HomeMy WebLinkAbout2023-08-08MINUTES OF THE PRECOUNCIL AND REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, August 8, 2023 The precouncil meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:30 p.m. on Tuesday, August 8, 2023, in the Precouncil Conference Room at City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Mayor Pro Tern Eddie Price, Council Members Tim Stinneford, Jeremy Tompkins, Perry Bynum, and Tika Paudel. Council Member Harry Zimmer was not present due to a scheduled absence. During the Precouncil meeting: ➢ Council Member Stinneford advised that he, Council Members Paudel and Tompkins, and Assistant City Manager Wes Rhodes, in addition to several members of the Nepalese community toured the Community Waste Disposal (CWD) recycling facility and stated that the operation was amazing. ➢ Council Member Paudel advised that a video of the tour of CWD recycling facility was shared over the internet and has received views from around the world. Additionally, he expressed his appreciation to Director of Public Works and Engineering Major Jones and Assistant Director of Public Works Joe Villa for their assistance related to Lone Star Estates. He also advised of his request to the Hurst -Euless -Bedford Independent School District (HEB ISD) for assistance related to two upcoming festivals. ➢ Director of Human Resources and Risk Management Heather Moorhead advised that she and her staff as well as two police officers represented the City of Euless at the North Texas Job Fair hosted by Congresswoman Beth Van Duyne. She stated that the job fair was well attended and she looks forward to participating in coming years. Council Member Tompkins complimented the staff for the booth display and added that staff was approachable and the booth's signage and banner display were a welcoming touch. ➢ Council Member Tompkins advised that he, Mayor Pro Tern Price, and Council Member Paudel represented the City at the HEB ISD convocation. ➢ City Manager Getchell advised that Council Member Paudel and Assistant City Manager Wes Rhodes will represent the City at the Grapevine-Colleyville Independent School District convocation. Council Minutes Page 2 of 12 August 8, 2023 ➢ City Manager Loretta Getchell reviewed the regular agenda. Director of Finance Janina Jewell introduced Jason Hughes, Managing Director, Hilltop Securities, and Chris Dvorak, Associate, Norton Rose Fulbright. Mr. Hughes reviewed the results of the bids received related to the issuance and sale of "City of Euless, Texas, Tax and Waterworks and Sewer System Revenue Certificates of Obligation, Series 2023," (Item #11). Piper Sandler & Company submitted the lowest rate at 3.6169 percent, for a 15-year term, and callable on February 15, 2033. The tax note sale is scheduled to close September 7, 2023. Mark Pfirrman, Public Finance Director, Municap, Inc., presented an update on the Midtown Public Improvement District (Item #15). He advised that an assessment of $200,166 is necessary to fund the debt service and annual collection costs for the upcoming fiscal year. ➢ Assistant City Manager Wes Rhodes presented an Atmos proposed rate increase update. He advised that an ordinance will be presented for consideration at the August 21, 2023 meeting with a recommendation from the Atmos Cities Steering Committee (ACSC) to approve the negotiated settlement. ➢ Assistant City Manager Rhodes presented an Oncor proposed rate increase update and stated that the Oncor Steering Committee is advising to deny the proposed rate increase of $152.8 million. He advised that a resolution will be presented for City Council consideration at the August 21, 2023 meeting. ➢ Director of Finance Jewell presented a Financial update and advised that car rental tax collection is down 14 percent when compared to the same period last year. As follow-up to the July 29, 2023 worksession, she advised that the median age of residents in the City is 35.9 years old. In addition, the number of "65 or older" accounts registered in the City is 3,070, which represents 21 percent of the real estate accounts city-wide. The number of "65 or older" accounts has increased just over 12 percent over the past five years. ➢ As follow-up to the discussion at the July 29, 2023 worksession, Deputy City Manager Chris Barker reviewed the recommended change to the fee ordinance and advised that an ordinance will be presented for consideration at the August 21, 2023 meeting. ➢ Additionally, Director of Parks and Community Services Duane Strawn reviewed the current and proposed rates for residents and non-residents as they relate to swimming lessons