HomeMy WebLinkAbout2023-04-18 P&Z MinutesCITY OF EULESS PLANNING AND ZONING COMMISSION APRIL 18, 2023 MINUTES The pre -session meeting of the Planning and Zoning Commission was called to order by Vice Chairman LuAnn Portugal at 6:00 p.m. in the Pre -Session Conference Room of City Hall, 201 North Ector Drive. Those present included Commission Members: Curtis Brown, Rubyanne Crites and Eric Owens. Chairman Steve Ellis and Commissioners: Robert Barker, and David Brown were absent. During the Pre -Session Meeting: ➢ Senior Planner, Lisa Payne reviewed agenda items number 2 and 3. PLANNING AND ZONING COMMISSION CONSIDERATION OF SCHEDULED ITEMS — COUNCIL CHAMBERS The regular meeting of The Euless Planning and Zoning Commission was called to order by Vice Chairman LuAnn Portugal at 6:32 p.m. in the Council Chambers at City Hall, 201 North Ector Drive. THE PLEDGE OF ALLEGIANCE Commissioner C. Brown led the pledge of allegiance. ITEM 1. APPROVED PLANNING AND ZONING MINUTES Commissioner Crites made a motion to approve the minutes of the regular meeting of April 4, 2023. Commissioner C. Brown seconded the motion. Nays: None Abstention: None Vice Chairman Portugal declared the motion carried. (4-0-0) ITEM 2. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 23-04- SUP AND CONSIDER RECOMMENDATION FOR AN ORDINANCE Vice Chairman Portugal opened up the public hearing on Specific Use Permit Case No 23- 04-SUP at 6:35 p.m. Senior Planner, Lisa Payne gave a brief description of the case. Redeemed Christian Church of God has been in this community for 20 years, and now the applicant intends to construct and operate the church on a 2.2-acre vacant property recently acquired by the church at 2400 W. Euless Blvd. A place of worship is only permitted in the Texas Highway 10 Multi - Use (TX-10) zoning district with the approval of a Specific Use Permit (SUP). Though a formal site plan submittal will be required following SUP approval, the church has provided conceptual plans of the property layout and appearance of the building, which are attached. A one-story building comprising of a lobby, sanctuary, classrooms, offices, and restrooms is proposed, as well as 47 parking spaces which complies with the parking regulations for a congregation of 180 people. In order to beautify the property, the applicant also has plans to clear underbrush and any dead trees that exist on the property while leaving the healthy trees intact. Public hearing notification letters were mailed to surrounding property owners, and to date, staff has received no responses. Staff recommends approval of the Specific Use Permit, with the following conditions: a. The Specific Use Permit is tied to the business name, Redeemed Christian Church of God; b. The Specific Use Permit is tied to the business owner, Abbey Adeyeye; and C. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Vice Chairman Portugal asked to hear from any proponents/opponents who wished to speak. Applicant Oscar Galan of Classic Design Group and Pastor Abbey Adeyeye were available for questions. Vice Chairman Portugal closed the public hearing at 6:40 p.m. Commissioner Owens asked for the number of church members. Mr. Adeyeye responded 150 members. Brown made a motion to approve Case No. 23-04-SUP a Specific Use Permit for Redeemed Christian Church of God to operate as a place of worship in the Texas Highway 10 Multi -Use (TX-10) zoning district located at Kitty House Survey, Abstract 678, Tracts 2A3A & 2C, 2400 W. Euless Blvd. and consider recommendation for an Ordinance. Commissioner Owens seconded the motion. The vote was as follows: Ayes: Vice Chairman Portugal and Commission Members: C. Brown, Crites and Owens. Nays: None Abstention: None Vice Chairman Portugal declared the motion to approve Case No. 23-04-SUP carried. (4-0-0) ITEM 3. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO 23-05- SUP AND CONSIDER RECOMMENDATION FOR AN ORDINANCE Vice Chairman Portugal opened up the public hearing on Specific Use Permit Case No 23- 05-SUP at 6:41 p.m. Senior Planner, Lisa Payne gave a brief description of the case. The applicant intends to operate a mechanic shop for general automotive repair in an existing building on the southeast corner of W. Euless Blvd. and Heather Dr. Such a use is only permitted in the Texas Highway 10 Multi -use (TX-10) zoning district with the approval of a Specific Use Permit (SUP). The proposed use does not include major automotive work such as auto body repair or replacement of engines and transmissions. In order to comply with Section 84-337 of the Code of Ordinances regarding open storage, all vehicle repair work will be performed inside the building and all outdoor storage will be screened on all sides by the existing 8-foot tall fence. Further, the outdoor storage area has existing solid shade structures so rainwater is not collected in tires. The applicant anticipates six employees and being open to the public Monday through Sunday from 8:00 a.m. to 6:00 p.m. In addition, the applicant will provide four potted plants on the property — three Boxwoods at the front of the building that faces W. Euless Blvd. and one Pine on the side of the building facing Heather Dr. Public hearing notification letters were mailed to surrounding property owners, and to date, staff has received no responses. Staff recommends approval of the Specific Use Permit, with the following conditions: a. The Specific Use Permit is tied to the business name, AmeriBahn, LLC; b. The Specific Use Permit is tied to the business owner, Jose Garay; C. The specific automotive services permitted by the Specific Use Permit are those identified on the attached "Schedule A", dated April 3, 2023 and signed by the business owner; d. All repair of vehicles will be conducted inside existing bays. No work is to be conducted exterior to the building; Planning and Zoning Commission Minutes Page 4 of 5 April 18, 2023 e. All car parts stored on -site, whether new or used, shall be stored in a manner that is screened from public view from the right-of-way or shall be stored interior to the building. All tires shall be stored so as to not collect rainwater; f. Outdoor storage of vehicles or merchandise is not permitted within the view of the public right-of-way; and g. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Vice Chairman Portugal asked to hear from any proponents/opponents who wished to speak. Applicant Jose Garay was available for questions. Vice Chairman Portugal closed the public hearing at 6:46 p.m. Commissioner C. Brown asked the applicant for the longevity of his career in the automotive industry and where he is currently working. Mr. Garay responded he has been in the automotive business for 18 years and that he owns a car lot in Grand Prairie, Texas and a repair shop in Arlington, Texas. Commissioner Owens asked if he was moving his businesses from Arlington, Texas and Grand Prairie, Texas to this location. Mr. Garay responded that he was not and would continue to have the other businesses at their locations. Vice Chairman Portugal wanted to make sure the Applicant understood the conditions. Mr. Garay responded that he understood and is excited to be doing business in Euless. There were no further questions or comments presented by the Commission. Commissioner Owens made a motion to approve Case No. 23-05-SUP a Specific Use Permit for AmeriBahn, LLC to perform general automotive repair in the Texas Highway 10 Multi -Use (TX-10) zoning district located at Cresthaven Addition, Block 1, Lot Al, 1511 W. Euless Blvd. and consider recommendation for an Ordinance. Commissioner Crites seconded the motion. The vote was as follows: Ayes: Vice Chairman Portugal and Commission Members: C. Brown, Crites and Owens. Nays: None Abstention: None Vice Chairman Portugal declared the motion to approve Case No. 23-05-SUP carried. (4-0-0) ITEM 4.
