RESOLUTION CANVASSING RETURNS AND
DECLARING RESULT OF ELECTION
CITY OF EULESS, TEXAS
ON THIS, the 24th day of September, 1968, the City Council of the city
of Euless, Texas, convened in regular session at the regular meeting place of
said Council, being open to the public, with the following members present and
in attendance, to -wit:

HAROLD SAMUELS )
BILL BYERS )
DAN L. SHULL )
FRANK DOUGLASS )
DON R. WARREN )
and
COUNCILMEN
C. J. GRIGGS CITY MANAGER
MRS. VADA FERRIS CITY SECRETARY
also being present; and with the following absent: NONE
constituting a quorum; when, among other proceedings had, were the following:
Mayor Fuller introduced a proposed resolution. Councilman Byers moved its
adoption. The motion was seconded by Councilman Warren. The motion carrying with
it the adoption of the resolution, prevailed by the following vote:
Warren
AYES: Mayor Fuller and Councilmen Samuels, Byers, Shull, Douglass and
NOES: None.
The RESOLUTION IS as follows:
WHEREAS, under and by virtue of a resolution and order passed and adopted
by the City Council of the City of Euless on the 29th day of August, 1968, an
election was held ill said City on the 14th day of September, 1968, on the follow-
ing proposition:
"SHALL the City Council of the City of Euless, Texas, be
authorized to sell and convey to the City of Bedford, Texas, that
portion of the Euless Water and Sewer System (located within the
corporation limits of Bedford) which is not required in any manner
for the rendition of efficient service to the inhabitants
of Euless and to apply as promptly as possible all pro-
ceeds of such sale to the prepayment or redemption of as
many revenue bonds issued by Euless for the purbhase and
acquisition of the entire system as the amount of such
proceeds will permit ?"
AND, WHEREAS, upon consideration of the returns of said election it appears
that the same was in all respects legally held after due and proper notice had
been given and that the returns of said election were duly and legally made, and
WHEREAS, it appears from the said returns that 471 votes were cast
"FOR THE SALE OF THAT PORTION OF THE EULESS WATER AND SEWER SYSTEM LYING WITHIN
THE CORPORATE LIMITS OF BEDFORD AND NOT REQUIRED FOR EFFICIENT SERVICE IN EULESS;
ALL PROCEEDS OF SALE TO BE EMPLOYED IN PREPAYMENT OR REDEMPTION OF EULESS WATER
AND SEWER SYSTEM REVENUE BONDS" and 135 votes were cast "AGAINST THE SALE OF
THAT PORTION OF THE EULESS WATER AND SEWER SYSTEM LYING WITHIN THE CORPORATE
LIMITS OF BEDFORD AND NOT REQUIRED FOR EFFICIENT SERVICE IN EULESS; ALL PROCEEDS
OF SALE TO BE EMPLOYED IN PREPAYMENT OR REDEMPTION OF EULESS WATER AND SEWER
SYSTEM REVENUE BONDS "; therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
SECTION 1: That the aforesaid election was duly and legally called and
notice thereof given in accordance with the laws of the State of Texas, and the
resolution and order calling said election; that said election was held in strict
conformity with the Constitution and laws of the State of Texas, and the returns
thereof have been properly made to the officials of the City entitled to receive
same; and that only qualified voters of the City were permitted to vote at said
election; and further, that said election properly represents the desires of
those qualified to vote as aforesaid.
SECTION 2: That the proposition was sustained by a majority of the parti-
cipating qualified electors and the City Council of the City of Euless, Texas, is
authorized to sell and convey to the City of Bedford, Texas, that portion of the
Euless Water and Sewer System which is located within the corporate limits of the
City of Bedford which is not required in any manner for the rendition of efficient
service to the inhabitants of the City of Euless and the City Council is further
authorized to apply as promptly as possible all of the proceeds of the sale of
such portion of the system to the prepayment or redemption of as many revenue
bonds issued by Euless for the purchase and acquisition of the entire system as
the amount of such proceeds will permit.
PASSED AND APPROVED this the 24th day of September, 1968.
