A RESOLUTION DETERMINING THE NECESSITY FOR AND
ORDERING THE IMPROVEMENT OF A PORTION OF NORTH
MAIN STREET IN THE CITY OF EULESS, TARRANT COUNTY,
TEXAS; DECLARING AN INTENTION THAT A PORTION OF
THE COST BE ASSESSED AGAINST THE ABUTTING PROPERTY
AND ITS OWNERS; DIRECTING THE PREPARATION OF PLANS
AND SPECIFICATION AND THE ADVERTISEMENT OF SAME FOR
BIDS; SPECIFYING ACTION UNDER ARTICLE 1105(B),
V.A.T.S.; AND DECLARING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
Section 1: A necessity exists for the improvement of North Main
Street in the City of Euless, Tarrant County, Texas,
between generally its intersection with Harwood Road
and Trailwood Drive.:
Section 2: Such street shall be improved by filling, grading,
raising, paving, repaving and repairing in a per-
manent manner and by constructing, reconstructing, repairing and
realigning curbs, gutters and side walks, and by widening, narrow-
ing and straightening, and by constructing appurtenances and in-
cidentals to any such improvements including drains and culverts,
such improvements to be made separately in any combination or part
thereof as may be recommended by the City Engineer and approved by
the Euless City Council.
Section 3: It is the intention of the Euless City Council that
the cost of such improvements shall be borne by the
City of Euless, Texas, and the abutting property owners as may be
determined at a public hearing thereon.
Section 4: The plans and specifications prepared by the City
Engineer for such improvements and steps taken for
advertisement of bids are herewith in all things approved and the
City Engineer is hereby directed to do all things necessary to
prepare necessary estimates of the costs of improvements so as to
allow the City Council to proceed thereon in the manner required
by law for determination of assessments and the final contracting
for such improvements and the construction thereof.
Section 5: In making such improvements the City Council is acting
under the provisions of the Act passed at the First
Called Session of the Fortieth Legislature of the State of Texas,
known as Chapter 106 of the Acts of such Session, together with
amendments thereto, also known as Article 1105(b) of Vernon's Texas
Civil Statutes, adopted by the Charter of the City of Euless.
Section 6: This Resolution shall be effective immediately upon
adoption.
ADOPTED this the 22nd day of November , 1977, at a
regular meeting of the City Council of the City of Euless by a
vote of 4 Ayes and 0 Nays and 0 Abstained.
