AN ORDINANCE AMENDING CITY OF EULESS, TEXAS, ORDINANCE
NO. 1101 BY REVISING THE REQUIREMENTS FOR A FENCE/WALL
ALONG HARWOOD ROAD WITHIN THE BEAR CREEK BEND
ADDITION; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL
NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Euless, Texas is a home rule city acting under its Charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and
WHEREAS, the City Council previously adopted Ordinance No. 1101 rezoning
property known as Bear Creek Bend Addition Phase I (the "Subdivision") to PD (Planned
Development for R-1, Single Family Detached, small lots) and implementing zoning and
other regulations for the Subdivision; and
WHEREAS, the City of Euless has requested an amendment to the PD zoning
requirements regarding perimeter fencing in the Subdivision adjacent to Harwood Road;
and
WHEREAS, a public hearing was duly held by the Planning and Zoning
Commission of the City of Euless on January 3, 2023, and by the City Council of the City
of Euless on January 24, 2023, with respect to the revisions described herein; and
WHEREAS, all requirements of law dealing with notice to other property owners,
publication, and all procedural requirements have been complied with in accordance with
Chapter 211 of the Texas Local Government Code and the City's Unified Development
Code; and
WHEREAS, the City Council deems it advisable and in the public interest to amend
Ordinance No. 1101 as described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS, THAT:
SECTION 1.
Ordinance No. 1101 is amended by revising the requirements for a fence or
screening wall along Harwood Road to meet the following minimum standards:
(i) six-foot (6) high, and
(ii) board -on -board cedar wood fence with a natural cedar finish, a top
cap, and installed with galvanized metal posts set in concrete and
constructed so that the sides of the fence containing the structural supports
are not visible from Harwood Road, any street right-of-way, or common
area.
SECTION 2.
CUMULATIVE CLAUSE. Any requirements in Ordinance No. 1101, including the
Development Plan attached as an exhibit thereto, that require masonry materials for a
screening fence along Harwood Road are hereby deleted. All other terms, conditions and
provisions of Ordinance No. 1101 that are not specifically amended herein shall remain
in full force and effect.
SECTION 3.
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses, and
phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph,
or section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance,
since the same would have been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase.
SECTION 4.
PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the
terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and
upon conviction thereof shall be fined in accordance with Chapter 1, "General Provisions,"
Section 1-12, "General Penalty," Euless Code of Ordinances. Each such violation shall
be deemed a separate offense and shall be punishable as such hereunder.
SECTION 5.
SAVINGS CLAUSE. All rights and remedies of the City of Euless are expressly
saved as to any and all violations of the provisions of Ordinance No. 1101 or any other
ordinances regulating zoning that have accrued at the time of the effective date of this
ordinance; and, as to such accrued violations and all pending litigation, both civil and
criminal, whether pending in court or not, under such ordinances, same shall not be
affected by this ordinance but may be prosecuted until final disposition by the courts.
SECTION 6.
PUBLICATION CLAUSE. The caption, penalty clause, and effective date clause
of this ordinance shall be published in a newspaper of general circulation in the City of
Ordinance No. 2337, Page 2 of 3
Euless, in compliance with the provisions of Article ll, Section 12, of the Euless City
Charter. Further, this ordinance may be published in pamphlet form and shall be
admissible in such form in any court, as provided by law.
SECTION 7.
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after
its passage and publication, as provided by the Euless City Charter and the laws of the
State of Texas.

meeting of the Euless City Council on January 24, 2023, by a vote of 7 ayes, 0 nays,
and 0 abstentions.
