HomeMy WebLinkAbout2022-08-22MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Monday, August 22, 2022 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:30 p.m. on Monday, August 22, 2022, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tern Eddie Price, Council Members Tim Stinneford, Jeremy Tompkins, Perry Bynum, Harry Zimmer, and Tika Paudel. During the Precouncil meeting: ➢ Mayor Martin expressed her appreciation to those who attended the Hurst -Euless - Bedford Independent School District's collaboration meeting and recognized Council Member Bynum for his participation. ➢ City Manager Loretta Getchell advised of several upcoming events: • Happy early birthday to Council Member Paudel; • Low maintenance landscaping and irrigation class hosted by the Parks Department, September 15, 2022, 6:30 p.m., City Hall; and • Texas Star Golf Course will be closed August 23, 2022, due to flooding caused by the recent rains. ➢ City Manager Loretta Getchell reviewed the regular agenda Finance Director Janina Jewell introduced Jason Hughes, Manager Director, Hilltop Securities, and Chris Dvorak, Associate, Norton Rose Fulbright. Mr. Hughes reviewed the results of the bids received related to the issuance of the "City of Euless, Texas Tax Notes, Series 2022" (Item #10). Amegy Bank submitted the lowest rate at 2.890 percent, for a seven-year term, and callable anytime. The tax note sale is scheduled to close September 20, 2022. ➢ City Secretary Kim Sutter presented a Board and Commission Appointments update and advised that the reappointments are included on tonight's agenda. ➢ Library Director Sherry Knight presented a Library update and reviewed the programs and events that are offered at the library. Additionally, she presented upcoming events including October's special events, passive activities, monthly outreach events, and the Euless Library Foundation Annual Meeting and fundraiser event, Murder in the Stacks. She reminded the City Council that the library will be closed August 29, 2022, for staff training, and will offer limited library services October 1 and 2, 2022, in preparation of the integration of the new library software system that will go live October 3, 2022. Council Minutes Page 2 of 17 August 22, 2022 ➢ Director of Finance Jewell presented a Financial update and advised that sales tax collections for June was up 13.2 percent compared to last year and up 24 percent year to date. ITEM NO. 1. PRESENTATION OF EMPLOYEE OF THE MONTH Fire Chief Chanc Bennett recognized Firefighter II/Paramedic Michael Troth. Michael was accompanied by members of the Fire Department. Mayor Martin presented Michael with a plaque commemorating his selection as Employee of the Month for September 2022. ITEM NO. 2. PRESENTATION OF EMPLOYEE SERVICE PINS Police Chief Mike Brown introduced Emergency Management/Special Projects Assistant Ofa "Mary" Faiva-Siale. Ofa was accompanied by her husband Fatongia Siale, David and Cindy Eteaki, the Pomee Family (Ivan, Anna, Katea, Kien, and Feti), the Tavo Family (Leo, Delilah, Pakileata, Buba, Saimone, Hilingatoto, and Siosi), and members of the Police Department. Mayor Martin presented Ofa with a service pin commemorating her 20 years of service with the City. REGULAR AGENDA ITEM NO. 3. APPROVED REQUEST FOR A TEMPORARY USE PERMIT NO. 22-02-CC Director of Planning and Economic Development Michael Warrix presented the case to the City Council and advised that the applicant is requesting a Temporary Use Permit to operate a farmer's market on the southern portion of the Sapphire Banquet and Conference Center's parking lot at 1300 North Main Street. He presented the site layout and advised that indoor restroom facilities will be available. The market is proposed to be open Sundays from 10:00 a.m. to 4:00 p.m. beginning September 25, 2022, and ending November 20, 2022. In response to questions raised by Council Members Tompkins and Stinneford, Mr. Warrix advised that indoor restroom facilities will be available, and that no temporary restroom facilities will be used. He also advised that the applicant is advertising through social media. Mr. Warrix stated that the Temporary Use Permit is valid for 90 days and the City may revoke the permit if the applicant deviates from the approved uses. Council Member Stinneford motioned to approve Temporary Use Permit No. 22-02-CC for a farmer's market to be located on the southern portion of the Sapphire Banquet and Conference Center's parking lot, 1300 North Main Street. Council Member Paudel seconded the motion. APPROVED SITE PLAN NO. 22-05-SP Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant intends to construct an 860 square foot drive-thru restaurant with no dine -in option near the intersection of East Euless Boulevard and North Main Street. Mr. Warrix reviewed the site access, parking, pedestrian paths, landscaping, elevations, and exterior construction materials. The Planning and Zoning Commission considered the site plan at their July 19, 2022 meeting and voted 5-0-0 to recommend approval. Representatives for the applicant were present to address any questions. Council Member Bynum motioned to approve Site Plan No. 22-05-SP for a drive-thru restaurant to be located on 1.264 acres of land located in the Jones-Ladenberger Addition, Block A, a portion of Lot 2R, north of East Euless