HomeMy WebLinkAbout2022-08-09MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, August 9, 2022 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:32 p.m. on Tuesday, August 9, 2022, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tem Eddie Price, Council Members Tim Stinneford, Jeremy Tompkins, Perry Bynum, and Tika Paudel. Council Member Harry Zimmer was not present due to a scheduled absence. During the Precouncil meeting: ➢ Council Member Bynum advised that he attended the Hurst Euless Bedford Independent School District (HEB ISD) convocation held Friday, August 5, 2022, and expressed his appreciation to Joe Harrington, HEB ISD Superintendent, and his staff for a job well done. ➢ Council Member Paudel expressed his appreciation to City staff for their help with the community blood drive event that was held Saturday, August 6, 2022. The event was a success with 46 donors in attendance. ➢ City Secretary Kim Sutter discussed the Board and Commission reappointments and advised that all candidates with expiring terms this year have requested to be considered for reappointment. She advised that reappointments will be considered at the August 22 meeting. ➢ Director of Parks and Community Services Ray McDonald advised of the removal of the batting cages at the Parks at Texas Star South and stated that once the cages are removed, the area will become a green space. ➢ City Manager Loretta Getchell advised that with the relocation of the entrance to the Parks at Texas Star North (formerly Softball World), the facility has been readdressed to 951 Highland Drive. ➢ Deputy City Manager Chris Barker advised that the North Tarrant Express (NTE) will be performing roadway maintenance on the eastbound service road of Highway 183 between Westpark Way and Highway 157 Tuesday night, August 9, 2022, and Wednesday night, August 10, 2022. The Police Department has been informed and will assist in traffic control. The public has been informed of the repairs through social media and the City website. ➢ Director of Public Works and Engineering Hal Cranor presented the Capital Projects update including Harwood Road improvements and the drainage channel construction at Bear Creek Elementary School. Council Minutes Page 2 of 12 August 9, 2022 Additionally, Mr. Cranor provided an update on the addition of the "No Parking" signs at Arbor Creek Elementary School, the status of the traffic signal repair at the intersection of Main Street and Mid Cities Boulevard, and reported that current lake levels are at a little over 80 percent full. ➢ City Manager Getchell advised that the Police Department, at the request of the school district, will have an enhanced presence on the school campuses for the first day of school. ➢ City Manager Loretta Getchell reviewed the regular agenda. Ms. Getchell welcomed Ms. Cara White and Mr. Stephen Cook to tonight's meeting. Stephen Cook, Senior Planner, Dunaway and Associates, addressed the City Council regarding the Watercolor Planned Development amendment (Item #12). He advised that the proposed amendment will rezone the undeveloped 63 acres into a mix of single family attached and detached homes, urban lofts, commercial development, and includes public amenities which reflects much of the original zoning ordinances intentions. City Manager Getchell (Item #19) noted that the Euless Development Corporation (EDC) Board of Directors authorized an additional $375,000 from reserves to be applied toward the Wilshire Park improvements as the bids came in higher than anticipated. ➢ City Attorney Cara White reviewed a proposed ordinance related to offenses associated with street racing. The proposed ordinance will assist the Police Department in addressing street racing incidences. She advised that the Police Department is working closely with neighboring cities to coordinate enforcement. Fire Chief Chanc Bennett presented a Fire Department update including total response times, total number of runs, new personnel, on -going training, status of Fire Station No. 1 construction, social media activities, retiree luncheon, Fire Marshal activities, Fire Prevention Week, and the upcoming Public Safety Open Houses scheduled for October 1, 2022. Director of Planning and Economic Development Michael Warrix presented a Development update. He reported on new personnel, the promotion of Don Sheffield to Assistant Director, new commercial development, and redevelopment. ➢ Director of Finance Janina Jewell presented a Financial update and advised that car rental tax collections for the month of May 2022 were up 18 percent over last year, up 350 percent from two years ago, and up 