WHEREAS, it has come to the attention of the Euless City Council
that an application has been made to the Texas Liquor Control Board by the
"Villa Club ", 800 W. Euless Blvd. in the City of Euless, Tarrant County, Texas,
for a private club registration permit under the provisions of Article 666- 15(e),
Penal Code of the State of Texas, and
WHEREAS, on Tuesday, September 8, 1964, at a regular Council
meeting of the Euless City Council, representatives of the "Fireside Inn" made
written application and appeared in person to petition the Euless City Council
for a certificate of occupancy to allow the operation of a private (bottle) club
to be located at Pipeline Road and State Highway 183 in the City of Euless,
Tarrant County, Texas, and
WHEREAS, Ordinance No. 33, enacted by the Euless City Council
on April 18, 1955, expressly prohibits the sale, storage, dispensing, consumption
and handling of liquor in the zoning classification sites of the proposed private
clubs "The Villa" and the "Fireside Inn", and
WHEREAS, the Euless City Council, on Tuesday, September 8, 1964,
voted to deny the certificate of occupancy to the "Fireside Inn" to commence
operations as a private (bottle) club because of the prohibition of the zoning
classification, and
WHEREAS, the Euless City Council was totally unaware of the in-
tention of the "Fireside Inn" to operate as a private club under the provisions
of Article 666- 15(e), Penal Code of the State of Texas, and
WHEREAS, on Tuesday, September 8, 1964, the Euless City
Council voted to enforce the provisions of Zoning Ordinance No. 33 of the
City of Euless which expressly prohibit the operation of private clubs at
the sites names in the permit applications to the State Liquor Control Board,
and
WHEREAS, the Euless City Council instructed the administrative
departmentsof the City of Euless, Tarrant County, Texas, to vigorously oppose
the establishment and operation of the "Villa Club", "Fireside Inn" and other
private clubs proposed for location in the zoning classification prohibiting the
operation of such clubs, and
WHEREAS, the Euless City Council by its action expressly and
vigorougly opposes the application by the "Villa Club" , 800 W. Euless. Blvd. ,
in the City of Euless, Texas, for a private club registration permit, and
WHEREAS, the proposed "Villa Club" site is located in an apart-
ment house and less than 200 feet from the only hospital located in the City of
Euless, Texas, and
WHEREAS, the Euless City Council does expressly by this resolution
oppose the "Villa Club" in its application for a private club permit as being an
immediate danger to the public health, welfare and community peace,
NOW, THEREFORE, be it RESOLVED by the Euless City Council
that the Texas Liquor Control Board at Austin be petitioned to deny the private
club application of the "Villa Club" because of the express violation of the
zoning ordinances of the City of Euless, Texas, such zoning : ordinances being
enacted and established to protect the public health, property and welfare
of the citizens of Euless.