Boulevard, south of State Highway 183, and approximately 460 feet east of North Main Street. Mr. Warrix reviewed the site access, parking, pedestrian paths, landscaping, elevations, and exterior construction materials. The Planning and Zoning Commission considered the site plan at their July 19, 2022 meeting and voted 5-0-0 to recommend approval. Mayor Pro Tern Price motioned to approve Site Plan No. 22-06-SP for a drive-thru restaurant on 1.077 acres of land located in the Jones-Ladenberger Addition, Block A, a portion of Lot 2R, north of East Euless Boulevard, south of State Highway 183, and approximately 280 feet east of North Main Street. Council Member Tompkins seconded the motion. APPROVED SITE PLAN NO. 22-07-SP Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant intends to construct a 950 square foot drive-thru coffee shop with no dine -in option near the intersection of East Euless Boulevard and North Main Street. Mr. Warrix reviewed the site access, parking, pedestrian paths, landscaping, elevations, and exterior construction materials. The Planning and Zoning Commission considered the site plan at their July 19, 2022 meeting and voted 5-0-0 to recommend approval. A representative for the applicant was present to address any questions. Council Member Stinneford motioned to approve Site Plan No. 22-07-SP for a 950 square foot drive-thru coffee shop to be located on 0.885 acres of land in the Jones-Ladenberger Addition, Block A, a portion of Lot 2R, north of East Euless Boulevard, south of State Highway 183, and approximately 700 feet east of North Main Street. Council Member Bynum seconded the motion. ITEM NO. 7. HELD PUBLIC HEARING FOR SPECIFIC 05-SUP AND APPROVED FIRST AND ORDINANCE NO. 2312 Mayor Martin opened the public hearing at 7:26 p.m. USE PERMIT NO. 22- FINAL READING OF Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant is seeking a Specific Use Permit for a canine advance training and boarding facility to be located at 2800 South Pipeline Road West, Suite A. Services would include obedience and behavior classes, boarding, training, grooming, dog sports, dog daycare, and retail for the sale of training equipment and related products. Hours of operations would be from 6:00 a.m. to 9:00 p.m., Monday through Saturday, and 7:00 a.m. to 7:00 p.m. on Sunday. The Planning and Zoning Commission held a public hearing on July 5, 2022, and voted 5-0-0 to recommend approval of the Specific Use Permit with the following conditions: 1) The Specific Use Permit is tied to the business owner, Wendy Dek; 2) The Specific Use Permit is tied to the business name, Canine Advanced Training Services; and 3) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Wendy Dek, 3328 Lake Hill Lane, Hurst, Texas, was present to address any questions regarding the request. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:28 p.m. Council Member Paudel motioned to approve Ordinance No. 2312, authorizing the issuance of a Specific Use Permit for a canine training and boarding facility with outside runs in Light Industrial (1-1) zoning located at JW Lewellyn Addition, Block 1, Lot 2R1, 2800 South Pipeline Road West, Suite A. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 22- 07-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2313 Mayor Martin opened the public hearing at 7:29 p.m. Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant is seeking a Specific Use Permit for a mechanic shop for general automotive repair in an existing building on the southeast corner of West Euless Boulevard and Heather Drive. The Planning and Zoning Commission held a public hearing on July 19, 2022, and voted 5-0-0 to recommend approval of the Specific Use Permit with the following conditions: 1) The Specific Use Permit is tied to the business name, Euless Auto Shop; 2) The Specific Use Permit is tied to the business owner, Raad Alatabi; 3) The specific automotive services permitted by the Specific Use Permit are those identified on the amended application 22-07-SUP (Attachment "A"), dated June 23, 2022, and signed by the business owner and property owner; 4) All repair of vehicles will be conducted inside existing bays. No work is to be conducted exterior to the building; 5) All car parts stored on -site, whether new or used, shall be stored in a manner that is screened from public view from the right-of-way or shall be stored interior to the building. All tires shall be stored so as to not collect rainwater; 6) Outdoor storage of vehicles or merchandise is not permitted within the view of the public right-of-way; and 7) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Raad Alatabi, 7202 Fossil Creek Drive, Arlington, Texas, was present to address any questions regarding the request. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:32 p.m. Council Member Tompkins expressed his appreciation to Raad Alatabi for enhancing the landscape and painting the building. Council Member Tompkins motioned to approve Ordinance No. 2313, authorizing the issuance of a Specific Use Permit for Euless Auto Shop to perform general automotive repair in the Texas Highway 10 Multi -Use (TX-10) zoning district located at Cresthaven Addition, Block 1, Lot Al, 1511 West Euless Boulevard. Mayor Pro Tem Price seconded the motion. ITEM NO. 9. