Surely the precaution the City is using to avoid difficult situations and treat a l l alike is above criticism and appreciative. But, I believe mine i s a peculiar and unusual situation i n which no one i s at fault. contracted for the curb, gutter and paving of the street in question before construction was started believing and having every good intention that the street improvement would be finished before house constructon was completed. As you know, the delay was occasioned by the weather at first followed by the Wisenbaker plat which proposed to change the course of the street which would serve travel better. I was not obligated to delay work on rry project to meet any requests of the City or other developers. My whole attitude in the matter has been to cooperate in the interests of a more beautiful city. It is not certain just when construction will begin on Ross Avenue, but since I have good and sufficient bond, if in the City's opinion, to grant n-e a certificate of occupancy would not . cause the City any embarrassment later, considering there is no intent to defraud, or refuse to f u I f i I I my promise to curb, gutter and pave, then I am very thankful for your consideration. Yours very truly, /s/ Ross Cannon