and recreation and senior center memberships. As follow-up to the July 29, Council Minutes Page 3 of 12 August 8, 2023 2023 worksession, he presented the breakdown of the number of resident and non- resident memberships for the recreation center and the senior citizen center as well as the fees associated with each membership tier. ➢ Texas Star General Manager Glenda Hartsell -Shelton presented a Texas Star Golf Course and Conference Centre update, including a number of improvements to the facility and staffing. CLOSED SESSION The City Council convened into closed session at 6:26 p.m. for deliberation regarding the following: As authorized by Section 551.071 of the Texas Government Code, the City Council reserves the right to adjourn into Closed Session at any time during the course of this meeting to consult with its attorney regarding any of the matters listed on the agenda and to seek legal advice related to pending or contemplated litigation or a settlement offer, including: ■ Lewis v. PRESENTATION OF EMPLOYEE OF THE MONTH FOR AUGUST 2023 Director of Parks and Community Services Duane Strawn introduced Foreman Randy Leach. Randy was accompanied by his wife, Blaire, daughter, Cara, son, Clay, and members of the Parks and Community Services Department. Mayor Martin presented Randy with a plaque commemorating his selection as Employee of the Month for August 2023. ITEM NO. 2. PRESENTATION OF EMPLOYEE SERVICE PINS+ Senior Police Officer Tyler Killman was not present to receive his service pin commemorating 10 years of service with the City. Director of Planning and Economic Development Michael Warrix introduced Assistant Director of Planning and Economic Development Don Sheffield. Don was accompanied by his wife, Jennifer, and members of the Planning and Economic Development Department. Mayor Martin presented Don with a service pin commemorating his 10 years of service with the City. Director of Fleet and Facilities Kyle McAdams introduced Facilities Supervisor Blake Cloud. Mayor Martin presented Blake with a service pin commemorating his 15 years of service with the City. Director of Parks and Community Services Duane Strawn introduced Crew Leader Larry Cook. Larry was accompanied by members of the Parks and Community Services Department. Mayor Martin presented Larry with a service pin and clock commemorating his 25 years of service with the City. PRESENTATION OF BLOOD DONORS OF AMERICA GOLD AWARD TO THE CITY OF EULESS Council Member Paudel presented the Blood Donors of America's Gold Award to the City of Euless to Library Director Sherry Knight. The Blood Donors of America (BDA) bestowed the award to the City of Euless in recognition for organizing and hosting blood donation events. CONSENT AGENDA (items 4 throu_gh 9) Mayor Martin asked Deputy City Manager Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 4 through 9. Council Member Tompkins seconded the motion. AUTHORIZED CITY MANAGER TO EXECUTE A CONTRACT Authorized the City Manager to execute a contract with UniFirst Corporation, 68 Jonspin Road, Wilmington, Massachusetts, for a three-year period providing for City uniforms, mats, and towels. Pricing is per BuyBoard Cooperative contract 670-22. The estimated expenditure is $55,000. ITEM NO. 5. APPROVED RESOLUTION NO. 23-1646 Approved Resolution No. 23-1646, authorizing submittal of an application to the Office of the Governor for the FY2024 Edward Byrne Memorial Justice Assistance Grant program for the purchase of an Automated License Plate Reader system at a cost of $100,000, and designating the Police Chief as the authorized official to act on the behalf of the City of Euless to apply for, accept, reject, alter, or terminate the grant. This grant has no match requirement and no costs to the City of Euless. ITEM NO. 6. RATIFIED PURCHASES OF FLEET VEHICLES Ratified the purchase of fleet replacement vehicles from Caldwell Country Chevrolet, 800 Texas-121, Caldwell, Texas, and Rush Truck Center, 4000 Irving Boulevard, Dallas, Texas, through the BuyBoard Cooperative. Due to manufacturer's ordering and production timelines, it is necessary to place orders for replacement vehicles prior to the adoption of the FY2024 budget. The vehicles will not be received and payment will not Council Minutes Page 6 of 12 August 8, 2023 be made until the FY2024 budget year. The estimated expenditure is $460,563 and includes the purchase of 10 vehicles. ITEM NO. 7. RECEIPT OF NOTICE ABOUT 2023 TAX RATES Acknowledged receipt of Notice About 2023 Tax Rates from designated employee calculating No -New -Revenue Rate and Voter Approval Rate. ITEM NO. 8. RECEIPT OF CERTIFICATION OF ADDITIONAL SALES AND USE TAX Acknowledged receipt of Certification of Additional Sales and Use Tax from Financial Officer or Auditor to pay debt services for 2023 Tax Year. ITEM NO. 9. