WHEREAS, pursuant to Section 5, Article I11 of the Euless City
Charter, the provisions of Title 28, Chapter 2 of the Revised Civil Statutes
of the State of Texas, and the Election Code of the State of Texas, it is
provided that should any candidate for the office of councilman for the
City of Euless fail to receive a majority of votes cast for all of the candi-
dates for such office at an election called for the purpose of selecting
councilmen, that a run -off election should be held, and
WHEREAS, at the regular election of municipal officials 66 the City
of Euless held on April 12, 1969, no candidate received a majority of all of
said votes cast for Place 4 on the Euless City Council, and
WHEREAS, pursuant to the provisions of Section 5, Article III of
the Euless City Charter as amended, a run -off election must be called
for a date not exceeding fifteen days following the issuance of such call,
and
WHEREAS, on Saturday, April 12, 1969, the Euless City Council
in special called session didi provide for and called a run -off election
for Councilman Place 4 for the Euless City Council between Ivan
Gregory, Jr. and J. Dwayne Wilcox, the two candidates receiving the
highest number of votes for such office in the regular election on
April 12, 1969;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS:
That the City Council of the City of Euless, Texas, at a special
called meeting held on Satufday, April 12, 1969, did and does hereby order
a run -off election for the election of Councilman Place 4 on the Euless
City Council to be bold on Saturday, April 26, 1969, such Councilman
Place 4 to serve for a period of two years, or until his successor has
been duly qualified. The effective date of taking such office shall be as
soon as returns are canvassed and declared. The candidate for Councilman
Place 4 receiving a majority of the votes cast for the office of
Councilman Place 4 at such run -off election on April 26, 1969, shall
be declared elected to such office.

For the purpose of said election, the entire City is hereby constituted
one voting precinc'; the polling place for said eilection shall be the City Hall
located at 201 Ector Drive in said City and said election shall be held between
the hours of 7 :00 a. m. and 7 :00 p. m. on the aforementioned date, and the
following persons are hereby appointed to act as election officers and clerks:

No person shall be eligible for the office of Councilman unless he
is twenty -one (21) years of age or older, a property owner within the
corporate limits of the City of Euless, Texas, a qualified voter of the
City of Euless, a resident of the United States, a resident of the City of
Euless for the last two f2) years prior to the date of this election and is
able to state truly under oath that he is not in arrears in the payment of
taxes or other liabilities due the City of Euless.

The two candidates receiving the highest nuitrer of votes at the
regular election for municipal officials on April 12, 1969, are as follows:
Ivan Gregory, Jr.
J. Dwayne Wilcox

Ballots to be used in said election shall be prepared in the manner
and form as provided in the Euless City Charter and the Election Code of
the State of Texas. The ballots shall be printed prior to April 16
1969.

All qualified voters within the meaning of the Constitution and
Laws of the State of Texas, who have resided in the State of Texas for
a period of one (1) year, and in the City of Euless for a period of six (6)
months prior to the date of the election herein provided for, shall be
entitled to vote at such election.

Voting by Absentee Ballot in said election shall commence on the
16th day of April , 1969, at the office of the City Secretary,
Euless, Texas. Voting by Absentee Ballot shall close at 5 :00 p. m. on
April 22 , 1969.

All ballot boxes containing ballots used in the election shall be
delivered to the County Clerk of Tarrant County, Texas, as by law pro-
vided and other election records and supplies shall be preserved by the
City Secretary in his office as by law provided. The City Council will
meet to canvass the returns of said election, investigate the qualifications
of the elected candidates and declare the official results of the election
promptly following receipt of the election returns by the City Secretary.
The canvassing of the returns and declaration of the results by the Euless
City Council shall take place April 26 , 1969, as soon as
practical after the polls close, ballots counted and the returns certified
by the Election Judge. The candidates for the election to the Councilman
Place 4 receiving the highest number of ballot votes cast by qualified
voters voting at the election, shall be declared elected.

The Mayor is hereby directed to give Notice of said election which
shall be signed by the Mayor, under the attest of the City Secretary, and
shall state the purpose of the election, the officers to be elected, and
the Chief of Police shall post a properly executed copy of the election
proclamation at the polling place herein provided and two copies at two
other public places within the City. Such notices shall have attached
thereto a certified copy of this Resolution.

Said election shall be held and conducted in accordance With the
City Charter and the laws of the State of Texas for the holding of general
elections for State and County offices except as otherwise provided by
Chapter 2, Title 28, of the Revised Civil Statutes of Texas.
