HomeMy WebLinkAbout79-450 03-27-1979RESOLUTION NO. 450 WHEREAS, The City Council of the City of Euless is firmly of the opinion that the current system in Tarrant County of traffic cases being appealed to the County for trial de novo results in such numbers of cases as to prevent the substantial likelihood that any one case will be tried; and WHEREAS, the City Council of the City of Euless is further of the opinion that such a system makes a mockery of the rule of law and of equal rights under the law, constituting instead a system which rewards those who pay to block the system; and WHEREAS, such system eliminates the whole reason for having appeals, that is to correct abuses, and replaces justice with the avoidance of penalties, such as an increase in insurance premiums or loss of drivers licenses; and WHEREAS, justice demands that the interest of the majority be protected from abuse by a minority of persons desiring to take advantage of a defective system which may be characterized as a trial de novo appeal; and WHEREAS, municipal courts of record have been tried and proved in Texas with results that satisfy both the need for an efficient system of justice as well as protection of the rights of defendants in the system. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: Sec. 1. THAT the City Council of the City of Euless urges the creation of a Municipal Court of Record for the City of Euless. Sec. 2. THAT the City Council, City of Euless, mindful of the fact that Tarrant County has more incorporated municipalities than any other county in the State of Texas respectfully urges the creation of the Municipal Court of Record for all cities in Tarrant County. Sec. 3. THAT the City Council, City of Euless, urges the endorsement by other cities in Texas of the Municipal Court of Record. APPROVED AND ADOPTED this the 27th day of March, 1979.