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the precouncil and regular meeting of June 27, 2023, and the special called meeting of July 31, 2023. REGULAR AGENDA ITEM NO. 10. HELD A PUBLIC HEARING AND APPROVED SECOND AND FINAL READING OF ORDINANCE NO. 2347 Mayor Martin presented the item to City Council and opened the public hearing at 7:22 p.m. Mayor Martin asked to hear from any proponents followed by opponents of the item There being none, Mayor Martin closed the public hearing at 7:22 p.m. Council Member Bynum motioned to approve the second and final reading of Ordinance No. 2347, granting a franchise to Atmos Energy Corporation to construct, maintain, and operate pipelines and equipment for the transportation, delivery, sale, and distribution of natural gas in, out of, and through the City. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, and Paudel Nays: None Mayor Martin declared the motion carried. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2349 Finance Director Janina Jewell advised that Ordinance No. 2349 authorizes the issuance of "City of Euless, Texas, Tax and Waterworks and Sewer System Revenue Certificates of Obligation, Series 2023" and the proceeds will fund the Police and Court's Building Remodel. Ms. Jewell introduced Jason Hughes, Managing Director, Hilltop Securities, and Chris Dvorak, Associate, Norton Rose Fulbright. Mr. Hughes provided a brief overview of bids received and advised that Piper Sandler & Company, 800 Nicollet Mall, Suite 900, Minneapolis, Minnesota, submitted the lowest rate at 3.6169 percent, for a 15-year term. The sale is scheduled to close September 7, 2023, in the amount of $20,620 million. He also stated that the City's credit rating was upgraded by Standard & Poor's to an AA+ credit rating. Council Member Paudel motioned to approve Ordinance No. 2349, authorizing the issuance and sale of "City of Euless, Texas, Tax and Waterworks and Sewer System Revenue Certificates of Obligation, Series 2023." ITEM NO. 12. HELD A PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 22-12-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2350 Mayor Martin opened the public hearing at 7:27 p.m. Director of Planning and Economic Development Warrix presented the case to the City Council and advised that the applicant, Crown Castle USA, Inc., is seeking a Specific Use Permit (SUP) to modify an existing wireless telecommunication facility located at Midway Park Addition, Block 45, Lot 2R, 709 Midway Drive. The Planning and Zoning Commission held a public hearing on July 18, 2023, and voted 6-0-0 to recommend approval of the SUP with the following conditions: 1. The Specific Use Permit is tied to the telecommunication tower owner, T-Mobile West LLC or its successors; and in the event such a change in ownership occurs, the City of Euless must be notified in writing; 2. The telecommunication tower shall not exceed 94 feet in height; 3. The telecommunication tower shall remain a stealth monopole with no antenna elements external to the pole; Council Minutes Page 8 of 12 August 8, 2023 4. There shall be no outdoor advertising display other than signage required by the FCC; 5. Any change to the telecommunication tower that does not qualify as a non - substantial change under federal law shall require an amendment to the Specific Use Permit; 6. The telecommunication tower must be removed at the expense of the tower owner in the event that the facility is inactive for a period of one year, and the City must be notified in writing that the facility has become inactive; and 7. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated. Mayor Martin asked to hear from any proponents followed by opponents of the case There being none, Mayor Martin closed the public hearing at 7:31 p.m. Mayor Pro Tern Price motioned to approve Ordinance No. 2350, authorizing the issuance of a Specific Use Permit for an extension of a telecommunication facility located at Midway Park Addition, Block 45, Lot 2R, 709 Midway Drive, in the Single -Family Detached Dwelling (R-1) zoning district with the conditions presented and recommended by the Planning and Zoning Commission. ITEM NO. 13. