RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF
EULESS, TEXAS TO APPROVE CONSTRUCTION CONTRACT
FOR EXTENSIONS TO THE MUNICIPALLY OWNED WATER
AND /OR SEWER SYSTEM FOR THE Greenhills Park
SUBDIVISION WITHIN THE CORPORATE LIMITS OF
Euless , TEXAS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
That the terms and provisions of that certain construction contract
dated the 28th day of January
19 66 relative to the construc-
tion of water and sewer improvements, ip Greenhills Park Addition, Third
Installment, of Euless, Texas
having been reviewed by the Engineer for the City of Euless, said contract being
by and between Janann, Inc.
as Developer, and Cowart Construction Company
as Contractor such contract is hereby approved and the Mayor of the City of
Euless is hereby authorized to execute such instruments as may be necessary for
and on behalf of the City of Euless to endorse its approval thereon and the City
Secretary is authorized and directed to attest the same and to place the cor-
porate seal of the City thereon.

CITY - DEVELOPER AGREEMENT
THE STATE OF TEXAS
COUNTY OF ?MOM
KNOW ALL MEN BY THESE PRESENTS:
That Jam,,
VIM a Corporation organized under the
laws of Texas
of the County of Tarrant
State of Texas , hereinafter called Developer, and the
City of Euless, Tarrant County, Texas, hereinafter called City, enter

into the following. contract:
In consideration of the mutual covenants herein contained the
parties agree:
1. Developer agrees to construct water and sewer improvements
for the Third Increment
increment of the Green Hills
Park addition in accordance with the record plat duly
approved by the City of Mules as filed of record in Vol . 388.39
Page 63 , Deed Records of Tarrant County, Texas.
2. In compliance with requirements of the City, the Developer will
do the following at his own expense:
I. File with the City and secure City approval of complete
construction Contract Documents for the proposed water and
sewer extensions prior to commencing construction; which
Documents shall include:
A. Developer- Contractor Agreement, performance,
Maintenance and Payment Bond.
B. Written Special Provisions to clarify and adapt Standards
to the particular job.

C. Plan profiles to 1" = 100' horizontal and 1 " =10' or
1 " =5' vertical.
D. Details of all structures and special appurtenances.
II. Have all construction done under a single general contract
with full responsibility for all phases of the work resting upon.
the one Contractor; which Contractor shall post a maintenance bond
equal in amount to 10% of the cost of the work covering the work
a period of two (2) years from the date of completion as
established by Acceptance by the City. Such Contract and Bond
shall be executed on the forms furnished by the City.
III. Require the Contractor to notify the City's Inspector when
the work is in progress & not proceed with any succeeding phase
of the work until the City's Inspector has given approval of the
work inspected. Such inspections shall be required during the
laying of all water and sewer lines and appurtenances.
IV. Abide by the conditions of the City's Standard Developer -
Contractor Agreement which provides that no payments shall be
made to the Contractor for any work performed until that portion
of the work has been approved by the City.
V. The City will provide the inspections as required and upon
satisfactory completion of the work the City will accept
ownership and operation of the system.
VI. Upon completion of the work the Developer will deliver
good and sufficient title to all facilities constructed
warranted free of any liens or encumberances.

this Contract in five (5) counterparts, each of which shall be deemed