30 percent from three years ago. ITEM NO. 1. PRESENTATION OF EMPLOYEE OF THE MONTH Assistant Police Chief Gary Landers recognized Code Compliance Inspector I Paul Schafer. Paul was accompanied by his wife, Trish, daughter, Kysa, stepson, Ronnie, members of the Police Department and the Code Compliance Division. Mayor Martin presented Paul with a plaque commemorating his selection as Employee of the Month for August. ITEM NO. 2. PRESENTATION OF EMPLOYEE SERVICE PINS Assistant Police Chief Landers introduced Public Service Officer Chris Garcia. Chris was accompanied by his parents, Tom and Tracey Miles, grandparents, Richard and Catherine Mack, and members of the Police Department and the Code Compliance Division. Mayor Martin presented Chris with a service pin commemorating his five years of service with the City. Mayor Martin announced and expressed her congratulations to David See on reaching five years of service with the City. Deputy City Manager Chris Barker introduced General Manager Texas Star Golf Course and Conference Centre Glenda Hartsell -Shelton. Glenda was accompanied by her sister, Marina; niece, Leslie; cousin, Patsy; friends, Randy, Rick, Kathy, and, Robi. Mayor Martin presented Glenda with a service pin and clock commemorating her 25 years of service with the City. ITEM NO. 3 PRESENTATION OF MUNICIPAL CLERK'S OFFICE ACHIEVEMENT OF EXCELLENCE AWARD Amanda Campos, President, Texas Municipal Clerk's Association, Inc., presented City Secretary Kim Sutter and members of the City Secretary's Office with the Municipal Clerk's Office Achievement of Excellence Award, recognizing excellence in the effective and efficient management of resources in the Municipal Clerk's Office. The Euless City Secretary's Office is one of nineteen inaugural recipients of this award and has earned the distinction for two consecutive award periods. ITEM NO. 4 RECOGNITION OF RECIPIENTS OF THE EAGLE SCOUT AWARD FROM THE BOY SCOUTS OF AMERICA Mayor Martin present Zain Adatia, Ahad Ali, Sameer Ali, Ayaan Amlani, Ali Bharwani, Aasim Kamruddin, Mizan Mohammed, Aalyan Rajwani, and Danial Samdani with a certificate in recognition of achieving the rank of Eagle Scout from the Boy Scouts of America. AUTHORIZED CITY MANAGER TO EXECUTE AN ENGINEERING DESIGN CONTRACT Authorized the City Manager to execute an engineering design contract with Kimley-Horn & Associates, 2201 West Royal Lane, Suite 275, Irving, Texas, for the roadway and ADA improvements at the intersection of Mid -Cities Boulevard/Cheek-Sparger Road and State Highway 121. ITEM NO. 6. RATIFIED THE ACTION OF THE CITY MANAGER TO PROCEED WITH EMERGENCY REPAIRS RELATED TO THE CITY'S WATER WELLS Ratified the action of the City Manager to proceed with emergency repairs to the City's water wells at Fuller and Far North Well lots and found that the procurement is necessary to preserve the public health and protect the safety of the City's residents. In order to maintain the existing warranty of the new wells, Weisinger Incorporated, 18150 Interstate 45 North, Willis, Texas, will perform the work. The estimated expenditure is $417,810. ITEM NO. 7. APPROVED AWARD OF A CONTRACT Approved award of a contract for specific re -insurance coverage for the City's health insurance program for October 1, 2022 to September 30, 2023, to Granular Insurance Company, 269 East Grand Avenue, South San Francisco, California, for a term of one year. The estimated expenditure is $1,002,493. Council Minutes Page 6 of 12 August 9, 2022 ITEM NO. 8. AUTHORIZED PURCHASE OF AUTOMOTIVE AND EQUIPMENT TIRES Authorized the purchase of automotive and equipment tires from Republic Tire & Supply, 125 North Vine Street, Euless, Texas, through the BuyBoard Purchasing Cooperative Contract No. 636-21 with Michelin North America, Inc. Actual expenditures will be on an as needed basis and the estimated expenditure is $80,000. ITEM NO. 9. RECEIPT OF NOTICE ABOUT 2022 TAX RATES Acknowledged receipt of Notice About 2022 Tax Rates from designated employee calculating No -New -Revenue Rate and Voter Approval Rate. ITEM NO. 10. RECEIPT OF CERTIFICATION OF ADDITIONAL SALES AND USE TAX Acknowledged receipt of Certification of Additional Sales and Use Tax from Financial Officer or Auditor to pay debt services for 2022 Tax Year. ITEM NO. 11. