HomeMy WebLinkAbout64-77B 12-22-1964RESOLUTION NO. 77 b A RESOLUTION APPROVING AND ADOPTING ENGINEER'S ESTIMATE OF THE COST OF IMPROVING BYERS DRIVE BETWEEN DUCKETT AND FULLER; CANNON DRIVE BETWEEN HOLLYWOOD AND A POINT 220 FEET NORTH OF HOLLYWOOD DRIVE ON CANNON DRIVE; HIMES DRIVE BETWEEN A POINT 240 FEET NORTH OF FULLER STREET TO A POINT 130 FEET SOUTH OF LEE DRIVE; NORTH MAIN STREET FROM STATE HIGHWAY 183 TO DALLAS-HARWOOD ROAD; SOUTH MAIN STREET FROM STATE HIGHWAY 183 TO PIPELINE ROAD; RADER DRIVE FROM STATE HIGHWAY 183 TO PIPELINE ROAD; SIMMONS DRIVE TO STATE HIGHWAY 183 TO A POINT 470 FEET SOUTH OF STATE HIGHWAY 183 ON SIMMONS DRIVE; WRIGHT - RICHARDSON ROAD FROM STATE HIGHWAY 183 TO PIPELINE ROAD; CALLING A HEARING: DIRECTING ADVERTISEMENT AND MAILING OF NOTICE; AND DECLAR- ING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: Section 1: The attached City Engineer's Estimate of the cost of improving the following streets in the City of Euless, Tarrant County, Texas: Byers Drive between Duckett and Fuller; Cannon Drive between Hollywood and a point 220 feet north of Hollywood Drive on Cannon Drive; Himes Drive between a point 240 feet north of Fuller Street to a point 130 feet south of Lee Drive; North Main Street from State Highway 183 to Dallas- Harwood Road; South Main Street from State Highway 183 to Pipeline Road; Rader Drive from State Highway 183 to Pipeline Road; Simmons Drive to State Highway 183 to a point 470 feet south of State Highway 183 on Simmons Drive; Wright - Richardson Road from State Highway 183 to Pipeline Road; and the Engineer's Roll or Statement are approved and adopted, and it is found and determined that the estimated amounts of the several respective items of cost of such improvements are as shown thereon. All assessments, however, shall be made and levied by the City Council as it may deem just and equitable, having in view the special benefits in enhanced value to be received by such parcels of property and the owners thereof, the equities of such owners, and the adjustment of such assessments so as to produce a substantial equality of benefits received and burdens imposed. Section 2: On the 26th day of January , 19 65 , at 8:00 o'clock, P.M. , in the Council Chamber of the Municipal Building, 201 West Euless Blvd. , Euless, Texas, the governing body of such City will give a hearing to all owning abutting property, or any interest therein, on any matter constitutionally prerequisite to the validity of pro- posed assessments for such improvements, and to contest the amounts of the proposed assessments, the lien and liability thereof, the special bene- fits to the abutting property and owners thereof by means of the improvements for which assessments are to be levied, and the accuracy, sufficiency, regularity, and validity of the proceedings and contract in connection with such improvements and proposed assessments. Section 3: The City Secretary shall give notice of such hearing by advertise - ment inserted at least three times in some newspaper published in the City of Euless; the first publication to be made at least ten days before the date of the hearing. Section 4: Although not required by law, the City Secretary shall also mail notices of such hearing to the owners (or their agents or attorneys) of property in or abutting upon the portion of such street described in Section 1 above. Such notices shall be deposited in the Post Office at Euless, Texas, at least ten days before the date of the hearing. Provided, however, these proceedings shall not be invalidated by any failure of the City Secretary to mail such notices, or any failure of such owners (or their agents or attorneys) to receive them. Section 5: This Resolution shall be effective immediately upon adoption. 1964 ADOPTED THE 22nd DAY OF December AISa, at a regular meeting of the City Council of the City of Euless by a vote of 4 ayes and O nays.