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2319 Police Chief Mike Brown presented the item to the City Council and advised that the ordinance will provide additional options to address street racing incidences and impose penalties for those participating in street racing including spectators and those that aid in the street racing exhibitions. Council Member Stinneford motioned to approve Ordinance No. 2319, amending Chapter 50, "Offenses", Article II, "Criminal Code" by adding a new Division 4, "Street Racing" to prohibit taking part in, spectating, and/or aiding in street racing exhibitions. Council Member Bynum seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 10. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2318 Finance Director Janina Jewell stated that the City's proposed Capital Improvement Plan includes the construction of a new Fire Station No. 2, including the purchase of necessary equipment. Based on the bids received, staff recommends the issuance of tax notes not to exceed $7,750,000 at a rate of 2.89 percent for a seven-year note to fund the construction and equipment for the new station. Council Member Stinneford motioned to approve the first and final reading of Ordinance No. 2318, authorizing the issuance of "CITY OF EULESS, TEXAS, TAX NOTES, SERIES 2022" in the approximate par amount of $7,7500,000 for the construction, improving, and equipping of one or more fire stations and for professional services related thereto and the financing thereof. Council Member Price seconded the motion. APPROVED EULESS DEVELOPMENT CORPORATION (EDC) BUDGET FOR FY2022-2023 Finance Director Jewell presented details of the proposed Euless Development Corporation (EDC) Budget for FY2022-2023. She advised that the Euless Development Corporation Board held a public hearing and approved the budget on August 8, 2022, and City Council held a public hearing on the proposed EDC budget on August 9, 2022. Council Member Tompkins motioned to approve the Euless Development Corporation (EDC) budget for FY2022-2023. Council Member Zimmer seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 12. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2314 ADOPTING THE CITY OF EULESS OFFICIAL OPERATING AND CAPITAL BUDGETS FOR FY2022-2023 Finance Director Jewell presented details of the proposed City of Euless Operating and Capital Budget for FY2022-2023, and the budget amendments to the fiscal year beginning October 1, 2021 and ending September 30, 2022. She advised that the proposed budget was provided to the City Council, posted on the City's website, filed in the office of the City Secretary, and made available at the City Library on July 22, 2022 and updated July 27, 2022. Darl Easton, 1005 Fayette Drive, Euless, Texas, requested clarification related to the differences in the beginning fund balances presented in the proposed budget compared to the ending fund balances included in the comprehensive audit document. City Manager Loretta Getchell advised that the discrepancy is due to the emergency contingency reserve and is noted on page 17 of the budget document. During the public comments portion of the meeting, Ms. Getchell referenced page 111 and noted that the balance sheet references a working capital and ties back to the budget document, and that for audit purposes there are adjustments that are made in accordance with generally accepted accounting principles. Ms. Getchell invited Mr. Easton to meet with her and discuss the budget further. Council Member Stinneford motioned to approve the first and final reading of Ordinance No. 2314, adopting the City of Euless Official Operating and Capital Budget for FY2022- 2023, and amending the budget for the fiscal year beginning October 1, 2021 and ending September 30, 2022. RATIFIED THE PROPERTY TAX INCREASE REFLECTED IN THE FY2022-2023 BUDGET Finance Director Jewell advised that a separate vote to ratify increased property tax revenue in the proposed budget is required by state law. The proposed tax rate for FY2022-2023 is $0.46 per $100 of assessed value, and represents a decrease of 1.5 cents from the prior fiscal year. Council Member Stinneford motioned to ratify the property tax revenue increase reflected in the Fiscal Year 2022-2023 budget. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 14. HELD PUBLIC HEARING FOR PROPOSED AD VALOREM TAX RATE Mayor Martin opened the public hearing at 7:46 p.m. Mayor Martin asked to hear from any proponents followed by opponents wishing to speak regarding the proposed tax rate. There being none, Mayor Martin closed the public hearing at 7:47 p.m. ITEM NO. 15. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2315 Council Member Stinneford motioned that the property tax rate be increased by the adoption of a tax rate of $0.46 per $100 of assessed value, which is effectively a 6.23% increase in the tax rate, by adoption of Ordinance Number 2315. ITEM NO. 16. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2316 Finance Director Jewell advised that Ordinance No. 2316 adopts the tax roll from the Tarrant Appraisal District. Council Member Bynum motioned to approve the first and final reading of Ordinance No. 2316, adopting the Tax Roll for Tax Year 2022. Council Member Paudel seconded the motion. