AN ORDINANCE GRANTING, EXTENDING, RENEWING, AND
AMENDING A FRANCHISE TO ALLIED WASTE SERVICES OF FORT
WORTH, LLC DBA REPUBLIC SERVICES FOR THE COLLECTION OF
RESIDENTIAL AND COMMERCIAL SOLID WASTE WITHIN THE CITY
OF EULESS; PROVIDING THE TERMS AND CONDITIONS THEREOF;
PROVIDING A TERM FOR THE FRANCHISE; PROVIDING FOR THE
APPROVAL OF RATES TO BE CHARGED FOR SUCH SERVICES
DURING THE TERM OF THE FRANCHISE; AND PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Euless has determined that it is in the
best interest of the citizens to utilize a qualified professional organization to provide for
the collection and disposal of solid waste in an efficient, safe, and healthy manner,
including but not limited to providing the following services:
A. Efficient and economical residential curbside and commercial container
solid waste collection.
B. Collection and transportation of solid waste from residential, institutional,
commercial, and industrial units within the City of Euless to a designated
disposal site.
C. Providing up to date equipmentand facilities and qualified and well -trained
personnel to assure quality collection and disposal of solid waste.
D. Maintaining positive commu n ications with theCityof Eulessand its citizens;
and
WHEREAS, the City Council previously approved Ordinance No. 2172 granting a
franchise to Allied Waste Services of Fort Worth, LLC dba Republic Services., as
successorin interestto Allied Waste Services, L.L.C., forthe provision of such solidwaste
services for a term ending on February 28, 2023; and
WHEREAS, Allied Waste Services of Fort Worth, LLC dba Republic Services. has
performed such servicesforthe citizens of Euless in an efficient, economical, and healthy
manner and is qualified to continue providing such services, facilities and equipment
necessary to fulfill the current and future solid waste services of the City; and
WHEREAS, the City and Allied Waste Services of Fort Worth, LLC dba Republic
Services. desire to renew, extend and amend the current franchise agreement upon the
terms and conditions set forth herein; and
WHEREAS, it is the intent of the City Council in approving this ordinance to grant
a franchise for a five-year term with the ability to renew and extend the franchise for an
additional five-year term upon agreement of the City and Allied Waste Services of Fort
Worth, LLC dba Republic Services. as provided in Section 5.9 of Ordinance No. 2172, as
amended, and such renewal and extension is hereby determined by the City Council to
be in compliance with the requirements of Article XI, Section 3 of th e City Charter.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
The City of Euless hereby renews, extends and amends its franchise agreement
with Allied Waste Services of Fort Worth, LLC dba Republic Services. previously
approved in Ordinance No. 2172 granting to Allied Waste Services of Fort Worth, LLC
dba Republic Services. the license and privilege to use the public streets, easements,
and thoroughfares within the corporate limits of the City of Euless for the purpose of
collection and disposal of residential and commercial garbage, trash, refuse, bulky
wastes, trees, construction debris, brush, tree trimmings and rubbish,subjectto the terms
and conditions set forth in Ordinance No. 2172, as amended herein, and as allowed by
state law.
FRANCHISE AGREEMENT FOR THE COLLECTION OF RESIDENTIAL AND
COMMERCIAL SOLID WASTE
THIS FRANCHISE AGREEMENT ("Agreement") is entered into by and between the
Cityof Eu less, Texas, a Home Ru le Mu nicipal Corporation located in Tarrant County, Texas,
(the "City"), and Allied Waste Services of Fort Worth, LLC dba Republic Services.
("Contractor"). In consideration of the following mutual agreements and covenants, the
City and Contractor do hereby agree as follows:
SECTION 1.
CONTRACTOR
Section 1.10 of Ordinance No. 2172 is amended to read as follows:
1.10 Contractor. Allied Waste Services of Fort Worth, LLC dba Republic Services.
SECTION 2.
TERM
Section 5.8 of Ordinance No. 2172 is amended to read as follows:
5.8 Term. This Agreementshall be for a five (5) year period beginning March 1, 2023,
and ending five (5) years thereafter.

SECTION 3.
RATE INCREASE
Section 9.4 of Ordinance No. 2172 is amended to read as follows:
9.4 Rate Increase. Contractor will be eligible to receive an increase in Monthly
Contractual Rates on March 1, 2024, 2025, 2026, and 2027, as set forth in the schedule
attached hereto as Exhibit "A".
SECTION 4.
SOLID WASTE RATES
Exhibit "A" of Ordinance No. 2172 is replaced with Exhibit "A" attached to this
ordinance.
SECTION 5.
AUTOMATED CART COLLECTION
Contractor is currently providing the services prescribed hereunder utilizing
manual collection and the vehicles associated with manual collection. The City
understandsand agrees that as a condition to continueto provide services to the City,
the Contractor will be converting to the use of automated cart collection vehicles to
provide the services. This conversion to automated collection vehicles will take place
duringtheterm of the Fran ch ise Agreement over several months.The parties understand
and agree that this conversion will require a changeto the rates for the provision of all
services. The parties agree to negotiate in good faith the timing, the term andthe increase
to rates. If the parties cannot come to mutual agreement on the increased rates either
party may terminate the Franchise Agreement atthe end of the then current Term.
SECTION 6.
EFFECT OF AMENDMENT
All other terms of Ordinance No. 2172 and the Franchise Agreement approved
thereunder shall remain in full force and effect except as specifically amended herein.

SECTION 7.
SEVERABILITY CLAUSE
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid
or unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any such invalid
or unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 8.
PUBLICATION
The City Council further directs that only the caption of this ordinance be published
in accordance with Article XI, Section 3 of the City Charter.
SECTION 9.
EFFECTIVE DATE
This ordinance shall be in full force and effect March 1, 2023.

nays, and 0 abstentions.
PRESENTED AND GIVEN SECOND AND FINAL READING and approved at a

tenant thereto for SH 10 Landscape Enhancement for the City of Hurst

PROPOSAL:

will be accepted.
Proposals will be accepted only, for the entire Portion of the project described
In these Drawings. Each proposal shall be submitted on the CONTRACTOR'S
Proposal Form enclosed herein or one a computer-genemtad loan, provided
that the following conditions are met All blanks shall be fully and legibly filled'
all signature shall be in longhand. An authorized member of the contracting
Ran must sign the CONTRACTOR'S Proposal Fmd. The completed form shall

When you pulled on the
hand brake, you felt resist-
ance. But since the cables
were seized, they weren't

And if you then left the
car in Neutral at the ferry
dock, it would have been
free to roll. That was the
plop you heard as you
walked the other way.
Why is it working prop-
erly now? Well, it could
just be that applying the
brake and releasing it a
number of times freed up
