WHEREAS, on September 3, 1965, the City of Euless purchased from
Municipal Service Company all its water and sewer systems, plants and
facilities located in the City of Euless and Town of Bedford, and surrounding
areas, and
WHEREAS, the City of Euless did simultaneously with the acquisition
of such water and sewer systems offer by letter to sell to the Town of Bedford
that portion of such water and sewer systems and appurtenances required by
Bedford to meet the needs of its citizens at a price equal to the cost thereof
to the City of Euless plus subsequent system improvements and reasonable
separation costs, and
WHEREAS, those portions of the water and sewer systems actually
located within the corporate limits of the Town of Bedford do not constitute
complete systems if separated from the systems located within the corporate
limits of the City of Euless, there being obvious engineering, technical and
financial problems involved on the part of both cities in a separation of the
two systems between the said two cities, and
WHEREAS, on February 22, 1966, the Honorable Bedford Mayor, Mr.
E. Z. Jernigan, and City Attorney, Mr. Shirley Peters, visited personally in
the home of W. G. Fuller, Mayor of the City of Euless, to inform Euless for
the first time that Bedford desired to purchase a portion of the water and
sewer systems located in the Town of Bedford, and
WHEREAS, by letter to the Town of Bedford dated February 24, 1966,
the City of Euless pointed out that it did not know what portions of the water
and sewer systems Bedford desired to purchase, and in such letter requested
that Bedford submit a resume of Bedford's needs and desires regarding possible
separation of the two systems between the two cities, and
WHEREAS, the Town of Bedford has, by Resolution dated February 26,
1966, and received by W. G. Fuller, Mayor of the City of Euless on March 1,
1966, officially petitioned the City of Euless to submit to the Town of Bedford
on Monday, March 7, 1966, the terms of sale of that portion of the water and
sewer systems located within the corporate limits of the Town of Bedford, and
WHEREAS, there have been no preliminary discussions by representa-
tives of Bedford and Euless in an attempt to define and achieve an understanding
of the complicated and technical problems involved in the separation of that
portion of the water and sewer systems desired by the Town of Bedford, and
WHEREAS, it appears both reasonable and necessary that some pre-
liminary discussion be had by representatives of the two cities regarding
separation of the two systems so as to protect the citizens of the Town of
Bedford and the City of Euless, and
WHEREAS, the City of Euless desires to cooperate in an orderly manner
with the Town of Bedford in assisting it in every way possible in purchasing
at cost and separating that portion of such systems located in Bedford as may
be required by the citizens of Bedford,
NOW, THEREFORE, BE IT RESOLVED BY THE EULESS CITY COUNCIL
that its Mayor, a representative of its consulting engineers, a representative
of its financial advisors, its City Manager and its City Attorney are hereby
directed to meet with representatives of the Town of Bedford at 10:00 a.m.,
Thursday, March 10, 1966, at Western Hills Inn on Highway 183, or at such
other place, tine and date as may be requested by the Town of Bedford, to
discuss the complicated and technical problems inherent in the sale and
separation of the two systems as between the Town of Bedford and the City
of Euless, and
BE IT FURTHER RESOLVED that such representatives of the City of
Euless are directed and instructed to cooperate fully with the representatives
of the Town of Bedford in seeking a harmoneous understanding and agreement
regarding separation of the two systems as between the said two cities.
ADOPTED this 4th day of March, 1966, at a called session of
the Euless City Council by the unanimous vote of those council members
present.
