Home My WebLink About2350 08-08-2023ORDINANCE NO. 2350 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT FOR THE EXTENSION OF A TELECOMMUNICATION FACILITY IN THE SINGLE-FAMILY DETACHED DWELLING (R-1) ZONING DISTRICT LOCATED IN THE MIDWAY PARK ADDITION, BLOCK 45, LOT 2R AT 709 MIDWAY DRIVE; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATION; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on July 18, 2023, in conjunction with Specific Use Permit Case No. 22-12-SUP, and has rendered a recommendation to the City Council with respect to this case; and WHEREAS, City Council has conducted a public hearing on August 8, 2023, has considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless and that any foreseeable negative impacts of the proposed use have been mitigated through design restrictions or other set conditions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. ALLOWED USES. An extension to the existing telecommunication facility and conditions as specifically described on the Specific Use Form (attached hereto and made a part hereof) shall be permitted in the Midway Park Addition, Block 45, Lot 2R at 709 Midway Drive. SECTION 2. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3. PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with Chapter 1, "General Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 4. PUBLICATION CLAUSE. The caption, penalty clause, and effective date clause of this ordinance shall be published in a newspaper of general circulation in the City of Euless, in compliance with the provisions of Article II, Section 12, of the Euless City Charter. Further, this ordinance may be published in pamphlet form and shall be admissible in such form in any court, as provided by law. SECTION 5. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. CONDITIONS (INCLUDING DATES): 1) The Specific Use Permit is tied to the tower owner, T-Mobile West Tower LLC or its successors. In the event such a change in ownership occurs, the City of Euless shall be notified in writing; 2) The telecommunication tower shall not exceed 94 feet in height; 3) The telecommunication tower shall remain a stealth monopole with no antenna elements external to the pole; 4) There shall be no outdoor advertising display other than signage required by the FCC; 5) Any change to the telecommunication tower that does not qualify as a non - substantial change under federal law shall require an amendment to the Specific Use Permit; 6) The telecommunication tower must be removed at the expense of the tower owner in the event that the facility is inactive for a period of one year, and the City must be notified in writing that the facility has become inactive; and 7) The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. I hadn't heard of this before and wonder if it is going to become commonplace. Also, is there a big cost differential vs. air in- flation? — Gregory I don't want to go so far as to call this a scam, Gregory, because scam is a very strong word. But it's really close.So, let's go with "unnecessary upsell." There are some tire shops these days that are charging people to fill their tires with nitrogen rather than "air." But keep in mind, air is 80% nitro- gen. Now, they cite some reas onable sounding argu- ments for why you might want to use 100% nitro- gen rather than 80% ni- trogen and 20% oxygen — known as air. For instance, they say if your car catch- es fire and your tire ex- plodes, nitrogen —an inert gas —won't feed the tire. What they fail to men- tion is that there's an infinite amount of oxygen all around the tires, in the air. So that's nonsense. They'll also tell you that nitrogen -filled tires don't change pressure as much as air -filled tires when your tires heat up and cool down. This iS true, but it hardly matters. The normal range THERE ARE SOME TIRE SHOPS THESE DAYS THAT ARE CHARGING PEOPLE TO FILL THEIR TIRES WITH NITROGEN RATHER THAN 'AIR:' BUT KEEP IN MIND, AIR IS 80% NITROGEN. NOW, THEY CITE SOME REASONABLE SOUNDING ARGUMENTS FOR WHY YOU MIGHT WANT TO USE 100% NITROGEN RATHER THAN 80% NITROGEN AND 20% OXYGEN — KNOWN AS AIR.
