sworn, depose and Say that tie statements contained in the foregoing application are true. (Signed) Subscribed and sworn to before me this day of A.D. 1959. Notary Public in and for Tarrant County, Texas (S) Such sworn application shall be accompanied with an executed copy of the "Loyalty Affidavit" as required by Article 6.02 Election Code, Vernon's Texas Statutes, in substantially the following form: "I, , of the City of Euless, County of Tarrant, State of Texas, being a candidate for the office of City Councilman, do solemnly swear that t believe in and approve of our present representative form of government, and if elected, I will support and defend our repre- sentative form of government and shall resist any effort to movement from any part thereof, and I will support and defend the Constitution and Laws of the United States and of the State of Texas." VI. • Notary Public in and for Tarrant County, Texas THE names of all those who have filed their sworn applications as candidates and have paid the required file fee shall be posted by the City Secretary in a conspicuous place at the place of the holding of said spedal election for inspection of the Public for at least ten days before he orders the ballots to oe printed. All objections shall be made within five days after such posting by written notice filed with the City Secretary, setting forth the grounds of objections. In case no such objection is filed within the time pre- scribed, the regularity or validity of the application of no person whose name �.. is so posted, shall be thereafter contested, The City Secretary shall preserve in his possession, for a period of two years, all applications, notices of objections and other related papers. VII. Any person eligible to the office herein provided for, who has filed his sworn application in accordance with the provisions of this resolution, shall have his name printed on the official ballots. Any such person may cause his name to be withdrawn at any time before ballots are printed, by filing in writing with the City Secretary, a request to that effect over his signature, duly attested to by a Notary Public. No name so withdrawn shall be printed on the ballots. Not later than ten (10) days before the City Special Election, the City Secretary shall have the official ballots printed. VIII. The ballots to be used in said special election shall be prepared in the manner and form in the Election Code of the State of Texas enacted by the 1951 Legislature. IX. All qualified voters within the meaning of the Constitution and Laws of the State of Texas, who have resided in the State of Texas for a period of one year, and in the City of Euless for a period of six months prior to the date of the election herein provided for, shall be entitled to vote at such special election. - 3 - x. Voting by absentee ballot in said election shall commence on the 13th day of April, 1959, at the office of the City Secretary, Euless, Texas. Voting by absentee ballot shall close at five (5 :00) P.M. on the 28th day of April, 1959. xI. The election officers above names shall make and deliver the returns of said election in triplicate, one being retained by the presiding Judge, one delivered to the Mayor of the City, and one delivered to the City Secretary. The ballot box containig the signature stubs from ballots used in said election shall be delivered to the District Clerk of Tarrant County, Texas, and other ballot boxes and election records and supplies shall be preserved by the City Secretary in the proper office as by law provided. The City Council will meet at eight P.M. on Friday, the 8th day of May, 1959, being not less than five days and no more than seven days after the date of the election for the purpose of canvassing the returns of said specail election. XII. The Mayor is hereby directed to give notice of said special election which shall be signed by the Mayor under the attest of the City Secretary, and shall state the purpose of the special election, the officer to oe elected, and the Chief of Police shall post a properly executed copy of the election proclamation at the polling place herein provided and two copies at two other public places within the City. Such notices shall have attached thereto a certified copy of this Resolution. XIII, Said special election shall be held and conducted in accordance with the Laws of the State of Texas for the holding of general elections for State and County offices except as otherwise provided by Chapter 2, Title 28, of the Re- vised Civil Statutes of Texas.
