HomeMy WebLinkAbout2022-09-13MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, September 13, 2022 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:31 p.m. on Tuesday, September 13, 2022, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tern Eddie Price, Council Members Tim Stinneford, Jeremy Tompkins, Perry Bynum, Harry Zimmer, and Tika Paudel. During the Precouncil meeting: ➢ Council Member Paudel advised of recent thefts of gasoline in the City of Grand Prairie and inquired if the City of Euless had any reports of these types of incidents. Police Chief Mike Brown advised that there have been no incidents in Euless. ➢ Mayor Martin expressed appreciation to Mayor Pro Tem Price and Council Member Tompkins for agreeing to represent Euless at two events to be held Saturday, September 16, 2022. Mayor Pro Tern Price will participate in a cupcake eating contest at the YMCA Strengthening event and compete against the Mayor Pro Terns of Hurst and Bedford. Council Member Tompkins will participate in the Annual Grapefest Mayoral GrapeStomp. Additionally, she recognized Fire Chief Chanc Bennett and Police Chief Mike Brown for hosting a beautiful and touching 9/11 ceremony. ➢ City Secretary Kim Sutter advised that the Community Waste Disposal Driver Appreciation luncheon will be held at Saviano's Italian Kitchen, Tuesday, September 27, 2022, 11:30 a.m. ➢ City Manager Loretta Getchell advised the City Council that the new audio-visual system for the senior center approved in the FY 2023 budget will be installed as soon as possible. She also announced that Major Jones will serve as the Director of Public Works and Engineering upon the retirement of Hal Cranor, and Joe Villa will join the staff as the Assistant Director. ➢ Fire Chief Chanc Bennett announced that members of the Fire Department participated in the Riversport 2022 Swiftwater Conference and Championship Games held in Oklahoma City and the Euless team competed and has been named the National Champions. Members of the team included Michael Hanks, Ashley Watson, Josh Schnitzius, and Irving Alvarado. He recognized and expressed his appreciation to Council Member Tompkins for attending the event. ➢ City Manager Loretta Getchell advised of several upcoming events: • Director of Public Works and Engineering Hal Cranor Retirement Reception, Friday, September 16, 2022, Public Works Building, 3 p.m. Council Minutes Page 2 of 9 September 13, 2022 • Low Maintenance Landscaping and Irrigation Event, Thursday, September 15, 2022, City Hall, 6:30 p.m. • Euless Quarter Century Employee Dinner, Friday, September 23, 2022, Texas Star, 6:30 p.m. to 8:30 p.m. • Hurst -Euless -Bedford Chamber Annual Event — Honky Tonk HEB, Saturday, September 24, 2022, Hurst Conference Center, 6:00 p.m. to 9:30 p.m. • Euless Library Foundation Fundraiser — "Murder in the Stacks", Sunday, September 25, 2022, Euless Library, 5:30 p.m. to 8:00 p.m. • Williamson Memorial Golf Tournament, Wednesday, September 28, 2022, 8:00 a.m. • Recognized Rosyln Moore, retired City employee, for providing tonight's dessert. ➢ City Manager Loretta Getchell reviewed the regular agenda. ➢ Deputy City Manager Chris Barker introduced Matthew Jalbert, Executive Manager, Northern Region, Trinity River Authority (TRA); Kim Probasco, Financial Administrator, Northern Region, TRA; and John Bennett, Deputy Executive Manager, Northern Region, TRA to address the City Council regarding the TRA Bond issuance. Mr. Jalbert provided an overview of the proposed FY2023 bond sale for a $33 million Tarrant County Water Supply Project to fund phase 1 of the raw water transmission improvements. Additionally, Mr. Jalbert reviewed the proposed TRA five-year capital improvement plan funding encumbrance schedule. ➢ Deputy City Manager Barker presented an Atmos Rate Review Mechanism (RRM) update. He advised that an Ordinance will be presented for consideration at the next meeting to accept the negotiated settlement tariffs. ➢ Director of Planning and Economic Development Michael Warrix presented a Development update which included the status of various commercial developments. ➢ Director of Finance Janina Jewell presented a Financial update and advised that sales tax collections for July was up nine percent compared to last year and up 19.4 percent year to date. Additionally, she reported that car rental tax collections were up six percent over the same period in the prior year and up 53 percent year to date. ➢ Deputy City Manager Barker presented a Capital Projects update including the status of the water well projects and the fiscal year 2019 street improvement projects. ➢ Deputy City Manager Barker presented the Transportation update and advised that in light of the most recent accidents on State Highway 10 at West Pipeline Road, a request has been made to the Texas Department of Transportation (TXDOT) for consideration to expedite the Euless portion of the State Highway 10 improvements project. Council Minutes Page 3 of 9 September 13, 2022 CLOSED SESSION The City Council convened into closed session at 