HomeMy WebLinkAbout2022-11-01 P&Z MinutesCITY OF EULESS PLANNING AND ZONING COMMISSION NOVEMBER 1, 2022 MINUTES The pre -session meeting of the Planning and Zoning Commission was called to order by Chairman Steve Ellis at 6:00 p.m. in the Pre -Session Conference Room of City Hall, 201 North Ector Drive. Those present included Chairman Steve Ellis, Vice Chairman LuAnn Portugal, and Commission Members: Richard Barker and Ronald Dunckel. Commissioners, Curtis Brown, David Brown and Eric Owens were absent. During the Pre -Session Meeting: ➢ Senior Planner, Lisa Payne reviewed agenda items numbers two, three, four, and presented a brief Development Update. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The regular meeting of The Euless Planning and Zoning Commission was called to order by Chairman Steve Ellis at 6:31 p.m. in the Council Chambers at City Hall, 201 North Ector Drive. STAFF PRESENT: Michael Warrix, Director of Planning and Economic Development Lisa Payne, Senior Planner Yvonne Garcia, Administrative Secretary Curtis Drew Washington, Fire Marshal VISITORS PRESENT: None INVOCATION Commissioner Dunckel gave the invocation. THE PLEDGE OF ALLEGIANCE Commissioner Barker led the pledge of allegiance. ITEM 1. APPROVED PLANNING AND ZONING MINUTES Vice Chairman Portugal made a motion to approve the minutes of the regular meeting of October 18, 2022. Commissioner Barker seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chairman Portugal and Commissioner Barker. RECOMMENDED APPROVAL OF SITE PLAN CASE NO 22-09-SP Senior Planner, Lisa Payne gave a brief description of the case. The applicant intends to construct a commercial building containing tenant spaces and a Captain D's drive-thru restaurant. The site layout includes one drive-thru lane around the south and east sides of the building, and public entrances on the north side of the building. The Development Services Group has reviewed the site plan and has certified that it meets City standards. Vice Chairman Portugal requested confirmation on existing vehicular entrances to the property. Payne replied that three exist. There were no further questions or comments presented by the Commission. Commissioner Dunckel made a motion to approve Case No. 22-09-SP for a Site Plan for a commercial building containing tenant spaces and a drive-thru restaurant on 0.794 acres of land located on the southeast corner of Highway 183 and Byers Street. Commissioner Barker seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chairman Portugal and Commission Members: Barker and Dunckel. Nays: None Abstention: None Chairman Ellis declared the motion carried. (4-0-0) ITEM 3. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 22-10- SUP AND RECOMMENDED AN ORDINANCE Chairman Ellis opened the public hearing on Specific Use Permit Case No 22-10-SUP at 6:37 p.m. Senior Planner, Lisa Payne gave a brief description of the case. The applicant intends to operate a mechanic shop for general automotive repair in an existing building on the southwest corner of W. Euless Blvd. and Martha St. Such a use is only permitted in the Texas Highway 10 Multi -use (TX-10) zoning district with the approval of a Specific Use Permit (SUP). In order to comply with Section 84-337 of the Code of Ordinances regarding open storage, all vehicle repair work will be performed inside the building. No outdoor storage is proposed. The existing building is approximately 6,559 square feet in area, but the applicant is only Planning and Zoning Commission Minutes Page 3 of 5 November 1, 2022 going to use 3,475 square feet and leave the remaining area for other commercial tenants. Assuming the use with the highest parking requirement, which is restaurant, fills the remaining tenant suite in the building, and together with the proposed general repair use, the property still exceeds the minimum parking requirement with 43 parking spaces that don't block bay doors. The applicant anticipates 7-8 employees and being open to the public Monday through Friday from 8:00 AM to 7:00 PM, Saturday from 8:00 AM to 5:00 PM, and closed on Sundays. Staff recommends approval of the Specific Use Permit, with the following conditions: a. The Specific Use Permit is tied to the business name, ATL Total Car Care; b. The Specific Use Permit is tied to the business owner, Ed Markwardt; c. The specific automotive services permitted by the Specific Use Permit are those identified on the attached amended application 22-10-SUP (Attachment "A"); d. All repair of vehicles shall be conducted inside existing bays. No work is to be conducted exterior to the building; e. All car parts, including tires, stored on -site, whether new or used, shall be stored interior to the building; f. Outdoor storage of vehicles or merchandise is prohibited; and g. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Chairman Ellis asked to hear from any proponents/opponents who wished to speak. Seeing none, Chairman Ellis closed the public hearing at 6:41 p.m. Commissioner Dunckel asked what was classified as general repair. Payne responded, that the list of services is in Attachment "A", and does not include engine work, transmission work, or body work. Vehicles are never intended to stay overnight but in the event a part needs to be ordered, the vehicle will be stored in a bay. There were no further questions or comments presented by the Commission. Commissioner Barker made a motion to approve Case No. 22-10-SUP for a Specific Use Permit for ATL Total Car Care to perform general automotive repair at 301 West Euless Boulevard in the Texas Highway 10 Multi -use (TX-10) zoning district and with the conditions as presented. Vice Chairman Portugal seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chairman Portugal and Commission Members: Barker and Dunckel. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 22-11- SUP AND RECOMMENDED AN ORDINANCE Chairman Ellis opened the public hearing on Specific Use Permit Case No 22-11-SUP at 6:43 p.m. Senior Planner, Lisa Payne gave a brief description of the case. The applicant intends to operate as a motor vehicle dealer in his 3,600 square foot suite of an existing building at an industrial park on S. Airport Circle, which is east of S. Texas Star Pkwy., south of W. Euless Blvd., and north of S. Pipeline Rd. W. This use is only permitted in the Heavy Industrial (1-2) zoning district with the approval of a Specific Use Permit (SUP). The applicant currently offers auto repair, which is allowed by -right in the 1-2 district. No outdoor storage or display is proposed as the applicant will only keep cars for sale inside the building rather than in the parking lot.. In addition, the repair services are only performed inside. There will be no indication of an auto use at this location other than a permitted sign to advertise the business. Staff recommends approval of the Specific Use Permit, with the following conditions: b. The Specific Use Permit is tied to the business owner, Alam Joma; h. The Specific Use Permit is tied to the business name, Alam Auto Services, Inc. dba European Auto Sales & Services; i. No outdoor advertising display other than a permitted sign indicating the name of the business; j. No outdoor storage or display of vehicles; k. No more than five (5) gallons of fuel stored per vehicle (including fuel in the vehicle gas tank) and no more than thirty (30) gallons stored within the facility; and I. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Applicant, Alam Joma appeared and introduced himself. Chairman Ellis asked to hear from any proponents/opponents who wished to speak. Seeing none, Chairman Ellis closed the public hearing at 6:47 p.m. Commissioner Barker asked the ratio of new car sales versus repair shop. Applicant, Alam Joma responded that he needs office space and only has room for 4 or 5 cars. There were no further questions or comments presented by the Commission. Commissioner Barker made a motion to approve Case No. 22-11-SUP for a Specific Use Permit for Alam Auto Services, Inc. to perform auto sales at 1118 S. Airport Circle, Suite 120 in the Heavy Industrial (1-2) zoning district, and with the conditions as presented. Commissioner Dunckel seconded the motion. The vote was as follows: Ayes: Chairman Ellis, Vice Chairman Portugal and Commission Members: Barker and Dunckel.
