HomeMy WebLinkAbout80-485 05-13-1980RESOLUTION NO. 485 WHEREAS, the State of Texas and the majority of other states have adopted the Uniform Controlled Substances Act proscribing the manufacture, possession and use of certain drugs; and WHEREAS, such legislation was intended to effect, upon a state wide basis, the control of the manufacture, possession and use of such substances; and WHEREAS, there has arisen thoroughout the state numerous establishments for the manufacture, sale and distribution, not of controlled substances, but of specialty and novelty items often referred to as drug paraphernalia which are intended and used and designed for use in connection with the introduction of controlled substances into the human body; and WHEREAS, such establishments, commonly known as "head shops ", have commenced operations within municipalities, large and small, thoroughout our state; and WHEREAS, existing state law does not proscribe such opera- tions; and WHEREAS, the Euless City Council has determined and hereby does determine that the effect of the operation of such establish- ments is adverse and deleterious to the citizens of our community and state, especially, minors, who by their years, are more highly susceptible to an adverse influence by such establishments; and WHEREAS, the Euless City Council has further determined and hereby does determine that the sale, distribution and manufacture of such drug- oriented paraphernalia serves to readily assist in the use and consumption of illegal drugs and does threaten the health, life, safety, welfare, morals and property, of the citizens of our community and state and does, further, attract an element within our state of a criminal nature, thus creating even addi- tional dangers; and WHEREAS, the City Council of the City of Euless believes . and hereby does determine that individual community proscriptions upon the existence of such drug- oriented establishments would be far less effective than a total state wide proscription thereof; and WHEREAS, a state wide proscription of such establishments would be the most enforceable and effective in removing such dangers from the citizenry of our state and, particularly, our children. NOW, THEREFORE, be it resolved by the City Council of the City of Euless, Texas, in regular session duly convened, that: The 67th Legislature of the State of Texas, to be convened in the City of Austin, Travis County, Texas, during the month of January 1981, be, and the same is, herewith memorialized to adopt legislation that would proscribe, thoroughout the state, the manufacture, sale and distribution of drug oriented paraphernalia, that such Legislature consider the adoption of the Model Drug Paraphernalia Act recently promulgated by the United States Department of Justice and that a copy of this resolution be forwarded to the Honorable William P. Clements, Governor of the State of Texas; The Honorable William P. Hobby, Lt. Governor of the State of Texas; and the Honorable Bill Clayton, Speaker of the Texas House of Representatives, requesting that they lend their support and the authority of their respective offices toward the final adoption and enactment of such legislation. ADOPTED by the City Council of Euless, Texas, at a regularly scheduled meeting on this the 13th day of May, 1980, by a vote of 5 ayes, 0 nays and 0 abstentions.