6:29 p.m. for deliberation regarding the following: Seek legal advice and consult with the City Attorney as authorized by Section 551.071 of the Texas Government Code regarding any of the matters listed on the agenda and to seek legal advice related to pending or contemplated litigation or a settlement offer, including: • Batiste v. PLEDGES OF ALLEGIANCE Mayor Linda Martin led the pledge of allegiance to the flags of the United States and Texas. ITEM NO. 1. PRESENTATION OF EMPLOYEE SERVICE PINS City Manager Loretta Getchell introduced Director of Finance Janina Jewell. Janina was accompanied by members of the Finance Department. Mayor Martin presented Janina with a service pin commemorating her 15 years of service with the City. CONSENT AGENDA (items 2 through 9) Mayor Martin asked Deputy City Manager Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 2 through 9. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members. Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 2. AUTHORIZED CITY MANAGER TO EXECUTE A CONTRACT Authorized the City Manager to execute a contract with Tyler Technologies, 5101 Tennyson Parkway, Plano, Texas, for the purchase and maintenance of INCODE Court Case Software through the Texas Department of Information Resources contracting agency as approved in the FY2023 budget. The estimated expenditure is $149,701, ITEM NO. 3. AUTHORIZED CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE CITY OF GRAPEVINE Authorized the City Manager to execute an interlocal agreement with the City of Grapevine for an emergency water interconnection to facilitate the availability of additional water in order to meet potential emergency system demands. AUTHORIZED PURCHASE OF FOUR (4) SCOREBOARDS Authorized the purchase of four scoreboards for The Parks at Texas Star from Olen Williams Inc., 1123 South Airport Circle, Euless, Texas, through the BuyBoard Purchasing Cooperative as approved in the FY2023 budget. The estimated expenditure is $74,000. ITEM NO. 5. AUTHORIZED PURCHASE OF FITNESS EQUIPMENT Authorized the purchase of fitness equipment for the Euless Family Life Center from Comm Fit, 4651 Sunbelt Drive, Addison, Texas, through the BuyBoard Purchasing Cooperative as approved in the FY2023 budget. The estimated expenditure is $59,028.05, ITEM NO. 6. AUTHORIZED PURCHASE OF PLAYGROUND EQUIPMENT Authorized the purchase and installation of playground equipment for McCormick Park from Playground Boss, 5900 South Lake Forest Drive, Suite 375, McKinney, Texas, through The Interlocal Purchasing System purchasing cooperative as approved in the FY2023 budget. The estimated expenditure is $93,678. ITEM NO. 7. AUTHORIZED PURCHASE OF AUTOMATIC COMPRESSION SYSTEMS Authorized the purchase of three (3) Lucas automatic compression systems from Physio- Control, 11811 Willows Road Northeast, Redmond, Washington, for Fire/EMS services as approved in the FY2023 budget. This purchase is for the replacement of the current Lucas devices which were purchased in 2015. The estimated expenditure is $75,000. ITEM NO. 8. APPROVED RESOLUTION NO. 22-1627 Approved Resolution No. 22-1627, declaring the determination not to update water and wastewater impact fees, land use assumptions and capital improvement plan. Chapter 395 of the Texas Local Government Code mandates that impact fees be reviewed every five (5) years and either update or, in the event that the governing body determines that no change to the land use assumptions, capital improvements plan or impact fee is needed, continued without change. City staff along with Birkhoff, Hendricks & Carter L.L.P., 11910 Greenville Avenue, Dallas, Texas, have completed a review of the Impact Fee Study and have concluded that no changes or updates are required at this time: ITEM NO. 9. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the precouncil and regular meeting of August 22, 2022. Council Minutes Page 6 of 9 September 13, 2022 REGULAR AGENDA ITEM NO. 10. APPROVED A REQUEST FOR A TEMPORARY USE PERMIT NO. 22-06-CC Director of Planning and Economic Development Michael Warrix advised that St. John the Baptist Greek Orthodox Church is seeking a Temporary Use Permit to host its' 30tn Annual Mid -Cities Greek FoodFest on the church grounds. Mr. Warrix reviewed the festival layout and parking arrangements. Council Member Paudel motioned to approve Temporary Use Permit No. 22-06-CC, for a Greek Food Festival to be located on Alexander and Cullum Subdivision, Lot 6R and Lot 7R, 303 Cullum Drive, for four consecutive days, beginning on October 13, 2022 and concluding on October 16, 2022. Mayor Pro Tern Price seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 11. APPROVED SITE PLAN NO. 22-08-SP Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant is seeking approval for a 7.46-acre commercial development to be located on the northwest corner of Rio Grande Boulevard and Brazos Boulevard in Glade Parks, and intends to construct an 85,250 square foot retail building. Mr. Warrix reviewed the access to the site, parking, pedestrian paths, landscaping, building elevations, and building materials. The Planning and Zoning Commission considered the site plan at their regular meeting on September 6, 2022, and voted 7-0-0 to recommend approval. Council Member Tompkins motioned to approve Site Plan No. 22-08-SP, for a 7.46-acre commercial development to be located on J. Doss Survey, A-441, Tracts 6A1, 6B1A1, 6B1G, 6B1G1, and 6G, 2301 Rio Grande Boulevard. Council Member Bynum seconded the motion. