AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF EULESS, CHAPTER 84, UNIFIED DEVELOPMENT CODE,
AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON
APPROXIMATELY 5.935 ACRES IN THE PLAZA GRANDE
ADDITION, BLOCK A, LOT 1 R2, LOCATED NORTHWEST OF THE
INTERSECTION OF RAIDER DRIVE AND WEST EULESS
BOULEVARD, CHANGING THE ZONING FROM PLANNED
DEVELOPMENT (PD) DISTRICT TO PLANNED DEVELOPMENT (PD)
DISTRICT AS DESCRIBED HEREIN AND ON THE ATTACHED
EXHIBITS; PROVIDING FOR A SEVERABILITY CLAUSE, PENALTY
FOR VIOLATION; PROVIDING A SAVINGS CLAUSE; PROVIDING
FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission has conducted a public
hearing on August 1, 2023, in conjunction with Zoning Case No. 23-01-PD, and has
rendered a recommendation to the City Council with respect to this case; and
WHEREAS, the City Council has conducted a public hearing on August 21,
2023, considered the recommendation of the Planning and Zoning Commission, and
has determined that the proposed change is in the best interest of the general welfare
of the City of Euless.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS, THAT:
SECTION 1.
The official zoning district map of the City of Euless, Texas, being a part of
Chapter 84 of the Code of Ordinances, be amended to provide that the zoning district
classification of approximately 5.935 acres in the Plaza Grande, Block A, Lot 1 R2,
located northwest of the intersection of Raider Drive and West Euless Boulevard,
3232 West Euless Boulevard, is changed from Planned Development (PD) District to
Planned Development (PD) District, as described herein and on the attached
"Exhibits." Said property described above shall be subject to all the safeguards and
conditions set forth within the Planned Development (PD) package or stipulated
herein. Said "Exhibits" shall be applicable only to the property described in herein.
SECTION 2.
Development conditions of said property in the "Exhibits" shall operate under the
same development conditions of City of Euless Ordinance No. 1014, Planned
Development Zoning District, with the exception that it will include "Individual and Family
Social Services Organizations" as permitted uses by right, a modified requirement for
trees, and incorporate design element for wall signage consistent with that illustrated in
the "Exhibits."
In the event of any conflict or inconsistency between these PD Standards and the
applicable City regulations, the terms and provisions of these PD Standards shall control.
In the event a development standard or regulation is not addressed herein, the standards
of Chapter 84 "Unified Development Code" and other City regulations apply. Local
building codes, life safety codes, and all applicable Federal, State, and Local regulations
take precedence where any standard requires or recommends actions that are in conflict
with such codes and regulations.
SECTION 3.
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses, and
phrases of this ordinance are severable and if any phrase, clause, sentence,
paragraph, or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such unconstitutional
phrase.
SECTION 4.
PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of
the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be fined in accordance with Chapter 1, "General
Provisions," Section 1-12, "General Penalty," Euless Code of Ordinances. Each such
violation shall be deemed a separate offense and shall be punishable as such
hereunder.
SECTION 5.
SAVINGS CLAUSE. All rights and remedies of the City of Euless are
expressly saved as to any and all violations of the provisions of the Euless Unified
Development Code applicable to the Property that have accrued at the time of the
effective date of this Ordinance; and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be prosecuted until
final disposition by the courts.

SECTION 6.
PUBLICATION. The caption, penalty clause, and effective date clause of this
ordinance shall be published in a newspaper of general circulation in the City of
Euless, in compliance with the provisions of Article II, Section 12 of the Euless City
Charter.
SECTION 7.
EFFECTIVE DATE. This ordinance shall be in full force and effect from and
after its passage, as provided by the Euless City Charter and the laws of the State of
Texas.
PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular
meeting of the Euless City Council on August 21, 2023, by a vote of 7 ayes,
0 nays, and 0 abstentions.

NOTICE TO OFFERORS
CONSTRUCTION MANAGER -AT -RISK
(CMAR)
Proposals from Construction Man-
ager -at -Risk (CMAR) Offerors for the
Replacement Fire Station 26 located
near the intersection of South Hulen
Street and South Drive West in Fort
Worth, Texas, will be received at the
Purchasing Office, City of Fort Worth,
200 Texas Street, Fort Worth 76102,
until 1:30 P.M. on Thursday, Septem-
ber 7, 2023, and will be opened and
publicly read aloud approximately
thirty minutes later in the Council
Chambers.
A Pre -Proposal Conference will be
held at 10:00 A.M., Wednesday, Au-
gust 30, 2023 at the Property Man-
agement Department, Facilities Divi-
sion office, 401 West 13th Street, Fort
Worth, 76102.
The last day for questions from pro-
spective Offerors is at 5:00 PM on
Thursday, September 1,2023. A final
Addendum will be posted Tuesday
September 5, 2023.
The City will select the CMAR Contrac-
tor by using a two-step Request for
Proposal (RFP) process. After evalu-
ating the submitted Proposals from the
CMAR Offerors, the City will shortlist
the week of September 18, 2023, and
interview up to three Offerors the week
of September 25, 2023. The City will
then select and enter into negotiations
with the Best Value Offeror. The City
may discuss with the selected Offeror,
options for a scope or time modifica-
tion and any price change associated
with such modification.
The selected CMAR Contractor will
provide Pre -Construction Services
including Constructability Reviews,
Value Engineering Recommendations
and Estimating Services Fees to re-
view during the various phases of
the design process. This project was
initiated as a Design Build contract
and has been converted to CMAR for
contractual reasons. Programming
and Schematic Design have been
completed. Once the construction
documents are completed, the se-
lected CMAR Contractor will provide
a Guaranteed Maximum Price (GMP)
and construction performance period
for the work. This GMP will be inclu-
sive of Value Engineering and Estimat-
ing Services fees, General Conditions,
Construction Manager's Fee, contin-
gency, bonds, insurance, and other
agreed upon costs; plus, the City's
General Contingency Allowance. The
total construction cost is anticipated
to be approximately $6,200,00.00,
refer to the "Project Proposal Form"
found in the Instructions to Construc-
tion Manager -At -Risk (CMAR) Offerors
The City of Fort Worth will negotiate
a Pre -Construction Services Contract
and later negotiate a Construction
Services Contract, based on percent-
ages established in the "Project Pro-
posal Form" with the selected CMAR
firm determined to have made the Best
Value offer.
The Business Equity goal is 25% for
the estimated construction budget.
There is no goal for the Pre -Construc-
tion Services. The goal will be applied
to the GMP when the GMP agreements
are reached. Offerors must submit an
anticipated M/WBE Utilization Plan
with their CMAR Proposal submittal.
The submitted Plan will be part of
the weighted selection criteria. Re-
fer to Instructions to Construction
Manager -at -Risk (CMAR) Offerors for

with the selected CMAR firm, the City
will recommend to the City Council
to award the CMAR contract to the

negotiations and the agreed upon
estimated construction budget. The
CMAR contract will be adjusted based
on the agreed upon Guaranteed Max-
imum Price (GMP) after the design is
completed.
The selected CMAR Contractor will
be required to provide Payment and
Performance Bonds and provide Con-
tractors General Liability and Statuto-
ry Workers Compensation Coverage
once the GMP is agreed upon.
