HomeMy WebLinkAbout63-58 02-12-1963RESOLUTION NO. 58 WHEREAS, pursuant to the provisions of Title 28, Chapter 2, of the Revised Civil Statutes of Texas, it is provided that there shall be held in each municipality in the State of Texas on the first Tuesday in April of each year, a general election for the purpose of electing officers of said municipality: NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. THAT the City Council of the City of Euless, Texas, at a regular meeting held this date, does hereby order an election of officers for the City of Euless, Texas, to be held on Tuesday, April 2, 1963, for the purpose of electing a Mayor and two (2) Councilmen, who shall serve for a period of two (2) years, or until their successors have been duly qualified. The effective date of taking such office shall be April 2, 1963. The candidate for Mayor receiving the highest number of votes for the office of Mayor shall be declared elected to such office. The two (2) candidates receiving the highest number of votes for the office of City Councilman shall be declared elected to such offices. II. FOR the purpose of said election, the entire City is hereby con- stituted one voting precinct; the polling place for said election shall be the City Hall within said City and said election shall be held between the hours of 7:00 A.M. and 7:00 P.M. on the aforementioned date, and the following persons are hereby appointed to act as election officers: /1)7/10_ t&_ 2h-1 -7 _—' 114-4-4L,) Presiding Judge 731,107. Clerk NO person shall be eligible for the office of Mayor or Councilman unless he is a property owner within the Corporate limits of the City of Euless, a qualified voter of the City of Euless, a resident of the United States, and has been a resident of the City of Euless for at least two (2) years, and is not in arrears in the payment of any taxes or other liability due the City of Euless. IV. ANY eligible and qualified person may have his name printed upon the official ballot as an independent candidate for the office of Mayor or Councilman by filing his sworn application with the City Secretary not later than Midnight, March 2, 1963. The applications shall state the specific office or place being sought by the applicant and that the applicant is eligible and qualified under the laws of the State of Texas, to become a candidate for and hold the office being sought, if elected. follows: v. a) The form of the sworn application shall be substantially as TO THE CITY SECRETARY OF THE CITY OF EULESS, Greetings: "I, , do hereby declare that I am a candidate for the office of , and request that my name be printed upon the official ballot for that particular office in the next City election. Notary Public in and for Tarrant County, Texas. b) Such sworn application shall be accompanied with an executed copy of the "Loyalty Affidavit" as required by Article 6.02 Election Code, Vernon's Texas Statutes, in substantially the following form: "I, , of the City of Euless, County of Tarrant, State of Texas, being a candidate for the office of , do solemnly swear that I believe in and approve of our present representative form of government, and if elected, I will support and defend our representative form of government and shall resist any effort to movement from any part thereof, and I will support and defend the Constitution and the Laws of the United States and of the State of Texas. VI. names of all those who have filed their sworn applications to have their names printed on the official ballot as candidates shall be posted by the City Secretary in a conspicuous place at the place of the holding of said election for inspection of the public for at least ten (10) days before he orders the ballots to be printed. All objections shall be made within five (5) days after such posting by written notice filed with the City Secretary, setting forth the grounds of objections. In case no such objection is filed within the time prescribed, the regularity or validity of the application of no person whose name is so posted, shall be thereafter contested. The City Secretary shall preserve in his possession, for a period of two (2) years, all applications, notices of objections and other related papers. VII. ANY person eligible to the offices herein provided for who has filed his sworn application in accordance with the provisions of this Resolution, shall have his name printed on the official ballot. Any such person may cause his name to be withdrawn at any time before ballots are printed by filing in writing with the City Secretary a request to that effect over his signature, duly attested by a Notary Public. No name so withdrawn shall be printed on the ballots. Not later than ten (10) days before the balloting begins, the City Secretary shall have the official ballots printed. VIII. THE ballots to be used in said election shall be prepared in the manner and form as provided in the Euless City Charter and as provided in the Election Code of the State of Texas enacted by the 1951 Legislature. The ballots shall be printed prior to March 14, 1963. IX. ALL qualified voters within the meaning of the Constitution and Laws of the State of Texas, who have resided in the State of Texas for a period of one (1) year, and in the County of Tarrant for a period of six (6) months prior to the date of the election herein provided for, and who are residents of the City of Euless, Texas, shall be entitled to vote at such election. X. VOTING by Absentee Ballot in said election shall commence on the 14th day of March, 1963, at the office of the City Secretary, Euless, Texas. Voting by Absentee Ballot shall close at 5:00 P.M. on the 29th day of March, 1963. XI. THE election officers above -named shall make and deliver the returns of said election in triplicate, one being retained by the Presiding judge, one delivered to the Mayor of the City, and one delivered to the City Secretary. The ballot box containing the signature stubs from ballots used in said election shall be delivered to the District Clerk of Tarrant County, Texas, and other ballot boxes and election records and supplies shall be preserved by the City Secretary in the proper office as by law provided. The City Council will meet not more than forty -eight (48) hours after the date of the election for the purpose of canvassing the returns of said election. THE Mayor is hereby directed to give Notice of said election which shall be signed by the Mayor, under the attest of the City Secretary, and shall state the purpose of the election, the officers to be elected, and the Chief of Police shall post a properly executed copy of the election proclamation at the polling place herein provided and two copies at two other public places within the City. Such notices shall have attached thereto a certified copy of this Resolution. SAID election shall be held and conducted in accordance with the Euless City Charter and the laws of the State of Texas for the holding of general elections for State and County offices except as otherwise pro- vided by Chapter 2, Title 28, of the Revised Civil Statutes of Texas.