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the precouncil and regular meeting of June 28, 2022, and the special called meeting of August 1, 2022. REGULAR AGENDA ITEM NO. 12. HELD PUBLIC HEARING AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2308 Mayor Martin opened the public hearing at 7:30 p.m. Stephen Cook, Senior Planner with Dunaway & Associates, presented the case to the City Council and advised that the applicant is requesting to change the zoning of 32.863 acres in the A. Bradford Survey, Abstract No. 152, Tracts 4, 4B, 4132A, 4131A, 4C1, 4C2, 4D, 4D1, 4D2, and 4E and 30.377 acres in the Abraham Barnard Survey, Abstract No. 107, Tracts 1A and 1 C, located northwest of State Highway 360 and State Highway 183 from Planned Development District (PD) to a Planned Development District (PD) zoning. The zoning case for this planned development intends to rezone the undeveloped 63 acres into a mix of single-family (SF) attached and detached homes, urban lofts (Multifamily), and commercial development with retail, restaurant space and the possibility of a hotel. Mr. Cook reviewed the conditions of the ordinance and noted the new water feature will be constructed with the residential development. He further advised that the Planning and Zoning Commission considered the amendment to the Planned Development on July 19, 2022, and recommended approval by a vote of 5-0-0. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:46 p.m. Council Minutes Page 7 of 12 August 9, 2022 Mehrdad Moayedi, President and CEO, Centurion American Development Group, and Michael Beaty, President, Mooreland Development, were present to address any questions. Council Member Tompkins expressed his appreciation for the pedestrian circulation plan that has been included in the development of the project. Council Member Paudel expressed his appreciation to the developers on their commitment to build the commercial area and the residential area concurrently. Council Member Bynum motioned to approve Ordinance No. 2308, amending the Code of Ordinances of the City of Euless, TX, Chapter 84, Unified Development Code, amending the City of Euless Zoning District Map on approximately 32.863 acres in the A. Bradford Survey, Abstract No. 152, Tracts 4, 4B, 4B2A, 4B1A, 4C1, 4C2, 4D, 4D1, 4D2, and 4E and 30.377 acres in the Abraham Barnard Survey, Abstract No. 107, Tracts 1A and 1 C, by changing the zoning from Planned Development (PD) District to Planned Development (PD) District zoning. ITEM NO. 13. APPROVED FIRST AMENDMENT TO RIVERWALK! AT EULESS DEVELOPMENT AGREEMENT (Secretary's Note: this item is a companion item to Agenda Item #12) Director of Planning and Economic Development Warrix presented the case to the City Council and outlined the First Amendment to Riverwalk! at Euless Development Agreement. MM Euless 66, LLC purchased the undeveloped portion (approximately 63 acres) of the project from SLF and is requesting to amend the Riverwalk! PD to rename the district to "Watercolor Planned Development District" (Watercolor PD), remove the riverwalk amenity, and provide for a new primary water feature consisting of a lake and hike and bike trails to complement the proposed pedestrian -oriented mixed -use development. Council Member Tompkins motioned to approve the First Amendment to Riverwalk! at Euless Development Agreement. Mayor Pro Tem Price seconded the motion. ITEM NO. 14. APPROVED SITE PLAN NO. 22-02-SP Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant is seeking approval for 0.78-acre commercial development to be located in Glade Parks, Block A, Lot 4, on the northeast corner of Rio Grande Boulevard and Loving Trail, and intends to construct a 2,513 square foot drive- thru restaurant. Mr. Warrix reviewed the access to the site, parking, pedestrian path connection, landscaping, and elevations. The Planning and Zoning Commission considered the site plan at their July 5, 2022, meeting and voted 5-0-0 to recommend approval. Council Member Stinneford motioned to approve Site Plan No. 22-02-SP, for a commercial development to be located in Glade Parks, Block A, Lot 4, on the northeast corner of Rio Grande Boulevard and Loving Trail. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 15. APPROVED SITE PLAN NO. 22-03-SP Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant is seeking approval for a 1.49-acre commercial development to be located in Glade Parks, Block A, Lot 5, east of Rio Grande Boulevard and approximately 180 feet north of Loving Trail, and intends to construct an 8,391 square foot retail building with a drive-thru restaurant. Mr. Warrix reviewed the access to the site, parking, pedestrian path connection, landscaping, and elevations. The Planning and Zoning Commission considered the site plan at their July 5, 2022, meeting and voted 5- 0-0 to recommend approval. In response to a question from Council Member Stinneford, Mr. Warrix advised that the parking lots will be interconnected. Council Member Bynum motioned to