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 22- 08-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2320 Mayor Martin opened the public hearing at 7:16 p.m. Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant is seeking a Specific Use Permit for a motor vehicle dealer to be located at 1118 South Airport Circle, Suite 150. The applicant currently operates an automotive services business at the subject property providing high -end detailing services and is intending to expand the business to include sales of luxury automobiles. Mr. Warrix reviewed the conditions of the Specific Use Permit and stated that detailing services will be performed inside the existing building. The Planning and Zoning Commission held a public hearing on August 16, 2022, and voted 6-0-0 to recommend approval of the Specific Use Permit with the following conditions: 1) The Specific Use Permit is tied to the business owner, Ryed Aloffe; 2) The Specific Use Permit is tied to the business name, Ryed Auto Sales; 3) No outdoor advertising display other than one (1) permitted wall sign identifying the name of the business; 4) No outdoor storage or display of vehicles; 5) No on -site major mechanical or auto body work, including painting, to be performed on vehicles; 6) No more than five (5) gallons of fuel stored per vehicle (including fuel in the vehicle gas tank) and no more than thirty (30) gallons stored within the facility; and 7) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Ryed Aloffe, applicant and business owner of Ryed Auto Sales, 608 Setting Sun Lane, Arlington, Texas, addressed the City Council regarding the case. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:19 p.m. Council Member Paudel motioned to approve Ordinance No. 2320, for a Specific Use Permit for a motor vehicle dealer to be located in the Airport Business Park, Block 1, Lot 2R, 1118 South Airport Circle, Suite 150 in a Heavy Industrial (1-2) zoning district. Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 22- 09-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2321 Mayor Martin opened the public hearing at 7:20 p.m. Director of Planning and Economic Development Warrix presented the item to the City Council and advised that the applicant is acquiring the Parra Car Care located at 209 West Airport Freeway and is seeking a new Specific Use Permit to reflect the ownership and business name change. The Planning and Zoning Commission held a public hearing on August 16, 2022, and voted 6-0-0 to recommend approval of the Specific Use Permit with the following conditions: 1) The Specific Use Permit is tied to the business name, GB Auto Service, Inc. dba Parra Car Care; 2) The Specific Use Permit is tied to the business owner, David Scheve; 3) All repair and service to vehicles will be conducted within the building. No work will be conducted exterior to the building; 4) All vehicles, car parts, or merchandise shall be stored interior to the building so as to not allow the collection of rainwater, or shall be screened from public view by a solid fence; 5) Fencing shall be maintained for the purpose of completely screening any outdoor storage of vehicles, car parts, or merchandise; and 6) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin asked to hear from any proponents followed by opponents of the case. There being none, Mayor Martin closed the public hearing at 7:23 p.m. Mayor Pro Tem Price motioned to approve Ordinance No. 2321, for a Specific Use Permit for a general automotive repair shop to be located in the Casa Bonita Addition, Block 1, Lot 2, 209 West Airport Freeway in the Texas Highway 10 Multi -Use (TX-10) zoning district. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, Zimmer, and Paudel Nays: None Mayor Martin declared the motion carried. PUBLIC COMMENTS Lee Ann Folau, 800 Henslee Drive, Euless, Texas, addressed the City Council regarding a request for directional signage for the traffic traveling on North Main Street over State Highway 183. ITEM NO. 15. REPORTS City Manager No report given. City Attorney No report given. City Council Mayor Martin announced the retirement of Hal Cranor, Director of Public Works and Engineering and stated that he will be missed. Mayor Martin recognized City Manager Getchell for her 25 years of service with the City and presented her with a pin and clock commemorating her service. Mayor Martin announced the Euless Library Foundation fundraiser, "Murder in the Stacks", to be held September 25, 2022, 5:30 p.m. Tickets are $45 per person and includes membership into the foundation, dinner, and participation in the mystery event.