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2317 Finance Director Jewell presented the item to City Council and advised that Ordinance No. 2317 updates various water fees and miscellaneous charges; amends the fees charged for monthly services, reclaimed water services, construction and gas well meter services, and wastewater service. The fee changes would become effective on bills dated on or after November 1, 2022. Council Member Tompkins motioned to approve the first and final reading of Ordinance No. 2317, amending Chapter 30, "Fees", Section 30-35, 'Water and Wastewater Service - Monthly Rates", and Section 30-37, "Monitored Group Class". Council Member Bynum seconded the motion. Owners of real property located near the intersection of State Highway 121 (SH121) and Cheek Sparger Road delivered to the City of Euless a petition to establish the Glade Parks Public Improvement District Number One (PID #1), which the City Council created December 14, 2010, by Resolution No. 10-1350. She stated that no assessment is necessary for fiscal year 2022-2023. Council Member Bynum motioned to approve the first and final reading of Ordinance No. 2309, adopting Fiscal Year 2022-2023 Service and Assessment Plan for the Glade Parks Public Improvement District Number One (PID #1). APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2310 Finance Director Jewell presented the item to City Council and advised that Chapter 372 of the Texas Local Government Code allows for the creation of public improvement districts. Owners of real property located near the intersection of State Highway 121 (SH121) and Cheek Sparger Road delivered to the City of Euless a petition to establish the Glade Parks Public Improvement District Number Two (PID #2), which the City Council created June 9, 2015, by Resolution No. 15-1461. She stated that no assessments are needed for fiscal year 2022-2023. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2311 Finance Director Jewell presented the item to City Council and advised that Chapter 372 of the Texas Local Government Code allows for the creating of public improvement districts. Owners of real property located near Farm to Market Road 157 (FM 157), State Highway 10 (SH 10), and State Highway 183 (SH 183) delivered to the City of Euless a petition to establish the Euless Midtown Public Improvement District, which the City Council created August 25, 2015, by Resolution No. 15-1471. She stated that a $322,463 assessment is necessary for fiscal year 2022-2023. Council Member Stinneford motioned to approve the first and final reading of Ordinance No. 2311, adopting Fiscal Year 2022-2023 Service and Assessment Plan for the Euless Midtown Public Improvement District (PID). Mayor Pro Tern Price seconded the motion. APPROVED PURCHASE OF TWO HALF -TON PICKUP TRUCKS Authorized the purchase of two half -ton pickup trucks from Chastang Ford, 6200 North Loop East, Houston, Texas, through the BuyBoard contract. APPROVED PURCHASE OF TWO MID -SIZE HYBRID PICKUP TRUCKS Authorized the purchase of two mid -size hybrid pickup trucks from Rockdale Country Ford, 479 West Highway 79, Rockdale, Texas, through the Tarrant County Contract. APPROVED PURCHASE OF FIVE POLICE PATROL VEHICLES Authorized the purchase of five mid -size Police Patrol vehicles from Rockdale Country Ford, 479 West Highway 79, Rockdale, Texas, through the Tarrant County Contract. APPROVED RESOLUTION NO. 22-1626 Authorized the City Manager to execute an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) for roadway and ADA improvements at the intersection of Mid -Cities Boulevard/Cheek Sparger Road and State Highway 121 (SH 121). ITEM NO. 27. AUTHORIZED CITY MANAGER TO NEGOTIATE AND EXECUTE AN ARCHITECTURAL SERVICES CONTRACT Authorized the City Manager to negotiate and execute an Architectural Services Contract with Oxley Williams Tharp Architects, 509 Pecan Street, Fort Worth, Texas, for the design and construction of the new Fire Station No. 2. The estimated expenditure is $525,000. ITEM NO. 28. AUTHORIZED CITY MANAGER TO NEGOTIATE AND EXECUTE AN ARCHITECTURAL SERVICES CONTRACT Authorized the City Manager to negotiate and execute and Architectural Services Contract with Oxley Williams Tharp Architects, 509 Pecan Street, Forth Worth, Texas, for the design, remodeling, and construction of the existing Police and Courts Building. REPORTS City Manager City Manager Getchell expressed her appreciation to Finance Director Jewell and her finance team for all the dedication and hard work in preparing the proposed budget. City Attorney No report given. City Council Council Member Stinneford advised that state law dictates the language that must be included in the motion to adopt a tax rate. Although the language included in the motion to adopt the FY2022-2023 tax rate indicates a 6.23 percent increase to the tax rate, the FY2022-2023 adopted tax rate is 1.5 cents lower than the 2021 tax rate. Council Member Tompkins expressed his appreciation to the City staff involved in the preparation of tonight's lengthy agenda. Mayor Martin announced the Euless Library Foundation fundraiser, "Murder in the Stacks", to be held September 25, 2022. "Murder in the Stacks" is an interactive murder mystery event beginning at 5:30 p.m. in the Euless Library. Tickets are $45 per person and includes membership into the foundation, dinner, and participation in the mystery event. Council Minutes Page 17 of 17 ITEM NO. 33.