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2351 Mayor Martin presented the item to the City Council and advised that no assessments are needed for Fiscal Year 2023-2024. Council Member Tompkins motioned to approve the first and final reading of Ordinance No. 2351, adopting the Fiscal Year 2023-2024 Service and Assessment Plan for the Glade Parks Public Improvement District Number One (PID #1). APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2352 Mayor Martin presented the item to the City Council and advised that no assessments are needed for Fiscal Year 2023-2024. Council Member Bynum motioned to approve the first and final reading of Ordinance No. 2352, adopting the Fiscal Year 2023-2024 Service and Assessment Plan for the Glade Parks Public Improvement District Number Two (PID #2). Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 15. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2353 Finance Director Jewell presented the item to City Council and advised that Chapter 372 of the Texas Local Government Code allows for the creating of public improvement districts. Owners of real property located near Farm to Market Road 157 (FM 157), State Highway 10 (SH 10), and State Highway 183 (SH 183) delivered to the City of Euless a petition to establish the Euless Midtown Public Improvement District, which the City Council created August 25, 2015, by Resolution No. 15-1471. She stated that a $200,166 assessment is necessary for Fiscal Year 2023-2024. Council Member Stinneford motioned to approve the first and final reading of Ordinance No. 2353, adopting the Fiscal Year 2023-2024 Service and Assessment Plan for the Euless Midtown Public Improvement District (PID). Council Member Paudel seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Price, Council Members Stinneford, Tompkins, Bynum, and Paudel Nays: None Mayor Martin declared the motion carried. APPROVED BOARD AND COMMISSION APPOINTMENTS Council Member Stinneford motioned to reappoint Council Members Perry Bynum and Jeremy Tompkins and Citizen Members Rusty Brown and Mike Pruitt to the Crime Control and Prevention District Board with terms to expire September 1, 2025. ITEM NO. 17. HELD A PUBLIC HEARING AND APPROVED CRIME CONTROL AND PREVENTION DISTRICT (CCPD) BUDGET FOR FY 2023- 2024 Mayor Martin opened the public hearing at 7:36 p.m. Finance Director Jewell presented a summary of the budget and advised the City Council that the proposed Euless Crime Control and Prevention District Budget for Fiscal Year 2023-2024 was approved by the Crime Control and Prevention District Board on June 15, 2023, following a public hearing. State law requires final approval by the City Council without amendment. Mayor Martin asked to hear from any proponents followed by opponents of the item. There being none, Mayor Martin closed the public hearing at 7:39 p.m. Council Member Paudel motioned to approve the Crime Control and Prevention District (CCPD) budget for Fiscal Year 2023-2024 Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Price, Council Members Stinneford, Tompkins, Bynum, and Paudel Nays: None Mayor Martin declared the motion carried. ITEM NO. 18. HELD A PUBLIC HEARING FOR EULESS DEVELOPMENT CORPORATION (EDC) BUDGET FOR FY 2023-2024 Mayor Martin opened the public hearing at 7:39 p.m. Council Minutes Page 11 of 12 August 8, 2023 Finance Director Janina Jewell presented the proposed budget to the City Council. She advised that the Euless Development Corporation (EDC) Board of Directors, at their August 7, 2023 meeting, recommended approval of the proposed budget for Fiscal Year 2023-2024. Ms. Jewell advised that the budget will be presented for City Council consideration at the Monday, August 21, 2023 meeting. Mayor Martin asked to hear from any proponents followed by opponents of the item. There being none, Mayor Martin closed the public hearing at 7:44 p.m. ITEM NO. 19. HELD A PUBLIC HEARING FOR CITY OF EULESS FY2023-2024 OPERATING AND CAPITAL BUDGETS AND MOTIONED TO APPROVE THE PROPOSED BUDGET ON AUGUST 21, 2023 Mayor Martin opened the public hearing at 7:44 p.m. Finance Director Jewell presented details of the proposed City of Euless Operating and Capital Budgets for Fiscal Year 2023-2024. Mayor Martin asked to hear from any proponents followed by opponents of the item. Darl Easton, 1005 Fayette Drive, Euless, Texas, expressed his concerns with the bond sale, the formatting of the budget documents, and the $2 million car rental reserve. City Manager Loretta Getchell responded and offered to meet with Mr. Easton to answer any additional questions. There being no others wishing to speak, Mayor Martin closed the public hearing at 8:03 p.m. Council Member Tompkins motioned to consider approval of the City of Euless Official Operating and Capital Budgets for Fiscal Year 2023-2024 proposed budget at the August 21, 2023 City Council meeting.