approve Site Plan No. 22-03-SP, for a commercial development to be located in Glade Parks, Block A, Lot 5, east of Rio Grande Boulevard and approximately 180 feet north of Loving Trail. APPROVED SITE PLAN NO. 22-04-SP Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant is seeking approval for a 1.60-acre commercial development to be located in Glade Parks, Block A, Lot 6, east of Rio Grande Boulevard and approximately 445 feet north of Loving Trail, and intends to construct a 6,970 square foot retail building with a drive-thru restaurant. Mr. Warrix reviewed the access to the site, parking, pedestrian path connection, landscaping, and elevations. The Planning and Zoning Commission considered the site plan at their July 5, 2022, meeting and voted 5- 0-0 to recommend approval. Council Member Stinneford motioned to approve Site Plan No. 22-04-SP, for a commercial development to be located in Glade Parks, Block A, Lot 6, east of Rio Grande Boulevard and approximately 445 feet north of Loving Trail. ITEM NO. 17. APPROVED BOARD AND COMMISSION APPOINTMENTS Council Member Stinneford motioned to reappoint Mayor Pro Tem Eddie Price, Council Member Harry Zimmer, and Citizen Member Ron Shields to the Crime Control and Prevention District Board with terms to expire September 1, 2024. HELD A PUBLIC HEARING AND APPROVED CRIME CONTROL AND PREVENTION DISTRICT (CCPD) BUDGET FOR FY2022- 2023 Mayor Martin opened the public hearing at 8:00 p.m. Finance Director Janina Jewell presented a summary of the budget and advised the City Council that the proposed Euless Crime Control and Prevention District Budget for Fiscal Year 2022-2023 was approved by the Crime Control and Prevention District Board on June 16, 2022, following a public hearing. State law requires final approval by the City Council without amendment. Mayor Martin asked to hear from any proponents followed by opponents wishing to speak regarding the item. There being none, the public hearing was closed at 8:05 p.m. Mayor Pro Tern Price motioned to approve the Crime Control and Prevention District (CCPD) Budget for Fiscal Year 2022-2023. Council Member Paudel seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 19. HELD A PUBLIC HEARING FOR EULESS DEVELOPMENT CORPORATION (EDC) BUDGET FOR FY2022-2023 Mayor Martin opened the public hearing at 8:05 p.m. Finance Director Jewell presented the proposed budget to the City Council. She advised that the Euless Development Corporation (EDC) Board of Directors, at their August 8, 2022 meeting recommended approval of the proposed budget for Fiscal Year 2022-2023 with an additional $375,000 allocated from reserves to be applied toward the Wilshire Park improvements as the bids came in higher than anticipated. Mayor Martin asked to hear from any proponents followed by opponents wishing to speak regarding the item. There being none, the public hearing was closed at 8:11 p.m. ITEM NO. 20. HELD A PUBLIC HEARING FOR CITY OF EULESS FY2022-2023 OPERATING AND CAPITAL BUDGETS AND MOTIONED TO CONSIDER APPROVAL OF THE PROPOSED BUDGET ON AUGUST 22, 2022 Mayor Martin opened the public hearing at 8:11 p.m. Council Minutes Page 11 of 12 August 9, 2022 Finance Director Jewell presented details of the proposed City of Euless Operating and Capital Budgets for Fiscal Year 2022-2023. Mayor Martin asked to hear from any proponents followed by opponents wishing to speak regarding the item. There being none, Mayor Martin closed the public hearing at 8:25 p.m. Council Member Stinneford motioned to consider approval of the City of Euless Official Operating and Capital Budgets for Fiscal Year 2022-2023 proposed budget on August 22, 2022. Council Member Bynum seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 21. PUBLIC COMMENTS Salima Madhani, 900 Silverton Street, Southlake, Texas, representing the Shia Ismali Muslim Community, expressed appreciation to Mayor Martin and Mayor Pro Tern Price for attending the lunch and learn event and the Eagle Scout Award ceremony. She expressed her appreciation to City Secretary Sutter for helping the community connect and remain engaged with the City Council. She also announced the renewed pledge for the Boy Scouts of America by Mayor Pro Tern Price. ITEM NO. 22. REPORTS City Manager No report given. City Attorney No report given. City Council Mayor Martin announced the upcoming fundraiser for the Euless Library Foundation. "Murder in the Stacks" will be held September 25, 2022, at 5:30 p.m. in the Euless Library. Tickets for the event are $45.00, and will include membership into the Euless Library Foundation, dinner catered by Raven's Grill, and the evening's entertainment.
