HomeMy WebLinkAbout2022-08-16 P&Z MinutesCITY OF EULESS PLANNING AND ZONING COMMISSION AUGUST 16, 2022 MINUTES The pre -session meeting of the Planning and Zoning Commission was called to order by Chairman Steve Ellis at 5:45 p.m. on August 16, 2022, in the Pre -Session Conference Room of City Hall, 201 North Ector Drive. Those present included Chairman Steve Ellis, Vice Chairman LuAnn Portugal, and Commission Members: Curtis Brown, David Brown, Eric Owens and Ronald Dunckel. Commissioner Richard Barker was absent. During the Pre -Session Meeting: ➢ Senior Planner, Lisa Payne reviewed agenda items number two, number three and presented a brief Development Update. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The regular meeting of The Euless Planning and Zoning Commission was called to order by Chairman Steve Ellis at 6:30 p.m. in the Council Chambers at City Hall, 201 North Ector Drive. STAFF PRESENT: Don Sheffield, Assistant Director of Planning and Economic Development/Building Official Lisa Payne, Senior Planner Yvonne Garcia, Administrative Secretary Ken Rawlinson, Fire Marshal VISITORS PRESENT: Ryed Aloffe Kelly McCormick INVOCATION Commissioner D. Brown gave the invocation. THE PLEDGE OF ALLEGIANCE Commissioner Owens led the pledge of allegiance. ITEM 1. APPROVED PLANNING AND ZONING MINUTES Commissioner Owens made a motion to approve the minutes of the regular meeting of August 16, 2022. Commissioner Dunckel seconded the motion. The vote was as follows: Ayes: Vice Chairman Portugal and Commission Members: C. Brown, Owens, and Dunckel. (4-0-2) ITEM 2. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 22-08- SUP AND RECOMMENDED AN ORDINANCE Chairman Ellis opened the public hearing on Specific Use Permit Case No 22-08-SUP at 6:32 p.m. Senior Planner, Lisa Payne gave a brief description of the case. The applicant intends to operate as a motor vehicle dealer in his suite of an existing building at an industrial park on S. Airport Circle, which is east of S. Texas Star Pkwy., south of W. Euless Blvd., and north of S. Pipeline Rd. W. The applicant currently offers high -end detailing services, such as paint correction, buffing, waxing, shampooing carpets, leather treatment, etc., for his customers' cars, which is allowed by -right in the 1-2 district. No outdoor storage or display is proposed as the applicant will only keep cars for sale inside the building rather than in the parking lot. In addition, the detailing services are only performed inside. There will be no indication of an auto use at this location other than a permitted sign to advertise the business. The proposed use does not include major mechanical or body work, and the applicant anticipates two employees of the business. Staff recommends approval of the Specific Use Permit, with the following conditions: a. The Specific Use Permit is tied to the business owner, Ryed Aloffe; b. The Specific Use Permit is tied to the business name, Ryed Auto Sales; c. No outdoor advertising display other than a permitted sign indicating the name of the business; d. No outdoor storage or display of vehicles; e. No on -site major mechanical or auto body work, including painting, to be performed on vehicles; f. No more than five (5) gallons of fuel stored per vehicle (including fuel in the vehicle gas tank) and no more than thirty (30) gallons stored within the facility; and g. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Ryed Aloffe, the applicant introduced himself. Chairman Ellis asked to hear from any proponents/opponents who wished to speak. Seeing none, Chairman Ellis closed the public hearing at 6:37 p.m. Planning and Zoning Commission Minutes Page 3 of 4 August 16, 2022 Vice Chairman Portugal asked the applicant the amount of time they have been operating the business as a detailing service. Mr. Aloffe responded, that it has been one year. There were no further questions or comments presented by the Commission. Commissioner D. Brown made a motion to approve Case No. 22-08-SUP for a Specific Use Permit for Ryed Auto Sales to operate as a motor vehicle dealer in the Heavy Industrial (I- 2) zoning district located at Airport Business Park, Block 1, Lot 2R; 1118 S. Airport Circle, with the conditions as presented. Vice Chairman Portugal seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chairman Portugal and Commission Members: C. Brown, D. Brown, Dunckel, and Owens. Nays: None Abstention: None Chairman Ellis declared the motion carried. (6-0-0) ITEM 3. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 22-09- SUP AND RECOMMENDED AN ORDINANCE Chairman Ellis opened the public hearing on Specific Use Permit Case No 22-09-SUP at 6:38 p.m. Senior Planner, Lisa Payne gave a brief description of the case. The applicant intends to intends to continue operating a general automotive repair shop, but a new Specific Use Permit (SUP) to operate in the TX-10 district is required when there is an owner name change or business name change. In order to comply with Section 84-337 of the Code of Ordinances regarding open storage, all vehicle repair work will be performed inside the building and all outdoor storage will be screened on all sides by the existing fence. Continued maintenance of the fence to ensure screening will be required. Materials such as tires are required to be stored indoors to avoid the collection of rainwater. The applicant has no plans to make changes to the building or the property, and will keep the same hours of operation, which are Monday through Friday from 7:00 a.m. to 5:30 p.m. Staff recommends approval of the Specific Use Permit, with the following conditions: a. The Specific Use Permit is tied to the business name, GB Auto Service, Inc. dba Parra Car Care; b. The Specific Use Permit is tied to the business owner, David Scheve; c. All repair and service to vehicles will be conducted within the building. No work will be conducted exterior to the building; d. All vehicles, car parts, or merchandise shall be stored interior to the building so as to not allow the collection of rainwater, or shall be screened from public view by a solid fence; Planning and Zoning Commission Minutes Page 4 of 4 August 16, 2022 e. Fencing shall be maintained for the purpose of completely screening any outdoor storage of vehicles, car parts, or merchandise; and f. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Kelly McCormick, the district manager for this location introduced himself. Chairman Ellis asked to hear from any proponents/opponents who wished to speak. Seeing none, Chairman Ellis closed the public hearing at 6:41 p.m. Commissioner Owens asked the district manager if there are any plans to update any of the signage. Mr. McCormick responded not at this time. There were no further questions or comments presented by the Commission. Commissioner Dunckel made a motion to approve Case No. 22-09-SUP for a Specific Use Permit to continue operating a general automotive repair shop in the Texas Highway 10 Multi -use (TX-10) zoning district; 209 W Airport Freeway, with the conditions as presented. Commissioner Owens seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chairman Portugal and Commission Members: C. Brown, D. Brown, Dunckel, and Owens. Nays: None Abstention: None Chairman Ellis declared the motion carried. (6-0-0) ITEM 4. PUBLIC COMMENTS There were no public comments presented. ITEM 5.
